AN ORDINANCE APPROVING AN AMENDMENT
TO THE SIGNAGE PLAN FOR PARKWAY NORTH CENTER
WHEREAS, the owner (the "Petitioner ") of the property commonly known as Parkway North
Center located at the southeast corner of Deerfield Road and Saunders Road and legally described on
Exhibit A attached hereto (the "Subject Property") has petitioned the Plan Commission of the Village of
Deerfield for approval of the following signs (collectively, the "Parkway North Sign Amendments ") as an
amendment to the approved Signage Plan for Parkway North Center to permit: (A) a double -faced 270 sq.
ft. (30 ft. by 9 ft.) Tollway identification sign with a maximum height of 15 feet 7 inches, installed on a
stone base, and consisting of the wording "Parkway North Center" in acrylic dimensional backlit letters,
with black film on the front face, and including: (i) a modification to increase the size of the Tollway sign
from the previously approved 176 square feet to 270 square feet, (ii) a modification to allow not more than
six (6) removable metal sign panels below for tenant corporate identity signage (logo, specific font, etc.),
in black lettering and symbols only, (iii) a modification to increase the height of the sign from the
previously approved height of 9 feet 7 inches to a height of 15 feet 7 inches, and (iv) a modification to
allow the sign to be located 10 feet from the east property line in lieu of the required 50 foot rear yard
setback ; (B) upgrade the existing ground signs at the Deerfield Road and Saunders Road entrances to
Parkway North Center, utilizing the existing stone bases and existing sign boxes, and refacing the signs
with the wording "Parkway North Center ", and including: (i) a modification to allow three (3) tenant
names per sign face placed below the development name, with the sign letters to be acrylic dimensional
backlit letters with black film on the face, and with tenants using their corporate identity (logo, specific
font, etc.) for their tenant identification signage in black lettering and symbols only, and (ii) a modification
to increase the size of the sign from the previously approved 86 square feet (19 feet x 4 feet, 6 inches) to
88 square feet (19 feet, 2 inches x 4 feet 7 inches); and, (C) upgrade the existing building identification
ground signs along Parkway North Boulevard, in their current locations and utilizing their existing sign
boxes and concrete bases, with new sign faces containing building identification names and utilizing
acrylic dimensional backlit sign letters with black film on the front face, including a modification to permit
two (2) tenant names to be placed below the building name with tenants using their corporate identity
(logo, specific font, etc.) for tenant identification signage in black lettering and symbols only; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 10,
2011 to consider Petitioner's request for approval of said Parkway North Sign Amendments as an
amendment to the Signage Plan for Parkway North Center, said hearing being held pursuant to public
notice and conforming in all respects, in both manner and form, with the requirements of the statutes ofthe
State of Illinois and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed
amendments to the approved Signage Plan for Parkway North Center and the evidence and supporting
materials offered at said public hearing, has filed its written report and recommendation with the President
and Board of Trustees containing its written findings of fact and recommendation that the Parkway North
Sign Amendments, but not including the requested modification to allow the Tollway sign to contain six
(6) removable metal sign panels for tenant corporate identity signage, be approved as an amendment to the
Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted
Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield, having
considered and reviewed the Petition and supporting materials submitted by Petitioner and the
findings of fact and recommendations of the Plan Commission, concur in the recommendations of
the Plan Commission and find that said Parkway North Sign Amendments, but not including the
requested modification to allow the Tollway sign to contain six (6) removable metal sign panels for
tenant corporate identity signage, should be approved as an amendment to the Signage Plan for
Parkway North Center to the extent provided herein and in accordance with the plans, drawings and
exhibits presented by the Petitioner and attached hereto as Exhibit B hereof, as an amendment to the
Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and
Restricted Industrial District;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby
authorize and approve an amendment to the approved Signage Plan for Parkway North Center as an
amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District to permit the following signs and sign modifications: (A)
a double -faced 270 sq. ft. (30 ft. by 9 ft.) Tollway identification sign with a maximum height of 15
ft. 7 inches, installed on a stone base, and consisting of the wording "Parkway North Center" in
acrylic dimensional backlit letters, with black film on the front face, and including: (i) a modification
to increase the size of the Tollway sign from the previously approved 176 square feet to 270 square
feet, (ii) a modification to increase the height of the sign from the previously approved height of 9

SECTION 2: That the approval and authorization of said amendments to the approved
Signage Plan for Parkway North Center is hereby granted subject to the following additional
conditions, regulations and restrictions: (i) that the construction, maintenance and use of the signs
described in Section 1 of this Ordinance as hereby approved shall be in accordance with the
supporting documents, materials and exhibits attached hereto and made a part hereof as Exhibit B;
(ii) the construction, maintenance and use of the Subject Property shall continue to be in accordance
with previously approved Signage Plan for Parkway North Center, as hereby amended; (iii)
continued compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance
and Municipal Code of the Village of Deerfield.
SECTION 3: That the amendment to the approved Signage Plan for the Subject Property
hereby approved and authorized as an amendment to the Special Use Planned Unit Development of
the Subject Property shall be binding upon and inure to the benefit of Petitioner and Petitioner's
successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set
forth by the Petitioner or its successors, grantees, transferees or assigns shall authorize the
revocation of the Amended Special Use hereby authorized.
SECTION 4: That the Village Clerk is hereby authorized and directed to record this
Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Petitioner's expense.
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.

approval and publication in pamphlet form as provided by law.
