AN ORDINANCE APPROVING A FINAL DEVELOPMENT PLAN AND
AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT
FOR THE CHICAGOLAND JEWISH HIGH SCHOOL IN THE I -1
OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT
WHEREAS, Petitioner Chicagoland Conservative Jewish High School Foundation, the
owner of certain property commonly known as 1095 Lake Cook Road and legally described on
Exhibit A attached hereto and made a part hereof (the "Subject Property "), has petitioned the Plan
Commission of the Village of Deerfield to permit the development of a private high school as a
Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and
Restricted Industrial District under and pursuant to the provisions of Article 6.01 -C, Paragraph 16,
Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended,
including variations to allow motor vehicle parking in the west, east and south perimeter setbacks of
the proposed Planned Unit Development; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June
10, 2004 to consider Petitioner's proposed Preliminary Development Plan to authorize a private high
school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District, said hearing being held pursuant to public notice and
conforming in all respects, in both manner and form, with the requirements of the statutes of the
State of Illinois and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed Preliminary Development Plan for the Subject Property and the evidence and supporting
materials offered at said public hearing, submitted its written report to the Board of Trustees of the
Village of Deerfield recommending approval of the Preliminary Development Plan to allow a private
high school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concurred in the
recommendation of the Plan Commission to approve the Preliminary Development Plan submitted
by the Petitioners for approval of a private high school as a Special Use Planned Unit Development
of the Subject Property; and,
WHEREAS, Petitioner has now submitted a Final Development Plan to the Plan
Commission of the Village of Deerfield for approval of a private high school as a Special Use
Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted
Industrial District pursuant to the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, after considering the evidence and supporting materials submitted by the
Petitioner, the Plan Commission has determined that the Final Development Plan is in substantial
conformance with the previously approved Preliminary Development Plan for the Subject Property
and should be approved as a Special Use Planned Unit Development of the Subject Property in the I-
1 Office, Research and Restricted Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield are of the
opinion that said Final Development Plan should be approved as a Special Use Planned Unit
Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District
authorizing and permitting the construction, development and use of the Subject Property as a private
high school in accordance with the Final Development Plan attached.hereto and made a part hereof
as Exhibit B, and with the evidence and supporting materials submitted by the Petitioner which are
incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby find that the Final
Development Plan for the Subject Property attached hereto and made a part hereof as Exhibit B fully
complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 16, Article 12.09
and Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve the
Final Development Plan attached hereto and made a part hereof as Exhibit B as a Special Use
Planned Unit Development of the Subject Property authorizing and permitting the construction,
development and use of a private high school on the Subject Property in the I -1 Office, Research and
Restricted Industrial District, including variations to allow motor vehicle parking in the west, east
and south perimeter setbacks to the extent depicted in the Final Development Plan, and subject to the
conditions, regulations and restrictions set forth in Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of said Final Development Plan is hereby
granted subject to the following conditions, regulations and restrictions:

A. That the construction, development and use of the Subject Property shall be
in accordance with the documents, materials and exhibits comprising the
Final Development Plan for the Subject Property attached hereto and made a
part hereof as Exhibit B.
B. That authorized private high school shall include a three -story classroom
building containing 66,300 square feet with a student enrollment capacity of
200, including an unlit soccer field, unlit tennis courts, landscaping, .site
lighting, signage, utility, drainage, surface parking for 175 vehicles and traffic
and pedestrian circulation improvements, all in accordance with the Final
Development Plan attached hereto as Exhibit B.
C. The addition of a future three -story classroom building and auditorium
containing 56,240 square feet with a student enrollment capacity of 200 is
authorized in concept, subject to the future submission and approval of an
amendment to the Final Development Plan in accordance with the Zoning
Ordinance of the Village of Deerfield.
D. The future auditorium shall be used for school activities only.
E. Petitioner acknowledges that the property abutting and immediately east of
the Subject Property is zoned and used for public uses including
telecommunications antenna towers and structures, and that the future
construction of additional telecommunications antenna towers and structures
on said property is consistent with the Comprehensive Plan of the Village of
Deerfield and is likely to occur. Petitioner represented to the Plan
Commission and the President and Board of Trustees of the Village of
Deerfield that such uses are compatible with the private high school use
approved for the Subject Property by this ordinance and that the Petitioner
has knowingly and voluntarily waived any objections to any such future use
of the abutting property.
F. All representations submitted and made by the Petitioner to the Plan
Commission and to the President and Board of Trustees of the Village of
Deerfield.
G. Petitioner's initial and continued compliance with all other applicable
provisions of the Development Code and Zoning Ordinance of the Village of
Deerfield.
SECTION 4: That the corporate authorities of the Village of Deerfield do hereby approve
the Development Agreement for Chicagoland Jewish High School, a copy of which is attached

