AN ORDINANCE AUTHORIZING A CLASS B SPECIAL USE
TO PERMIT A BANK AT 660 DEERFIELD ROAD
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
February 8, 2007 to consider the application of the owner (hereinafter referred to at the "Applicant ")
of certain property commonly known as Deerfield Shoppers Court, legally described on Exhibit A
attached hereto (the "Subject Property "), for approval of a Class B Special Use to permit a 2,892
square foot bank without drive - through facilities at 660 Deerfield Road in the C -1 Village Center
District, together with certain site improvements to the Subject Property; and,
WHEREAS, said public hearing was held pursuant to public notice duly given and published
as required by law and conforming in all respects, in both manner and form, with the requirements of
the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
testimony, documentary evidence and supporting materials offered at said public hearing, filed its
report with the President and Board of Trustees containing its written findings of fact and
recommendation that the requested Class B Special Use for a bank without drive - through facilities at
660 Deerfield Road be authorized as a Special Use of the Subject Property in the C -1 Village Center
District pursuant to Article 13.11 and Article 5.01 -C, Paragraph 2, Subparagraph b(2), including the
following site improvements to the Subject Property: (i) the reconfiguration of the north parking lot
to orient parking in the middle of the lot in an east -west direction, new landscaping, the installation
of new lighting fixtures matching Village Streetscape lighting, and the repair and striping of the
parking lot including parking lot directional striping; (ii) the improvement of trash areas serving the
Subject Property with enclosures and/or screening; (iii) the improvement of the rear pedestrian
access way on the west of the Shoppers Court building; (iv) the tuckpointing and painting of the
Amish Furniture Shoppe building; (v) improvements to the Deerfield Road facade of the Shoppers
Court building; and, (vi) the establishment of signage prohibiting left turns onto Deerfield Road
between the hours of 7:00 a.m. and 9:00 a.m. and the hours of 4:00 p.m. and 6 p.m. from the
westernmost driveway on the Subject (collectively referred to herein as the "Site Improvements ");
and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the proposed Class B Special Use for the Subject Property fully complies with the
requirements and standards set forth in Article 5.01 -C, Paragraph 2, Subparagraph b(2) and Article
13.11 of the Zoning Ordinance of the Village of Deerfield and that the best interests of the Village
will be served by the authorization and granting of said Special Use as provided herein, subject to
and in accordance with the plans and supporting materials submitted by the Applicant which are
incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the
Class B Special Use as hereby authorized fully complies with the requirements and standards set
forth in Article 5.01 -C, Paragraph 2, Subparagraph b(2) and Article 13.11 of the Zoning Ordinance
of the Village of Deerfield.

SECTION 2: That the President and Board of Trustees do hereby approve and authorize the
construction, establishment, operation, maintenance and use of a 2,892 square foot bank without
drive - through facilities as a Class B Special Use of the Subject Property in the C -1 Village Center
District, subject to the conditions, regulations and restrictions set forth in Section 3 of this
Ordinance.
SECTION 3: That the approval and authorization of said Class B Special Use is granted
subject to the following conditions, regulations and restrictions: (i) the establishment, development,
maintenance and use of the Subject Property for said Class B Special Use shall be in accordance with
the plans and supporting materials attached and made a part of this Ordinance as Exhibit B hereof;
(ii) Applicant shall cause the Site Improvements to the Subject Property to be made, established and
maintained in accordance with the plans and supporting materials attached and made a part of this
Ordinance as Exhibit B hereof, (iii) the Site Improvements shall be substantially completed not later
than twelve (12) months after the effective date of this ordinance; (iv) compliance with the
statements and representations made and submitted by Applicant to the Plan Commission and to the
Board of Trustees of the Village of Deerfield; (v) approval by the Appearance Review Commission
of the Deerfield Road fagade improvements; (vi) continued compliance with the Zoning Ordinance
and Municipal Code of the Village of Deerfield; and (vii) the benefit of said Special Use is limited to
Deerfield Bank & Trust Company and shall expire at such time as Deerfield Bank & Trust Company
ceases to do business at the premises.
SECTION 4: That the Class B Special Use as hereby authorized shall, except as provided in
Section 3 hereof, be binding upon and inure to the benefit of the Applicant and Applicant's
successors, grantees, transferees and assigns, and any violation of this Ordinance or the conditions,

regulations and restrictions set forth herein by the Applicant or its successors, grantees, transferees or
assigns shall authorize the revocation of the Special Use as hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of
Lake County, Illinois at Applicant's expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.

