AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF DEERFIELD TO AUTHORIZE
DRIVE- THROUGH ATM BANKING FACILITIES AND
CERTAIN GROUND SIGNS FOR FREE STANDING BANKS
IN THE C -2 OUTLYING COMMERCIAL DISTRICT
WHEREAS, National City Bank and the owner of the Lake Cook Plaza Shopping Center
(collectively, the "Petitioner ") have petitioned the Plan Commission of the Village of Deerfield for a
text amendment to Article 5.02 -C of the Zoning Ordinance of the Village of Deerfield to permit a
drive - through automatic teller machine as a special use in the C -2 District when operated in
connection with a bank, savings and loan or other financial institution, and for a text amendment to
Article 9.02 -B of the Zoning Ordinance of the Village of Deerfield to permit a monument ground
sign for a free - standing bank in a shopping center /planned unit development of more than 200,000
square feet and less than 500,000 square feet of gross floor area in the C -2 Outlying Commercial
District; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
February 10, 2005 and March 10, 2005 to consider said text amendments, said hearing being held
pursuant to public notice and conforming in all respects, in both manner and form, with the
requirements of the statutes of the State of Illinois and Zoning Ordinance of the Village of Deerfield;
and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence
and supporting materials presented at said hearing, submitted its written report and findings of fact to
the Board of Trustees of the Village of Deerfield recommending a text amendment to the Zoning
Ordinance of the Village of Deerfield to permit drive - through automatic teller machine facilities as a
special use in the C -2 Outlying Commercial District when operated in connection with a bank,
savings and loan or other financial institution; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence
and supporting materials presented at said hearing, submitted this written report and findings of fact
to the Board of Trustees of the Village of Deerfield recommending a text amendment to the Zoning
Ordinance of the Village of Deerfield to permit certain monument ground signs for free - standing
banks in a planned unit development shopping center of more than 200,000 square feet of gross floor
area and less than 500,000 square feet of gross floor area in the C -2 Outlying Commercial District;
and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the
recommendation of the Plan Commission and have determined that it is in the best interests of the
Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That Paragraph 2 of Article 5.02 -C of Article 5 of the Zoning Ordinance of the
Village of Deerfield, as amended, be and the same is hereby further amended to add the following as
Subparagraph j thereof:
Drive - through automatic teller machine when operated in connection with a
bank, savings and loan or other financial institution.

SECTION 2: That Paragraph 12 of Article 9.02 -B, Commercial Districts of Article 9, Signs,
of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further
amended to add the following as Subparagraph b thereof.
12. C -2 OutlLing Commercial District B Shopping� Center /Planned Unit
Development of more than 200, 000 square feet of rg oss floor area and less than
500, 000 square feet of gross floor area
b. Free standing bank building.
Type
A free standing bank building sign shall be a monument ground sign only.
2. Number and Content
Not more than one (1) ground sign shall be permitted for each free standing
bank building. The sign may only contain the name and/or logo of the
restaurant.
Area
The maximum surface area permitted shall not exceed 16 square feet per face.
The maximum aggregate surface area of the sign shall not exceed thirty -two
(32) square feet. Such sign shall not have more than two (2) exposed faces.
The area of the pedestal shall not be included in calculating the maximum
aggregate surface area of the sign.
4. Location
A free standing restaurant sign may be located in any required yard provided
it does not extend over any lot line and does not cause a safety problem for
entering and exiting vehicles or pedestrians. Said sign shall be located along
the public street or public right -of -way adjacent to the free standing bank
building.
5. Height
Said sign shall not exceed 5 feet, 4 inches in height as measured from grade
at the bottom of the sign to the top of the sign.
6. Illumination
Said sign may be internally illuminated.

SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such .Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 4: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