hereto as Exhibit C hereof, and the Village President and the Village Clerk be and they are hereby
authorized and directed to execute said Development Agreement for and on behalf of the Village of
Deerfield.
SECTION 5: That the Final Development Plan hereby approved and authorized as a Special
Use Planned Unit Development authorizing a private high school on the Subject Property shall be
binding upon and inure to the benefit of Petitioner's successors, grantees, transferees and assigns,
and any violations of the conditions hereinabove set forth by Petitioner or its successors, grantees,
transferees or assigns shall authorize the revocation of the Special Use hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to record this
Ordinance in the Office of the Recorder of Deeds of Cook County, Illinois at Petitioner's expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.

DEVELOPMENT AGREEMENT
CHICAGOLAND JEWISH HIGH SCHOOL
This Development Agreement is dated this day of , 2004, by and
between the Village of Deerfield, Lake and Cook Counties, Illinois, a municipal corporation
( "Village "), and Chicagoland Conservative Jewish High School Foundation, an Illinois not - for -profit
corporation ( "Developer ")
RECITALS:
A. The Developer is the owner and developer of certain property in the Village described
on Exhibit A attached hereto and made a part hereof (the "Subject Property ").
B. Pursuant to relevant provisions of the Village Zoning Ordinance, the Developer has
made application to the Village for certain approvals, including: (i) a text amendment to the Zoning
Ordinance to permit a private high school as a special use in the I -I Zoning District; (ii) a text
amendment to allow certain identification signage for a private high school in the I -I Zoning District;
(iii) authorization of a Special Use Planned Unit Development to permit a private high school to be
located on the Subject Property which is a 7.32 acre parcel of land located south of Lake Cook Road
and commonly known as 1095 Lake Cook Road; (iv) approval of a Final Development Plan for the
Subject Property; and (v) granting of certain variances from the Deerfield Development Code to the
extent allowed in paragraph 6 below.
C. Pursuant to due and proper notice, the Village Plan Commission conducted a public
hearing on the Developer's application and submitted its Report and Recommendation to the
President and Board of Trustees for approval of the requested Special Use Planned Unit
Development in accordance with a Preliminary Development Plan submitted by the Developer.
D. The President and Board of Trustees reviewed the Report and Recommendation of the
Plan Commission and granted the Developer's request for Preliminary Development Plan approval
on July 6, 2004.
E. The Developer has submitted certain plans, schedules, specifications and other
documents comprising its Final Development Plan as defined in the Village Zoning Ordinance that
are listed on Exhibit B attached hereto. The Final Development Plan has been submitted to,
reviewed by, and recommended for approval by the Plan Commission of the Village of Deerfield.
F. The President and Board of Trustees have reviewed the Final Development Plan and
have adopted (or contemporaneously with the adoption of this Agreement will adopt) all necessary
ordinances, passed all necessary motions, and otherwise granted all necessary approvals: (i) adopting
certain text amendments to Articles 6 and 9 of the Village Zoning Ordinance; (ii) authorizing the
Special Use Planned Unit Development for the Subject Property; (iii). approving the Developer's
Final Development Plan; and (iv) granting certain variations from the Deerfield Development Code
(as defined below). Copies of the authorizing Ordinance and other approval measures are attached
hereto as Exhibit C.
G. The Village has heretofore adopted the "Deerfield Development Code"
( "Development Code "). Among other things, the Development Code calls for the Village and the
Developer to enter into a "Development Agreement" relative to the development of the Subject
Property.
H. In accordance with Article III of the Development Code, this Agreement has been
reviewed by the Director of Community Development, the Village Engineer, and the Village Plan
Commission.