This memorandum summarizes the results of a site traffic and parking impact analysis conducted
by Kenig, Lindgren, O'Hara, Aboona, Inc. (KLOA. Inc) for a proposed walk -up bank facility
located in Deerfield, Illinois. The proposed bank site is located in an existing strip center
(Deerfield Shoppers Court) located on the north side of Deerfield Road, east of Waukegan Road.
The center is part of a "complex" of retail uses that are interconnected in the rear by a system of
parking.lots and drive aisles. The other retail /commercial uses in the complex are under separate
ownership. The proposed bank will occupy existing space formerly occupied in part by a
sporting goods store. The bank, as planned, will contain approximately 3,266 square feet
It will be walk up only, no drive through. The site location for the bank as well as the entire
complex is shown on Figure 1.
The objectives of this study are to identify existing traffic movements in and out of the center at
the proposed location of the bank along Deerfield Road; identify traffic movements in the rear of
the complex of parking areas and drives along Waukegan Road and also Rosemary Terrace.

conditions in the area and to recommend any street and access improvements necessary to
accommodate .development-generated traffic.
Existing Conditions
In order to project future transportation conditions at the site, four general components of
existing conditions were considered- (1) the geographical location of the site and the land uses in
the area (2) the characteristics of the streets in the site area, (3) access and general circulation
issues, and (4) the traffic volumes on area streets.

Site Location and Adjacent Land Uses
The site, as stated previously, is located on the north side of Deerfield Road east of Waukegan
Road. It is located within the general Deerfield Village Center business district As part of a
complex of separately owned other commercial establishments As such it shares some common
access and parking facilities as well as utilizing its own drives and parking lots
Area Streets
The principal streets in the site vicinity that provide access to the site are described in the
following paragraphs.
Deerfield Road is an east -west arterial extending from Highland Park on the east to Buffalo
Grove. In the site vicinity it is a four lane divided street with no parking on either side of the
street. Left turn lanes are provided at Waukegan road (westbound) and for Rosemary Terrace
(eastbound).
Waukegan Road (IL 43) is a major north -south arterial roadway with two through travel lanes in
each direction and separate left turn lanes at Deerfield Road. On the south approach
(northbound) it has a separate right turn lane.
Rosemary Terrace, which borders the east side of the site, is a north -south local residential street
with parking permitted on the east site. It is signalized at its intersection with Deerfield Road
The south leg of this intersection (Deerfield Road) is the entrance to a mixed -use commercial
development.
Existing Traffic Volumes
As part of this study, KLOA,.Inc. conducted manual traffic counts at the primary access drives to
Deerfield Shoppers Court and the entire commercial complex specifically at Waukegan Road
and also Rosemary Terrace. Additionally, field records were developed noting traffic conditions
on the roads as well as activity occurring within the complex such as vehicles entering and
exiting from drives to /from the east or west as "cut through" traffic. The counts were conducted
during the weekday evening on Tuesday, November 21, 2006 from 4:00.to 6:00 P.M and on
Saturday, November 18, 2006 from 11:00 A.M. to 1:00 P.M. peak periods. Figures 2 and 3
illustrate the existing traffic volumes.
Existing Parking Conditions
Parking areas within the complex were inventoried and occupancies were tabulated for two
sample hours on both Saturday, November 18, 2006 and also Tuesday, November 21, 2006

Shoppers Court. The remaining lots are part of the previously described "complex "

Traffic Characteristics —New Bank Walk -Up Facility
As proposed, the new bank will be a walk up only and will not contain a drive through operation
Existing traffic at the shopping center, as shown and discussed previously, is relatively
moderately low during the peak hours of traffic on the surrounding streets (31 vehicles inbound
and 46 vehicles outbound). This includes traffic for all uses in the center and possibly some "cut
through" traffic from other uses in the complex. The center currently contains four uses
(including, two restaurants). Approximately 3,000+ square feet of the center will be vacant
(pending new leases) after adding the Deerfield Bank and Trust (DBT).
In order to estimate new traffic for the new DBT facility, customer counts at both the west
Northbrook walk up facility as well as the west Lake Forest facility were taken. Based on bank
data, 1.5 transactions per person were assumed. All customers were assigned to be driving a
vehicle alone (conservative estimate). The results of the very low projected volumes are shown
in Table 2.

Evaluation and Recommendations
The impact of new traffic from the bank walk up facility (6 -7 vehicles in and out during the
peak hour) will be small. However, there are some specific site improvements that can be done
to improve circulation and access to both the center and the complex as a whole. They are noted
below by category.
Cut Through Traffic
This complex, and its interconnecting series of driveways, drive aisles and parking lots serN es
vehicles and customers from establishments on the east and west Consequently, this rear area
"cut through" traffic actually provides a convenience and possible benefit to the area by allowing .
vehicles to pass through and avoid the congested intersection of Deerfield Road and Waukegan
Road. A summary of this cut through traffic is (by observation) shown below in Table 3

