ORDINANCE NO. 0 -11 -12
AN ORDINANCE APPROVING A SIX MONTH EXTENSION
TO SEPTEMBER 1, 2011 OF TEMPORARY ZONING RELIEF
FOR HONQUEST FURNITURE
WHEREAS, Honquest Furniture (the "Applicant ") was previously granted a Special Use by
Ordinance No. 0 -10 -24 (the "Ordinance ") authorizing the establishment and operation of a 22,167
square foot Honquest Furniture Outlet Plus retail store in the Cadwell's Corners Shopping Center in
the C -2 Outlying Commercial District; and,
WHEREAS, said Ordinance further authorized Applicant to install and maintain a temporary
64 square foot west wall sign for Applicant's tenant space, as approved by the ARC, provided that
such temporary sign would be replaced by a permanent sign not later than March 1, 2011; and,
WHEREAS, Applicant has requested an extension of this temporary zoning relief to allow
Applicant to maintain said temporary west wall sign until September 1, 2011 which would allow
Applicant to complete its market analysis of the facility; and,
WHEREAS, the President and Board of Trustees have determined that Applicant's request
for an extension of the temporary sign relief granted by the Ordinance is in the best interests of the
Village and should be authorized as provided herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That Section 3(iv) of Ordinance No. 0 -10 -24 is hereby amended to read as
follows (additions are indicated by underscoring and deletions by str4kethfoug markings):
(iv) the temporary 64 square foot (24 inches in height by 32 feet in length) west
wall sign for Applicant's tenant space, as approved by the ARC, shall be replaced
with a permanent sign approved by the ARC, or removed, not later than March
September 1, 2011;
SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 3: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