I. The parties now desire to enter into this Development Agreement, pursuant to the
applicable provisions of the Development Code, for the purposes set forth in the Development Code.
NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES
HERETO, as follows:
Incorporation of Recitals. The recitals set forth above are incorporated herein as if
fully set forth.
2. Identification of Development/Improvement Plan.
A. For purposes of this Agreement, the "Final Development Plan" shall consist of
the documents listed on Exhibit B hereto, which documents have been approved by the President and
Board of Trustees pursuant to the Development Code and which are hereby incorporated and made a
part of the Agreement by this reference.
B. In accordance with Section 3 -101 -B of the Development Code, the Developer
has provided the Village Engineer and the Director of Community Development with copies of its
Improvement Plan as part of its Final Development Plan. The term "Improvement Plan" when used
herein shall include only those documents and/or plans, or those specific parts of documents and/or
plans, listed in Exhibit B that depict public or private improvements as they are defined and
specifically identified hereafter. Said final engineering plans are identified as part of Exhibit B.
Developer shall grant to the Village all easements reasonably required by the Village that are related
to the Improvement Plan.
3. Site Development Schedule. In accordance with Section 3- 102- B(4)(a) of the
Development Code, the development of the Subject Property will proceed substantially in
accordance with the schedule attached hereto as Exhibit D and made a part hereof. The parties

recognize and acknowledge that this development schedule is subject to variables relating to weather,
strikes, work stoppages, acts of God and other matters outside of the reasonable control of the
Developer, its contractors and subcontractors.
4. Development/Improvement Details. Pursuant to Section 3- 102- B(4)(b) of the
Development Code, all proposed improvements are depicted and detailed on the Improvement Plan.
5. Performance Guarantee. Except as provided in the following subparagraphs,
Developer shall submit a performance guarantee as required by Article IV of the Development Code.
A. In accordance with Article IV and Section 3- 102- B(4)(c) of the Development
Code, Developer shall provide to Village, in a form satisfactory to the Village, an irrevocable
commercial letter of credit equal to twenty percent (20 %) of the total cost estimate for all
public improvements depicted on the Improvement Plan and for the following private
improvements: utilities, drainage, parking lot, landscaping and fencing (collectively, the
"Guaranteed Improvements ").
B. In lieu of providing the letter of credit required pursuant to subparagraph 5.A
prior to the time of adoption of the Final Development Plan authorizing the Special Use
Planned Unit Development for the Subject Property as required by the Development Code,
Developer may elect to provide the Village with the unconditional commitment of a
commercial bank or financial institution authorized to do business in Illinois to provide the
required letter of credit within one (1) year from the time of adoption of the Final
Development Plan. In no event, however, shall Developer be entitled to the issuance of any
permit for work on the Subject Property, nor shall Developer commence any site
development or utility work on or adjacent to the Subject Property, until the required letter of

