AN ORDINANCE AUTHORIZING A SPECIAL USE
FOR A NATIONAL CITY BANK AT 401 LAKE COOK ROAD
IN LAKE COOK PLAZA
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
February 10, 2005 and March 10, 2005 on the application of National City Bank and the owners of
the Lake Cook Plaza Shopping Center (collectively, the "Applicants ") for approval of a special use
to permit the establishment of a National City Bank facility, including drive - through banking and
automatic teller machine facilities, at 401 Lake Cook Road in the Lake Cook Plaza Shopping Center,
said property being legally described on Exhibit A attached hereto (the "Subject Property ") and being
located in the Lake Cook Plaza Planned Unit Development in the C -2 Outlying Commercial District;
and,
WHEREAS, said public hearing was held pursuant to public notice duly given and published
as required by statute and conforming in all respects, in both manner and form, with the provisions of
the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
evidence, testimony and supporting materials offered at said public hearing, filed its report with the
President and Board of Trustees containing its written findings of fact and recommendation that the
requested Special Use be authorized pursuant to Article 13.11 and Article 5.02 -C, Paragraph 2,
Subparagraph c, and Article 5.02 -C, Paragraph 2, Subparagraph j, of the Zoning Ordinance of the
Village of Deerfield to allow a National City Bank facility, with drive -in banking and. a drive-
through automatic teller machine facility, to be located, established and operated on the Subject
Property as a Special Use in the Lake Cook Plaza Planned Unit Development in the C -2 Outlying
Commercial District; and,
WHEREAS, the Comprehensive Plan of the Village of Deerfield provides for" an
interconnection between the Lake Cook Plaza shopping center and the adjacent Deerbrook Mall
shopping center; and
WHEREAS, the .Village has caused a traffic study to be made of traffic conditions in and
about the Lake. Cook Plaza shopping center and the Deerbrook Mall shopping center to determine the
best means of implementing an interconnection between Lake Cook Plaza shopping center and the
adjacent Deerbrook Mall and to minimize the possible adverse effects of allowing such traffic
movements between the adjacent shopping centers; and
WHEREAS, Applicants and the owners of the Deerbrook Mall shopping center have agreed
to a conceptual plan for implementing an interconnection between the Lake Cook Plaza shopping
Center and the Deerbrook Mall shopping center, a copy of which is attached hereto as Exhibit C and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that substantial evidence supporting the Plan Commission recommendation was adduced
at said public hearing, that the proposed Special Use for the Subject Property fully complies with the
requirements and standards set forth in Article 13.11, Article 5.02 -C, Paragraph 2, Subparagraph c
and Article 5.02 -C, Paragraph 2, Subparagraph j, of the Zoning Ordinance of the Village of
Deerfield, and that the best interests of the Village will be served by the authorization and granting of
said Special Use to the extent herein authorized;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD,.LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the
Special Use as hereby authorized fully complies with the requirements -and standards set forth in
Article 5.02 7C, Paragraph 2, Subparagraph c, Article 5.02 -C, Paragraph 2, Subparagraph j, and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve the
establishment of a free standing bank as a Special Use of the Subject Property in the Lake Cook
Plaza Planned Unit Development in the C -2 Outlying Commercial District permitting the
establishment, operation and use of a National City Bank banking facility, including drive -in banking
facilities and a drive - through automatic teller machine, subject to the conditions, regulations and
restrictions set forth in Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of said Special Use is granted subject to
the following conditions, regulations and restrictions:
A. The establishment, development, maintenance and use of the Subject Property for
said Special Use shall be in strict conformance with the plans and supporting materials
attached hereto and made a part of this Ordinance as Exhibit B hereof, and. with all
representations made and submitted by the Applicant to the Plan Commission and to
President and Board of Trustees of the Village of Deerfield;
B. Cross Access Interconnection with Deerbrook Mall:
1. Applicants shall cooperate with the Village and with the owners of the Deerbrook
Mall shopping center in planning, designing, establishing and operating a cross -
access interconnection for the purpose of allowing motor vehicle access between
the Lake Cook Plaza shopping center and the adjacent Deerbrook Mall shopping
center consisting of: (i) improving and extending the southerly access drive

depicted on the National City Bank site plan to the east property line and the
point of intersection with the Deerbrook Mall on -site traffic circulation system;
and, (ii) improving and extending the north -south Lake Cook Plaza access drive
to the south property line and the point of future intersection with the Deerbrook
Mall east -west peripheral roadway; all in accordance with the conceptual
interconnection design attached hereto as Exhibit C.
2. Applicants shall grant permanent easements in a form approved by the Village
Attorney authorizing mutual traffic movements between the Lake Cook Plaza;
shopping center and the Deerbrook. Mall shopping center in accordance with the
final interconnect design approved by the Village; which shall be in substantial
conformance with the conceptual design attached hereto. Such easements shall
be subject to reciprocal easement rights being granted by the owner of the
Deerbrook Mall shopping center in a form approved by the Village Attorney.
3. Applicant shall submit final plans for Applicants' cross access interconnection
improvements for review and approval by the Village and the Northbrook Fire
Protection District.
4. Applicant shall construct Applicants' cross access interconnection improvements
in an orderly manner in accordance with a schedule approved by the Village.
C. Compliance with the recommendations of the Appearance Review Commission.
D. Continued compliance with the requirements of the Lake Cook Plaza Planned Unit
Development;
E. Compliance by the Applicants with all other applicable provisions of the Zoning
Ordinance of the Village of Deerfield.
SECTION 4: That the following exceptions from the strict compliance with the regulations
of the Zoning Ordinance of the Village of Deerfield are hereby granted and authorized:
A. A modification from the requirement for 781 parking spaces for Lake Cook Plaza
Shopping Center is hereby granted to permit Applicant to provide a minimum total of 769
parking spaces for the uses at Lake Cook Plaza.
B. A modification to provide an eighteen (18 ") inch high landscape screen along Lake
Cook Road in lieu of the required 4 -foot high landscape strip.

