AN ORDINANCE APPROVING AN AMENDMENT TO THE
SIGNAGE PLAN AND A SIGN MODIFICATION FOR RED ROOF INN
AT 340 SOUTH WAUKEGAN ROAD
WHEREAS, the Plan Comrnission of the Village of Deerfield held a public hearing on
December 14, 2006, to consider the application of the owner of certain property commonly known
as the Red Roof Inn motel at 340 South Waukegan Road, legally described on Exhibit A attached
hereto (the "Subject Property "), for an amendment to the signage plan for the Subject Property to
allow two new wall signs on the east and west walls of the Red Roof.Inn building, including a sign
modification to allow said wall signs to be 133.79 square feet in area in lieu of the maximum 80
square feet allowed by the Zoning Ordinance of the Village of Deerfield, as an amended Special
Use of the Subject Property in the C -2 Outlying Commercial District; and,
WHEREAS, said public hearing was held pursuant to public notice duly given and
published as required by law and conforming in all respects, in both manner and form, with the
requirements of the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Cominission, after considering the proposed amendments .to the
approved signage plan for the Subject Property, including the proposed sign modification to allow
the proposed east and we wall signs to be 133.79 square feet in area in lieu of the maximum 80
square feet allowed by the Zoning Ordinance, together with the evidence and supporting materials
offered at said public hearing, has submitted its report and recommendation to the President and
Board of Trustees of the. Village of Deerfield . that the proposed amendment to.the. signage plan. for.
the Subject Property, including the proposed sign modification, should be approved as an amended
Special Use of the Subject Property in the C -2 Outlying Commercial District to allow a total of two
(2) new wall signs to be placed on the east and west walls of the Red Roof Inn building with a
maximum size of 133.79 square feet; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield find that the
proposed amendment to the approved signage plan should be approved as an amendment to the
Special Use of the Subject Property in the C -2 Outlying Commercial District, and that a sign
modification should be approved for the Subject Property authorizing two (2) 133.79 square foot
wall signs to be installed on the east and west walls of the Red Roof Inn building consisting of the
letters "Red Roof Ii-m" and the Red Roof Inn logo, all in accordance with the plans and exhibits
presented by the Applicant and attached hereto as Exhibit B hereof;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,

in the exercise of its home rule powers, as follows:
SEC'T'ION 1: That the President and Board of Trustees of the Village of Deerfield do
hereby find that the requested amendment to the approved signage plan for the Subject Property;
including. a modification from the regulations set forth in Article 9.02 -B, of the Zoning Ordinance
of the Village of Deerfield, to permit a total of 2 wall signs with a maximwn size of 1' )3.79 square
feet to be installed on the east and west walls of the Red Roof Inn building, fully complies with the
requirements and standards set forth in Article 9 and. Section 13.11 of the Zoning Ordinance of the
Village of.Deerfield..
SECTION 2: That an amendment to the. approved signage plan, including a modification
from the regulations set forth in Article 9, Signs, of the Zoning Ordinance of the Village of
Deerfield, is hereby authorized and approved as an amendment to the Special Use approved for the

Subject Property in the C -2 Outlying Commercial District to authorize and permit: (i) a 133.79
square foot wall sign (14 feet 8.75 inches x 9 feet 1 inch) consisting of the letters "Red Roof Inn"
and logo to be installed on the west elevation of the Red Roof Inn building in accordance with the
plans, drawings and specifications set forth on Exhibit B attached hereto; and (ii) a 133.79 square
foot wall sign (14 feet 8.75 inches x 9 feet 1 inch) consisting of the letters "Red Roof Inn" and logo
to be installed on the east elevation of the Red Roof Inn building in accordance with the plans,
drawings and specifications set forth on Exhibit B attached hereto.
SEC'T'ION 3: That the approval and authorization of said amended signage plan as
amendment to the Special Use approved for the Subject Property, including the approval of said
modification to the sign regulations set forth in Article 9 of the Zoning Ordinance to allow an
increase in the size of the east and west wall signs from 80 square feet to 133.79 square feet, is
hereby granted subject to the following conditions, regulations and restrictions: (i) that the
construction, maintenance and use of the signs hereby approved shall be in accordance with the
supporting documents, materials and exhibits attached and made a part hereof as Exhibit B; (ii)
compliance with the reconnmendations of the Appearance Review Commission and with the
representations made and submitted by Applicant to the Plan Commission and to the Board of
Trustees; (iii) except as otherwise provided herein, the construction, development, maintenance and .
use of the Subject Property shall be in accordance with the Special Use heretofore approved for of
the Subject Property in the C-2. Outlying Commercial District, including the signage plan as Hereby
aiinended; (iv) continued compliance by Applicant with all other applicable _provisions of the Zoning
Ordinance of the Village of Deerfield.
SECTION 4: That the amendment to the approved signage plan for the Subject Property
hereby approved and authorized as .an amendment .to the Special Use of the Subject Property shall
be binding upon and. inure to the benefit of Applicant and Applicant's successors, grantees,

transferees and assigns, and any violation of the conditions hereinabove set forth by Applicant or its
successors; grantees, transferees or assigns shall authorize revocation of the amended Special Use
hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to record this
Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant =s expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate it a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non- preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet forni as provided by law.