credit has been deposited with the Village in replacement of such alternate performance
guarantee.
C. At the time that Developer completes the Guaranteed Improvement(s) in
accordance with the Improvement Plan and makes payments for such Guaranteed
Improvement(s), and as a prerequisite to any partial reduction of the performance guarantee,
Developer shall provide Village with documentation: (i) identifying the specific Guaranteed
Improvements completed by Developer, (ii) the estimated cost for such Guaranteed
Improvements, (iii) certificates from the Inspecting Engineer (defined below) that such
Guaranteed Improvements have been fully and satisfactorily completed, (iv) all appropriate
contractor and/or subcontractor lien waivers for the work performed and materials supplied
for the specific Guaranteed Improvements, and (v) such other and further invoices, bills,
contracts or documentation as the Village shall reasonably request to evidence completion of
the Guaranteed Improvements in accordance with the Improvement Plan. Except as
expressly modified herein, all reductions and the final discharge of the letter of credit shall be
in accordance with Sections 4 -107 and 4 -109 of the Development Code.
D. Developer is a not - for - profit corporation and, based on the Village's review
and approval of the Final Improvement Plan, the schedule of development and Developer's
financing, the Village, pursuant to Sections 3- 102- B(4)(c) and Section 4 -102 of the
Development Code, has approved a reduced performance guarantee as described in
subparagraph 5.A hereof.
6. Approved Conditions, Requirements and Variations. Pursuant to Section 3 -102-
B(4)(d) of the Development Code, the public and private improvements identified on the
Improvement Plans shall conform to the Design and Improvement Standards set forth in Article V of

the Development Code, except for the following specific conditions, requirements, and variations, as
contemplated by the Final Development Plan and Improvement Plan, which are hereby approved, to
wit: NONE.
7. Permit Fees. Pursuant to Section 6 -7 of the Municipal Code of the Village of
Deerfield, no building or plumbing permit fees shall be charged for the issuance of a building permit
for construction of a private high school on the Subject Property in accordance with the Final
Development Plan authorizing such construction. Except as specifically provided herein, nothing in
this Agreement shall be construed as waiving or modifying any plan review fees, inspection fees or
other fees applicable to development of the Subject Property or to the construction of a private high
school on the Subject Property
8. Compliance with Other Rules and Regulations. Except as specifically provided
herein, the development of the Subject Property shall proceed in accordance with the ordinances
described hereinabove and with applicable provisions of the Deerfield Municipal Code.
9. Inspecting Engineer. Pursuant to Section 4 -106 of the Development Code, the
Village Engineer, or any mutually acceptable registered professional engineering firm designated by
the Village Engineer, shall be the "Inspecting Engineer" authorized to ensure that the development
complies with the approved Improvement Plan, the Village Standards and Specifications Manual and
this Agreement. To the extent that the Village Engineer designates a professional engineering firm
to serve as the Inspecting Engineer, such Inspecting Engineer shall invoice the Village for
engineering services rendered and the developer shall promptly reimburse the Village for such
engineering fees and costs.
10. Remedies. Upon breach of this Agreement, any party in a court of competent
jurisdiction may obtain all appropriate relief, including, but not limited to, specific performance,

injunction or damages. Notwithstanding the foregoing, before the failure of any party to perform its
obligation under this Agreement may be considered a breach, the party claiming such failure shall
notify, in writing, the party alleged to have failed to perform, and shall demand performance. No
breach may be found to have occurred if performance has commenced to the reasonable satisfaction
of the complaining party within thirty (30) days of receipt of such notice and if the failing party
pursues diligently the curing of such failure.
11. Estoppel Certificate. Developer, its successors or assigns may request and obtain
from the Village a letter or certificate, stating: (i) whether this Agreement and the Ordinances and
resolutions referred to herein are in full force and effect; (ii) which covenants and requirements of
this Agreement and said Ordinances have been fully performed to the best of the Village's
knowledge; (iii) that the Developer is not in default of its obligations under this Agreement and such
Ordinances, or if Developer is in default, the nature and extent of such default; and (iv) the nature
and extent of any amendment or modification to this Agreement or such Ordinances.
12. Notices. All notices, elections and other communications between the parties hereto
shall be in writing and shall be mailed by certified mail, return receipt requested, postage prepaid, or
delivered personally to the parties at the following addresses, or to such other addresses as the parties
by notice shall designate:

13. Successors and Assigns. This Agreement shall be binding upon the parties, their
respective successors and assigns.
14. Authority. The parties warrant and represent that they have the power and authority
to enter into this Agreement in the names, titles and capacities herein stated.
15. Miscellaneous.
(a) Captions. The captions herein are inserted for the convenience of the parties
and are not to be construed as an integral part of the Agreement.
(b) Governing Law. This Agreement shall be governed by and construed in
accordance with Illinois law.
(c) Severability. If any provision, covenant, agreement or portion of this
Agreement is held invalid, such invalidity shall not affect the application or validity of such other
provisions, covenants or portions of this Agreement.
(d) Entire Agreement.. This Agreement supersedes any prior agreements,
negotiations and exhibits and is a full integration of the entire Agreement of the parties. The exhibits
to this Agreement are expressly incorporated herein.