Cut through volumes during the sample periods were low. Notwithstanding, the site design
shown to the new site plan reflects the following traffic calming recommendations
1. Stop signs should be placed at the intersecting drives connecting the center's parking lot
(Lot C) and entering/exiting to Lots B and D.
2. The lots has been redesigned to improve entry flow and align with the east -west drive
aisle.
3 New landscaped islands are designed to channelize flow from Lot B to the southerly
drive aisle.
4 New lighting should be provided possibly by bollards located in the new planted
medians.
5. New striping will be provided.
6 The north -south transition drive aisle should be striped in accordance with standards to
provide better definition of opposing drive lanes.
Site Access
Access to the shopping center is currently from the rear (as described) and also from Deerfield
Rod. Under the proposed plan, traffic will continue to enter /exit from the Deerfield Rod easterly
drive and either travel to the rear parking area or circulate in a counterclockwise fashion (one
way) to the westerly Deerfield Rod drive This circulation pattern should and. will continue
However, based on field observations, peak hour (westbound) traffic backs up past this
intersection. Consequently, we recommend the following: Left turns (outbound) be prohibited
fro 7:00 to 9:00 A.M. and 4:00 to 6.00 P M. by signage.
Site Improvements and Parking
The front parking areas are used for convenience. Employees should be directed to park in the
rear. The surveys previously shown and discussed indicate large quantities of available parking
in rear Lots C (center owned) and D (municipal). Lot E will continue to be busy and should be
signed for short term parking. We recommend the following:
1 Peak period turn restrictions (previously discussed).
2 Protective barriers for outdoor drives next to the parking areas in Lot E
3 Improved lighting.

Loading
Loading can and should continue for the restaurants and stores in the rear Discussions with the
furniture store indicate current 50 foot tractor trailers entering from Deerfield Rod and exiting
through the rear.
Conclusion
The proposed walk up bank is well located with respect to the area street system and
shopping center location The traffic can be accommodated efficiently by implementing our
recommendations. The site access system with recommended controls is more than adequate to
serve the traffic that is being generated by the bank. Parking on site is more than adequate to
meet the demand with directions for employees to park in the rear. Consequently, the changes to
the site (as described) will actually improve traffic flow for the overall complex as well as the
center.

Observations of traffic backups for westbound Deerfield Rd (extendiniY past entrance along Lot E)
1 Several backups, of a short duration, occurrcd during the red fight signal phase but cleared during the green
light signal phase. These backups occurred only in the left turn lane for vehicles headed southbound on

Subject: Observations from Deerfield Shopping Center (Waukegan Rd. and Deerfield Rd.)
Study Date: Tuesday —November 21 n, 2006
Observations of traffic backups for westbound Deerfield Rd (extending past entrance alone Lot E)•
Several backups, of a short duration, occurred during the red light signal phase but cleared during
the green light signal phase in the 4.00 to 4 15 time period. These backups occurred only in the
left turn lane for vehicles headed southbound on Waukegan Rd. The times of these backups were
at 4.02 p.m., 4:05,4-07,4-13, and 4.15.
Between 4:15 and 5.30 p.m., backups occurred regularly during each red light signal phase for the
left turn lane and for straight thru movements on Deerfield Rd. These backups always cleared
during the green light signal phase and were, on average, about 30 seconds in duration during each
red light signal phase.
Between 5:30 and 6:00 p.m., only two backups (5:35 p.m and 5:42 p.m.) were observed at the red
light signal phase.
Observations of vehicles entering the shopping area from Waukegan Rd. and continuing straight thru to
Rosemary Terrace or from Rosemary Terrace straight thru to Waukegan Rd
• Between 4.00 and 4:15 p m., there were two occurrences of vehicles entering from Waukegan Rd
and exiting at Rosemary Terrace. One vehicle was observed entering from Rosemary Terrace and
exiting at Waukegan Rd.
• Between 4.15 and 4:30 p.m., there were three occurrences of vehicles entering from Waukegan
Rd. and exiting at Rosemary Terrace. One vehicle was observed entering from Rosemary Terrace
and exiting at Waukegan Rd.
• Between 4:30 and 4.45 p.m , there were two occurrences of vehicles entering from Waukegan Rd
and exiting at Rosemary Terrace.
• Between 4:45 and 5:00 p.m., there was one occurrence of a vehicle entering from Waukegan Rd
and exiting at Rosemary Terrace Two vehicles were observed entering from Rosemary Terrace
and exiting at Waukegan Rd.
• Between 5:00 and 5:15 p.m., there were two occurrences of a vehicle entering from Waukegan Rd
and exiting at Rosemary Terrace.
• Between 5:15 and 5:30 p.m., there was one occurrence of a vehicle entering from Waukegan Rd.
and exiting at Rosemary Terrace.
• Between 5:30 and 5'45 p.m., there was one occurrence of a vehicle entering from Waukegan Rd
and exiting at Rosemary Terrace One vehicle was observed entering from Rosemary terrace and
