AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR
CERTAIN SEWER RATE INCREASES
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its
home rule powers, as follows:
SECTION 1: That Section 16 -18 of Article 2, Sewer Rates, of Chapter 16, Plumbing and
Sewers, of the Municipal Code of the Village of Deerfield, be and the same is hereby amended to
read as follows:
Sec. 16 -18. Rates:
(a) There are hereby established the following rates and charges for the
use and service of the sewerage system of the village. Such rates shall be based on
the amount of water supplied by the municipal water supply system to the lot, parcel
of land, building or premises receiving service of the village's sanitary sewerage
system, unless the lot, parcel of land, building or premises is served by a separate
meter approved by the village for measuring water that will not be discharged into the
sanitary sewerage system, in which case no separate sewer user charge shall be
calculated or charged on the amount of water measured by such separate meter.
(b) The charges for the use and service of the village's sewerage system to
any lot, parcel of land, building or premises situated within the corporate limits of the
village are hereby fixed and established as follows, but in no event less than the
minimum monthly charge set forth in subsection (d) of this section:
(1) Sewer User charge .......... $2.42 per 100 cubic feet of water
(c) The charges for the use and service of the village's sewerage system to
any lot, parcel of land, building or premises situated outside the corporate limits of
the village are hereby fixed and established as follows, but in no event less than the
minimum monthly charge set forth in subsection (e) of this section:
(1) Sewer User charge ................. $2.42 per 100 cubic feet of water.
(2) Equalization charge [to equalize plant capital expenses between users
inside and outside of the corporate limits of the village] .....$1.21 per 100
cubic feet of water.
(d) The minimum monthly sewer user charge to be paid for any lot, parcel
of land, building or premises within the village having any connection to the sanitary
sewerage system shall be four and 84/100 dollars ($4.84) per month.
(e) The minimum monthly sewer user charge to be paid for any lot, parcel
of land, building or premises outside the corporate limits of the village having any
connection to the sanitary sewerage system shall be seven and 26/100 dollars ($7.26)
per month.
SECTION 2: That Section 16 -19 of Article 2, Sewer Rates, of Chapter 16, Plumbing and
Sewers, of the Municipal Code of the Village of Deerfield, be and the same is hereby amended to
read as follows:
Sec. 16 -19. Bills; Sewer User Charges:
(a) For any lot, parcel of land, building or premises, the bill for sewer user
rates and charges shall be based on the amount of water used during the current
billing period as measured by the water meter in use.
(b) Any lot, parcel of land, building or premises served either in or without
the corporate limits of the village may, at the owner's expense, be serviced by the
installation of a separate meter for measuring water not to be discharged directly into
the village sanitary sewerage system, and no sewer charge or rental for the service
herein provided for shall be made on the amount of water measured by such separate
meter. Such installation shall be subject to the supervision and approval of the
director of public works.
(c) In all cases in which users of the sanitary sewer system are not supplied
with metered water from the village water supply system or other waterworks system,
the monthly sewer user charge is hereby fixed and established as follows:
(1) Twenty -five dollars ($25.00) per residential unit within the
corporate limits of the Village.
(2) Eighty -seven and 50 1100 dollars ($87.50) per residential unit
outside the corporate limits of the Village.
(3) Fifty dollars ($50.00) per commercial unit within the
corporate limits of the Village.
(4) One hundred seventy -five dollars ($175.00) per commercial
unit outside the corporate limits of the Village.
(d) A ten percent (10 %) additional delinquency charge shall be paid if the bill
is not paid by the first day of the month following the month in which the bill is
rendered.
(e) Between the hours of seven o'clock (7:00) A.M. and twelve o'clock
(12:00) noon daily, the village shall make available a manhole at the village treatment
plant for use by Recreational Vehicles (RV's) in disposing of domestic sanitary water
only. RV's with a village sticker may be permitted to use this service without charge.
RV's without a village sticker shall pay a fee in cash at the time of use consisting of a
service fee of twenty -five dollars ($25.00) per use and a charge of four cents ($0.04)
per gallon of sanitary waste disposed. The operation of this facility may be
discontinued at any time at the discretion of the chief plant operator of the village
treatment plant.
(t) For purposes of this Section 16 -19, the following words and phrases shat l
have the indicated meanings:
(1) Residential Unit. As used in this section, residential unit shall mean a
dwelling consisting of one or more rooms, including individual bathroom and
kitchen facilities, which are arranged, designed or used as a dwelling unit for
one family, including detached single - family residences, two - family attached
residences and multi - family residences. Residential Unit shall not include
multiple family dwelling units that are limited to persons sixty -two (62) years
of age or more or to handicapped persons regardless of age; hotels; or,
extended stay lodging facilities as defined in the zoning ordinance of the
Village of Deerfield.
(2) Commercial Unit. As used in this section, commercial unit means all
premises that are not residential units, that have plumbing fixtures connected
to the village sanitary sewer system, and which are designed for use and
occupancy by the owner of the premises or by an individual tenant.

SECTION 3: That Section 16 -20 of Article 2, Sewer Rates, of Chapter 16, Plumbing and
Sewers, of the Municipal Code of the Village of Deerfield be and the same is hereby amended to
read as follows:
Sec. 16 -20. Deposit; Schedule:
A deposit in accordance with the following schedule shall be made with each
application for sewer service, this sum to be retained by the village to ensure the
payment of all bills. When service to the applicant is discontinued permanently, this
deposit, less any amount still due to the village for services relating to the use of the
municipal sanitary sewer system shall be refunded without interest. Provided that
where an applicant for sanitary sewer service is the owner of the premises to be
served, no such deposit shall be required

SECTION 4: The sewer user charges and rates established and fixed by Sections 1 and 2 of
this Ordinance shall be effective with the billing cycle that commences during the month of June,
2008. The amended schedule of deposits established and fixed by Section 3 of this Ordinance shall
be effective ten (10) days after the passage, approval and publication of this ordinance.
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance

should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