(e) Counterparts and Duplicate Original. This Agreement may be executed in any
number of counterparts and duplicate originals, each of which shall be deemed an original, but all of
which shall constitute one and the same instrument.

AN ORDINANCE APPROVING A FINAL DEVELOPMENT PLAN AND
AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT
FOR TIIE CMCAGOLAND JEWISH HIGH SCHOOL IN THE I -1
OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT
WHEREAS, Petitioner Chicagoland Conservative Jewish High School Foundation, the
owner of certain property commonly known as 1095 Lake Cook Road and legally described on
Exhibit A attached hereto and made a part hereof (the "Subject Property"), has petitioned the Plan
Commission of the Village of Deerfield to permit the development of a private high school_ as a
Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and
Restricted Industrial District under and pursuant to the provisions of Article 6.01 -C, Paragraph 16,
Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended,
including variations to allow motor vehicle parking in the west, east and south perimeter setbacks of
the proposed Planned Unit Development; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June
10, 2004 to consider Petitioner's proposed Preliminary Development Plan to authorize a private high
school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted h-idustrial District, said hearing being held pursuant to public notice and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed Preliminary Development Plan for the Subject Property. and the evidence and supporting
materials offered at said public hearing, submitted its written report to the Board of Trustees of the
Village of Deerfield recommending approval of the Preliminary Development Plan to allow a private
high, school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concurred in the
— - ��recom�iendatiori of the Plan Commission to approve the Preliminary-Devetopment Phn submitted
by the Petitioners for approval of a private high school as a Special Use Planned Unit Development
of the Subject Property; and,
WHEREAS, Petitioner has now submitted a Final Development Plan to -the Plan
Commission of the Village of Deerfield for approval of a private high school as a Special Use
Planned Unit Development of the Subject Property in the 1 -1 Office, Research and Restricted
Industrial District pursuant to the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, after considering the evidence and supporting materials submitted by the
Petitioner, the Plan Commission has determined that the Final Development Plan is in substantial
conformance with the previously approved Preliminary Development Plan for the Subject Property
and should be approved as a Special Use Planned Unit Development of the Subject Property in the I-
1 Office, Research and Restricted. Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield are of the
opinion .that said Final Development Plan should be, approved as a Special Use Planned Unit
Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District
authorizing and permitting the construction, development and use of the Subject Property as a private
high.school in accordance with the Final Development Plan attached. hereto and made a part hereof
as Exhibit B, and with the evidence and supporting materials submitted by the Petitioner which are
incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEER-FIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby find that the Final
-- - -- Development Plan for the Subject-Property attached hereto andbiade a part hereof as Exhibit B ftilly
complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 16, Article 12.09 .
and Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve the
Final Development Plan attached hereto and made a part hereof as Exhibit B as a Special Use
Planned Unit Development of the Subject Property authorizing and pennitting the construction,
development and use of a private high school on the Subject Property in the I -1 Office, Research and
Restricted Industrial District, including variations to allow motor vehicle parking in the west, east
and south perimeter setbacks to the extent depicted in the Final Development Plan, and subject to the
conditions, regulations and restrictions set forth in Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of said Final Development Plan is hereby
granted subject to the following conditions, regulations and restrictions:
A. That the construction, development and use of the Subject Property shall be
in accordance with the documents, materials and exhibits comprising the
Final Development Plan for the Subject Property attached hereto and made a
part hereof as Exhibit B.
B. That authorized private high school shall include a three -story classroom
building containing 66,300 square feet with a student enrollment capacity of
200, including an unlit soccer field, unlit tennis courts, landscaping, site
lighting, signage, utility, drainage, surface parking for 175 vehicles and traffic
and pedestrian circulation improvements, all in accordance with the Final
Development Plan attached hereto as Exhibit B.
C. The addition of a future three -story classroom building and auditorium
containing 56,240 square feet with a student enrollment capacity of 200 is
authorized in concept, subject to the future submission and approval of an
amendment to the Final Development Plan in accordance with the Zoning
Ordinance of the.Village of Deerfield..

