A meeting of the Board of Local.Improvements of the Village of Deerfield was
called to order by the President.in the Council Chambers of the Village Hall on
Monday, May 3, 1971 at 8:45 p.m. The secretary called the roll and reported that the
following were
Present: Bernard Forrest, President
Charles R. Bootz
Albert E. Brust.
George Kelm
Werner E. Neuman
Stephen M. Slavin
M. Jay Turner, Jr.
Absent: None
and that a quorum was present and in attendance at the meeting. Also present were
Messrs. Richard Houpt, Village attorney, and Norris Stilphen, manager.
Mr. Bootz moved, seconded by Mr. Kelm, that the minutes of the meeting held
March 15, 1971 he approved as submitted. Motion carried unanimously.
10 Day Extension The Engineer's Certificate of Completion of
S/A 107 Escrow Construction, Special Assessment No. 107, Hov-
land sewer and water improvements, was submitted,
showing a total construction cost of $267,741.05. Of this amount, $246,098.45 has
heretofore been paid by vouchers or cash, a $17,000 voucher to George W. Kennedy
Cons.truction Company is in an escrow account at the First National Bank of Deerfield
pending compliance with an escrow agreement, and $4,642.60 has been retained by the
Village pending settlement of claims.
President Forrest reported that a letter from the insurance company stated
claims for damages would not be paid because the damage was intentional. The
Village attorney stated the Village could pay damages from the funds withheld if,
upon investigation, the claims were found to be valid. He reported that two condi-
tions of the escrow agreement had not been met; the time set at 120 days, an d.the
filing of waivers of liens by firms and corporations, including $1,500 for extra
engineering fees by Charles Greengard Associates. Mr. Greengard stated he had filed
the waiver last Ftiday, April 30. '2., - 1
Discussion was had on whether sufficient funds had been retained to cover all
claims for damages. Mr. Kennedy stated he had not been notified by the insurance
company that damages would not be paid, but he was prepared to guarantee personally
and as a corporation to hold the Village harmless for any suits for damages which may
be filed. He will talk to owners who have filed claims, and if they are justified,
he will make payment. He asked the Board to issue a voucher for the amount withheld,
and stated the engineer had certified approval of the full amount. It was the con-
sensus of the Board that no voucher be issued in payment of the amount withheld until
eadence has been presented that all claims have been settled.
Mr. Bootz moved, seconded by Mr. Kelm, that the escrow agreement date be ex-
tended 10 days from today, May 3, 1971. Motion carried unanimously.
There being no further business to come before the Board of Local Improvements,
on Motion by Mr. Bootz, seconded by Mr. Turner, the meeting was adjourned at 9:05 p.m.
