AN ORDINANCE REZONING CERTAIN PROPERTIES
AS P -1 PUBLIC LANDS DISTRICT AND AUTHORIZING
AN AMENDMENT TO A SPECIAL USE TO PERMIT CERTAIN
IMPROVEMENTS AND RENOVATIONS TO JEWETT PARK
WHEREAS, the property legally described on Exhibit A attached hereto, being adjacent to
the north end of Jewett Park and commonly known as 803, 819, 825, 845 and 853 Hazel Avenue,
and as 953 -955 and 969 Park Avenue, are located in the Village of Deerfield and are currently zoned
in the R -4 Single and Two - Family Residence District; and,
WHEREAS, Deerfield Park District (the "Applicant ") is the owner of the property legally
described on Exhibit A and has petitioned the Village of Deerfield: (1) to rezone the property legally
described on Exhibit A attached hereto from the R -4 Single and Two - Family Residence District to
the P -1 Public Lands District; and, (2) for approval of an amendment to the existing Special Use for
Jewett Park to permit certain the park improvements and renovations of the north end of Jewett Park
consisting of the demolition of the former senior center /field house building, the construction of a
new shelter /winter warming house with rest rooms and concession areas, the construction of a
renovated playground area, the relocation of a 50 -space parking lot, the construction of various
sidewalks and paths and associated site work and landscaping (collectively referred to herein as the
"Jewett Park Renovations ") on the property described on Exhibit A and on Exhibit B (the original
Jewett Park property) attached hereto, which site is collectively referred to herein as "Expanded
Jewett Park "; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
November 11, 2004 to consider said request for rezoning the property legally described on Exhibit A
to the P -1 Public,Lands District and for approval of an amendment to the previously approved
special use for Jewett Park pursuant to Article 7.02 -B, Paragraph 4, of the Zoning Ordinance of the
Village of Deerfield to permit the Jewett Park Renovations of the Expanded Jewett Park site, said
hearing being held pursuant to public notice and conforming in all respects, in both manner and
form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the
Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
testimony, documentary evidence and supporting materials offered at said public hearing, filed its
report with the President and Board of Trustees containing its written findings of fact and
recommendation to rezone the property described on Exhibit A attached hereto from the R -4 Single
and Two - Family Residence District to the P -1 Public Lands District, and to authorize an amended
special use pursuant to Article 7.02 -B, Paragraph 4 of the Zoning Ordinance of the Village of
Deerfield to permit the Jewett Park Renovations for the Expanded Jewett Park site in accordance
with the plans and supporting materials submitted by the Applicant which are incorporated herein
and made a part hereof by this reference; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered
and reviewed the proposed Jewett Park Renovations plan for the Expanded Jewett Park, the
supporting materials submitted by the Applicant, the evidence adduced at said public hearing and the
findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by amending the Zoning Map of the

Village of Deerfield to change the zoning classification of the property legally described on Exhibit
A attached hereto from the R -4 Single - Family and Two - Family Residence District to the P -1 Public
Lands District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have further
determined that substantial evidence supporting the Plan Commission recommendation was adduced
at said public hearing that the proposed Amended Special Use for the Expanded Jewett Park fully
complies with the requirements and standards set forth in Article 7.02 -C, Paragraph 4, and Article
13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village
will be served by the further authorization and granting of the requested amendment to the Special
Use to permit the proposed Jewett Park Renovations for the Expanded Jewett Park site to the extent
provided herein and in accordance with the plans and supporting materials submitted by the
Applicant, all of which are incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the above and foregoing recitals, being material to this ordinance, are
hereby incorporated by this reference and made a part of this ordinance as if fully set forth herein;
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby
authorize and approve an amendment to the Zoning Map of the Village of Deerfield to change the
zoning classification of the property legally described on Exhibit A attached hereto from the R -4
Single and Two - Family Residence District to the P -1 Public Lands District, subject to the Amended
Special Use for the proposed Jewett Park Renovations as hereby approved and authorized.

SECTION 3: That the President and Board of Trustees of the Village of Deerfield do hereby
authorize and approve the establishment, operation and maintenance of the Jewett Park Renovations
as an Amendment to the Special Use of the Expanded Jewett Park site in the P -1 Public Lands
District pursuant to Article 7.02 -C, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield,
subject to the conditions, regulations and restrictions set forth in Section 4 of this ordinance.
SECTION 4: That the approval and authorization of said Zoning Map Amendment and
Amended Special Use is hereby granted subject to full and continued compliance with the following
conditions, regulations and restrictions:
A. That the construction, development, maintenance and use of the Jewett Park
Renovations for the Expanded Jewett Park site, legally described on Exhibits A and B
attached hereto, shall be in accordance with the documents, materials and exhibits attached
hereto and made a part hereof as Exhibit C;
B. The sidewalk along the west side of the proposed parking lot along Hazel Avenue, as
depicted on Jewett Park Master Plan Sheet L -1, shall be extended to the public sidewalk on
Hazel Avenue;
C. The two (2) sidewalks extending along the west and east sides of the proposed
parking lot to Hazel Avenue, as depicted on Jewett Park Master Plan Sheet L -1, shall be
established at up to ten (10) feet in width, as approved by the Deerfield Police Department
considering public safety, the avoidance of motorist confusion and the prohibition of motor
vehicle entry.
D. . The proposed cell tower depicted on Jewett Park Master Plan Sheet L -1 is not
approved as a part of this Special Use, and any approval of such a use is subject to a separate
application and public hearing;
E. Continued compliance with the requirements of all previous ordinances approving the
existing Special Use for Jewett Park; and
F. Compliance by the Applicant with all other applicable provisions of the Zoning
Ordinance of the Village of Deerfield.

SECTION 5: That the amended Special Use as hereby authorized shall be binding upon and
inure to the benefit of the Applicant and Applicant =s successors, grantees, transferees and assigns,
and any violation of the conditions herein set forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation of the Special Use as hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to publish this
ordinance in pamphlet form and to record this ordinance in the office of the Recorder of Deeds of
Lake County, Illinois at Applicant =s expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.

approval and publication in pamphlet form as provided by law.

Housing — Rugged, die -cast, single -piece
housing. Die -cast door frame has I /8' thick
tempered glass lens. Door frame is fully
gasketed with one -piece solid silicone. Stan-
dard finish is textured dark bronze (DDBT)
corrosion - resistant polyester powder with
other architectural colors availabe.
Installation — Universal mounting mecha-
nism with integral mounting support al-
lows fixture to hinge down. Bubble level
provides correct alignment with each in-
stallation.
Optics — Interchangeable, segmented
reflectors for superior uniformity and con-
trol. Three full cutoff distributions avail-
able: FT (forward throw) ; MD (medium
throw), and WT (wide throw). Four up-
lightdistributions available: FTU (Forward
throw 10% up), MDU (medium throw, 10%

Features
Housing — Rugged, die -cast, soft - corner
aluminum housing with 0.12" nominal wall
thickness. Die -cast aluminum doorframe
has prismatic, impact- resistant,tempered
glass; drop dish acrylic lens or drop dish
polycarbonate lens. Door frame is fully
gasketed with one -piece tubular silicone.
Surface mounted utilizing four0.5" mount-
ing holes and one 0.875 wire -entry hole
(mounting hardware not included). Dark
bronze (DDB) corrosion- resistant polyes-
ter powder finish is standard. Other ar-
chitectural colors available.
Optics — Reflector is optical - quality alumi-
num that works in tandem with a light -
diffusing prismatic lens.

powerfactor (150W) or high -power factor,
constant - wattage autotransformer (175 -
400W MH & HPS).
Socket — Mogul -base porcelain socket,