E. Petitioner acknowledges that the property abutting and immediately east of
the Subject Property is zoned and used for public uses including
telecommunications antenna towers and structures, and that the future
construction of additional telecommunications antenna towers and structures
on said property is consistent with the Comprehensive Plan of the Village of
Deerfield and is likely to occur. Petitioner represented to the Plan
Commission and the President and Board of Trustees of the Village of
Deerfield that such uses are compatible with the private high school use
approved for the Subject Property by this ordinance and that the Petitioner
has knowingly and voluntarily waived any objections to any such future use
of the abutting property.
F. All representations submitted and made by the Petitioner to the Plan
Commission and to the President and Board of Trustees of the Village of
Deerfield.
G. Petitioner's initial and continued compliance with all other applicable
provisions of the Development Code and Zoning Ordinance of the Village of
Deerfield.
SIECTION 4: That the corporate authorities of the Village of Deerfield do hereby approve
the Development Agreement for Chicagoland Jewish High School, a copy of which is attached

hereto as Exhibit C hereof, and the Village President and the Village Clerk be and they are hereby
authorized and directed to execute said Development Agreement for and on behalf of the Village of
Deerfield.
SECTION 5: That the Final Development Plan hereby approved and authorized as a Special
Use Planned Unit Development authorizing a private high school on the Subject Property shall be
binding upon and inure to the benefit of Petitioner's successors; grantees, transferees and assigns,
and any violations of the conditions hereinabove set forth by Petitioner or its successors, grantees,
transferees or assigns shall authorize the revocation of the Special Use hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to record this
" -- �-Ordiriarice in Office of the Recorder of Deeds "of Cook County; Illinois at Petitioner s expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.

DESCRIPTION
The Vision Flood Medium (VFM) lower knuckle slip -fits over a standard 2'
pipe size (2 3/8" O.D.) tenon. VFM can be mounted to the following
accessories: Surface Mount Tenon (SMT), Stanchion Mount Tenon (ST), Twin
Mount Arm Tenon (TMT), and Wall Mount Arm Tenon (WMT).

4' tall standard 2" pipe size (2 3/8" O.D.)

STANCHION MOUNT TENON [ST]'
Used to mount fixture above grade to solid
surface, or partially buried when secured to
concrete pad. Cast luminum housing and
mounting plate is 18" tall and is supplied with
a standard 2" pipe size (2 3/8" O.D.) tenon.
TWIN ARM MOUNT TENON [TMT]
Soft form extruded aluminum arm is 24" in
length and features two (2) standard 2" pipe
size (2 3(8" O.D.) tenons for twin fixture
mount. Other lengths and drilling patterns
available upon request. Twin arm base slip
fits over standard 2" pipe size (2 318" O.D.)
tenon. End caps are removable for wiring
access. Useful In ground mount and pole
mount applications. For extended downward
aiming, utilize PM1 or PM2 in conjunction

WALL MOUNT ARM TENON [WMT]
Extruded aluminum arm with cast mounting
- - -plate is 15" in length-and is supplied with-a---

useful as an arm extension off square area

EXTERNAL GRID LOUVERS
Designed to control lamp glare and spill light
while maintaining beam efficiency. Useful
when aiming direction or intended target lies

motor vehicle activity. Mounts to accessory
channel in doorframe. Finished in black
powder coat paint. Compatible with all