C. A modification to allow the ATM directional sign on the drive - through canopy facing
approaching traffic to be up to twelve (12) square feet in size.
SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to
the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any
violation of this Ordinance or the conditions, regulations and restrictions set forth herein by the
Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the
Special Use as hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of
Cook County at Applicant's expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.

INTRODUCTION
Metro Transportation Group, Inc. (Metro) was retained by GPD Group to conduct a
traffic impact analysis for a proposed National City Bank to be located south of Lake
Cook Road on the east side of the Milwaukee District North Line. The development will
feature a one -story, 3,475 square feet bank building, a four -lane drive -thru window
service, and 33 parking spaces.
The following sections of this report present a detailed description of the proposed

SITE TRAFFIC CHARACTERISTICS
To evaluate the impact the proposed National City Bank will have on the area street
system, it was necessary to review how the bank will operate, quantify the number of
vehicle trips the site will generate during the weekday morning, weekday midday,
weekday afternoon, and Saturday midday peak hours.
Proposed Development
Based on the site plan dated November 5, 2004, the site contains a 3,475 square feet
building with a 4 -lane drive -thru service facility. The drive -thru lane closest to the
building will also provide .access to a 24 -hour ATM. The proposed hours of operation for
the lobby are: Monday through Friday from 9:00 AM to 7:00 PM and on Saturday from
9:00 AM to 4:00 PM. The drive -thru facility will be open from 8:00 AM to 7:00 P M
Monday through Friday and on Saturday from 8:00 AM to 4:00 PM. It is estimated that
this banking facility will have a maximum of ten (10) banking professionals at any one
time. The development will also provide thirty -three (33), 90- degree parking spaces.
Vehicle Trip Generation
The volume of traffic generated by the proposed National City Bank was estimated
using the typical Metro surveys of other banks with a drive -thru. These volumes are
lower than ITE trip estimates due to the evolution of banking practices. The increasing
popularity of online banking and ATM's has caused a reduction in site - generated traffic
for banking facilities.
Pass -by trips are typically considered in determining site - generated traffic for a land
use, such as this. Pass -by trips are vehicles that are traveling next to a development
and are "captured" from the immediately adjacent street system. Although a 45% pass -
by trip percentage is applicable for a bank with a drive -thru facility, pass -by trips were
not included in the total traffic volumes to provide for a conservative analysis.
The estimated site - generated trips for the sit -down restaurant that previously
occupied the site and the proposed National City Bank are shown in Table 1 . It
should be noted that Chilli's is not open during the weekday morning.

ANALYSES
Analyses were conducted to determine if the adjacent roadway network would be able
to accommodate the needs of the subject development. As the results will show, the
subject development will have a nominal traffic impact on the adjacent street network,
therefore the intersection of Lake Cook Road and Corporate Drive was not analyzed.
Capacity Analysis
Capacity analyses were conducted for the weekday morning, weekday midday,
weekday afternoon, and Saturday midday peak hours for both the existing and future
conditions using the methodologies outlined in the Highway Capacity Manual' for two -
way stop - controlled intersections (TWSC).
The unsignalized intersection analyses performed calculate the average control delay
to vehicles at an intersection. Control delay is the elapsed time from a vehicle joining .
the queue at a stop sign.(includes the time required to decelerate to a stop) until its
departure from the stop sign and resumption of free -flow speed. The methodology
analyzes each intersection approach controlled by a stop sign and considers traffic
volumes on all approaches, lane characteristics, and the percentage of heavy
vehicles.
The ability of an intersection to accommodate traffic flow is expressed in terms of
LOS, which is assigned a letter from A to F based on the average total delay
experienced by each vehicle passing through an intersection. Level of Service A is
the highest (best traffic flow and least delay), Level of Service E represents saturated
or at- capacity conditions, and Level of Service F is the lowest (oversaturated
conditions). Typically, Level of Service D is the lowest satisfactory level accepted by
public agencies in Northeastern Illinois for design of peak -hour conditions. However,
in dense urban areas, Level of Service E is sometimes considered acceptable for
peak.periods. The Highway Capacity Manual definitions for level of service and the
corresponding delay for unsignalized intersections are contained in the Appendix of
this report.
Summaries of the capacity analysis results for critical intersections are presented in
Table 2 and outlined below. All output worksheets used for these analyses are
contained in the Appendix to this report.

peak periods. The intersection of Internal Drive and West Drive has a 72 -foot queue
length during the weekday midday peak hour. It is not uncommon in a large shopping
center that the collector roadway would experience minor queuing.
RECOMMENDATIONS
The following are recommendations in regard to the internal roadways adjacent to the
proposed National City Bank. All recommendations are illustrated on Figure 5.
1. Access to the retail center to the south should be free flow.
2. The service drive just north of the existing retail center should provide a proper
turning radius for oversized trucks.
3. A DO NOT BLOCK DRIVEWAY SIGN should be placed north of the drive -in
entrance.

CONCLUSIONS
The proposed National City Bank will have a nominal impact on the surrounding
roadway network. The intersection at Lake Cook Road and Corporate Drive Drive will
continue to operate at the same level of service, with a negligible increase in overall
delay.
