ORDINANCE NO. 0 -11 -18
AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE
FOR ADDITIONS AND RENOVATIONS TO DEERFIELD
SCHOOL DISTRICT 109 ADMINISTRATION CENTER BUILDING
(517 DEERFIELD ROAD)
WHEREAS, Deerfield School District 109 (the "Applicant ") is the owner of certain property
commonly known as the District 109 Administration Center building at 517 Deerfield Road, and
legally described on Exhibit A attached hereto (the "Subject Property ") and has petitioned the
Village of Deerfield pursuant to Article 7.02 -A, Article 7.02 -C, Paragraph 8, Article 7.06 -B, and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield for approval of an amendment to
the Special Use for the Subject Property in the P -1 Public Lands District to permit: (i) an addition at
the north end of the Administration Center Building consisting of approximately 1,930 square feet
for staff training space and a Board meeting room; (ii) the renovation of approximately 1,300 square
feet of office space at the south end of the existing Administration Center Building; (iii) expansion of
the existing parking lot to the north and west of the existing parking lot; (iv) a modification to reduce
the visual screening requirement along the west side of the Subject Property to provide that the seven
foot (7.0 ft) wood fence depicted on the Site Dimensional and Paving Plan Sheet C -1 listed on
Exhibit B to this Ordinance shall terminate at the northern edge of the parking lot depicted on said
plan which point is approximately 71.45 feet south of the south line of Deerfield Road; and (v) a
modification to reduce the total parking required for the Administration Center building and the
adjacent Kipling Elementary School to permit 137 off - street parking spaces in lieu of the otherwise
required total of 150 off - street parking spaces, (collectively referred to herein as the "Administration
Center Addition and Renovation "); and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
February 24, 2011 to consider said application, said hearing being held pursuant to public notice and
conforming in all respects, in both manner and form, with the requirements of the statutes of the
State of Illinois and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
testimony, documentary evidence and supporting materials offered at said public hearing, filed its
report with the President and Board of Trustees containing its written findings of fact and
recommendation that the requested amended Special Use be authorized pursuant to Article 7.02 -A,
Article 7.02 -C, Paragraph 8, Article 7.06 -13 and Article 13.11 of the Zoning Ordinance of the Village
of Deerfield to permit the Administration Center Addition and Renovation as an amendment to the
Special Use for the Subject Property in the P -1 Public Lands District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and approval of
the Administration Center Addition and Renovation as an amended Special Use, including a
modification to reduce the visual screening requirement along the west side of the Subject Property
to provide that the seven foot (7.0 ft) wood fence depicted on the Site Dimensional and Paving Plan
Sheet C -1 listed on Exhibit B to this Ordinance shall terminate at the northern edge of the parking lot
depicted on said plan, which point is approximately 71.45 feet south of the south line of Deerfield
Road, and a parking modification to reduce the total parking required for the Administration Center
building and adjacent Kipling School property to 137 parking spaces, all to the extent herein
provided;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are
hereby incorporated and made a part of this Ordinance as if fully set forth herein.
SECTION 2: That the President and Board of Trustees do hereby affirmatively find that the
proposed Administration Center Addition and Renovation, hereby authorized as an amended Special
Use of the Subject Property in the P -1 Public Lands District, fully complies with the requirements
and standards for special uses set forth in Article 7.02 -A, Article 7.02 -C, Paragraph 8, Article 7.06 -13
and Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 3: That the President and Board of Trustees of the Village of Deerfield do hereby
authorize and approve the Administration Center Addition and Renovation, as more fully described
on the plans and supporting documents incorporated as part of Exhibit B to this Ordinance, including
but not limited to: (i) an addition at the north end of the Administration Center Building consisting of
approximately 1,930 square feet for staff training and a Board meeting room; (ii) the renovation of
approximately 1,300 square feet of office space at the south end of the existing Administration
Center Building; (iii) expansion of the existing parking lot to the north and west of the existing
parking lot; (iv) a modification to reduce the visual screening requirement along the west side of the
Subject Property to provide that the seven foot (7.0 ft) wood fence depicted on the Site Dimensional
and Paving Plan Sheet C -1 listed on Exhibit B to this Ordinance shall terminate at the northern edge
of the parking lot depicted on said plan which point is approximately 71.45 feet south of the south
line of Deerfield Road; and (v) a modification to reduce the total parking required for the
Administration Center building and the adjacent Kipling Elementary School to permit 137 off - street

parking spaces in lieu of the otherwise required total of 150 off - street parking spaces, (collectively
referred to herein as the "Administration Center Addition and Renovation "), all as an amendment to
the Special Use previously approved for the Subject Property in the P -1 Public Lands District
pursuant to Article 7.02 -A, Article 7.02 -C, Paragraph 8, Article 7.06 -B and Article 13.11 of the
Zoning Ordinance of the Village of Deerfield, subject to the conditions and restrictions set forth in
Section 4 hereof.
SECTION 4: That the approval and authorization of said amended Special Use is granted
subject to the following additional conditions, regulations and restrictions:
(i) the construction, development, maintenance and use of the Administration Center
Addition and Renovations to the Administration Center Building shall be in accordance with
the site plans, floor plans, elevations, landscape plans, engineering plans and supporting
materials attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all
representations made and submitted by the Applicant to the Plan Commission and to the
President and Board of Trustees;
(ii) compliance by the Applicant with all other applicable provisions of the Zoning
Ordinance of the Village of Deerfield.
SECTION 5: That the amended Special Use as hereby authorized shall be binding upon and
inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns,
and any violation of the conditions herein set forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation of the amended Special Use as hereby
authorized.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance

should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