TOP VISOR
Controls excess spill and glare on top

Specifications
HOUSING
The lamp housing shall be extruded 6061 T-6 aluminum. The removable end
caps shall be cast #356 aluminum sealed with a silicone gasket. Guards are
heavy cast aluminum. The mounting plate shall be cast;r1356 aluminum with
a minimum wall thickness of .250 Inches. All hardware shall be stainless
steel. Lenses shall be tempered glass on the square units and formed opal
acrylic on the round units. Reflectors shall be formed specular aluminum,

The louver assembly shall have a formed frame with four adjustable louver
blades. The blades shall be spring tensioned and held parallel in place with
a positioning strap. The socket shall be mounted to an adjustable yoke for
lamp positioning. Louvers are finished in matte black.
ELECTRICAL
All electrical components and materials shall be U.L. recognized. Ballasts are
high power factor rated for -30° starting. Medium base porcelain sockets are
4KV rated. Mogul base porcelain sockets are 4KV rated. The electrical
assembly shall be prewired with quick disconnects for servicing.
MOUNTING
The cast mounting plate shall attakdr to the wall through two holes, 12.375
inches at center. The fixture shall slip over a lip along the top edge of the

FINISH
Fixture finish shall consist of cleaning, etching, and rinsing followed by a
protective chromate primer, delonized water rinse, oven dry off and top coat-
ed with a thermoset TGIC super polyester powder coat finish. The finish
shall meet the AAMA 605.2 performance specification which includes pass-
ing a 3000 hour salt spray test for corrosion resistance.
RELAMPING
The lamp is accessed by loosening three set screws and removing the end cap.
CERTIFICATION
Fixtures shall be listed with U.L. Laboratories for wet location use.
WARRANTY
Fixture shall be warranted to be free of defects for three years, Ballast compo-
nents shall carry the ballast manufacturers limited warranty.

electrical compartment A solid barrier wall separates the optical and
electrical compartments, with gasketed wire penetrations. A double -
thick wall with gussets is provided on the support arm mounting end.
Inset sections on each end provide for attachment of optional
entablatures, and cradle the mounting arm. All hardware is stainless
steel or electro -zinc plated steel.
Lens Frame: One -piece die -cast, low copper k 0.6% Cu) aluminum
with a 1' minimum thickness around the basket flange for rigidity.
Integral hinges with stainless steel pins provide no-tool mounting and
removal from the housing. Two stainless steel thumb - latches are
recessed into the front comers, concealed from normal view. Lens frame
seals against the housing by a one -piece extruded silicone gasket with
vulcanized end closure. Clear Me' thick tempered flat or convex glass
lens is retained in the frame by. eight clips with full silicone gasketing
around the perimeter. '
Reflector Module: Specular Alzak® optical segments are rigidly
mounted in a die -cast aluminum enclosure which attaches to the
housing as a one -piece module. Reflector module is field- rotatable in
90° increments. MH and HPS sockets are porcelain 4KV medium base.
All reflector modules are factory prewired with a quick - disconnect plug
for the ballast module, with wires passing through a silicone gasket in
the housing barrier wall. Four light distributions are available and
interchangeable within the same housing-size - --- - - - -,- --
Electrical Module: All electrical components are UL and CSA
recognized, mounted on a single plate and factory prewired with quick -
disconnect plugs. Electrical module attached to housing with no-tool
hinges and latches, accessible by opening the lens frame. All ballasts are
high power factor with starting temperatures of -t0 °F for HPS and -20OF
for MH lamp modes. See lamp and electrical data on pages 20 - 21 for
ballast types and characteristics.

DEVELOPMENT AGREEMENT
CHICAGOLAND JEWISH HIGH SCHOOL
This Development Agreement is dated this � day of 6trem be r, 2004, by and
between the Village of Deerfield, Lake and Cook Counties, Illinois, a municipal corporation
( "Village "), and Chicagoland Conservative Jewish High School Foundation, an Illinois not - for - profit
corporation ( "Developer ").
RECITALS:
A. The Developer is the owner and developer of certain property in the Village described
on Exhibit A attached hereto and made a part hereof (the "Subject Property").
B. Pursuant to relevant provisions of the Village Zoning Ordinance, the Developer has
made application to the Village for certain approvals, including: (i) a text amendment to the Zoning
Ordinance to permit a private high school as a special use in the I -I Zoning District; (ii) a text
amendment to allow certain identification signage for a private high school in the I -I Zoning
District; (iii) authorization of a Special Use Planned Unit Development to permit a private high
school to be located on the Subject Property which is a 7.32 acre parcel of land located south of
Lake Cook Road and commonly known as 1095 Lake Cook Road; (iv) approval of a Final
Development Plan for the Subject Property; and (v) granting of certain variances from the Deerfield
Development Code to the extent allowed in paragraph 6 below.
C. Pursuant to due and proper notice, the Village Plan Commission conducted a public
hearing on the Developer's application and submitted its Report and Recommendation to the
President and Board of Trustees for approval of the requested Special Use Planned Unit
Development in accordance with a Preliminary Development Plan submitted by the Developer.
D. The President and Board of Trustees reviewed the Report and Recommendation of
the Plan Commission and granted the Developer's request for Preliminary Development Plan
approval on July 6, 2004.
E. The Developer has submitted certain plans, schedules, specifications and other
documents comprising its Final Development Plan as defined in the Village Zoning Ordinance that
are listed on Exhibit B attached hereto. The Final Development Plan has been submitted to,
reviewed by, and recommended for approval by the Plan Commission of the Village of Deerfield.
F. The President and Board of Trustees have reviewed the Final Development Plan and
have adopted (or contemporaneously with the adoption of this Agreement will adopt) all necessary
ordinances, passed all necessary motions, and otherwise granted all necessary approvals: (i) adopting
certain text amendments to Articles 6 and 9 of the Village Zoning Ordinance; (ii) authorizing the
Special Use Planned Unit Development for the Subject Property; (iii) approving the Developer's
Final Development Plan; and (iv) granting certain variations from the Deerfield Development Code
(as defined below). Copies of the authorizing Ordinance and other approval measures are attached
hereto as Exhibit C.
G. The Village has heretofore adopted the "Deerfield Development Code"
( "Development Code "). Among other things, the Development Code calls for the Village and the
Developer to enter into a "Development Agreement" relative to the development of the Subject
Property.
H. In accordance with Article III of the Development Code, this Agreement has been
reviewed by the Director of Community Development, the Village Engineer, and the Village Plan
Commission.

I. The parties now desire to enter into this Development Agreement, pursuant to the
applicable provisions of the Development Code, for the purposes set forth in the Development Code.
NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES
HERETO, as follows:
Incorporation of Recitals. The recitals set forth above are incorporated herein as if
fully set forth.
2. Identification of Development/Improvement Plan.
A. For purposes of this Agreement, the "Final Development Plan" shall consist of
the documents listed on Exhibit B hereto, which documents have been approved by the President
and Board of Trustees pursuant to the Development Code and which are hereby incorporated and
made a part of the Agreement by this reference.
B. In accordance with Section 3 -101 -B of the Development Code, the Developer
has provided the Village Engineer and the Director of Community Development with copies of its
Improvement Plan as part of its Final Development Plan. The term "Improvement Plan" when used
herein shall include only those documents and/or plans, or those specific parts of documents and/or
plans, listed in Exhibit B that depict public or private improvements as they are defined and
specifically identified hereafter. Said final engineering plans are identified as part of Exhibit B.
Developer shall grant to the Village all easements reasonably required by the Village that are related
to the Improvement Plan.
3. Site Development Schedule. In accordance with Section 3- 102- B(4)(a) of the.
Development Code, the development of the Subject Property will proceed substantially in
accordance with the schedule attached hereto as Exhibit D and made a part hereof. The parties

recognize and acknowledge that this development schedule is subject to variables relating to
weather, strikes, work stoppages, acts of God and other matters outside of the reasonable control of
the Developer, its contractors and subcontractors.
4. Development/Improvement Details. Pursuant to Section 3- 102- B(4)(b) of the
Development Code, all proposed improvements are depicted and detailed on the Improvement Plan.
5. Performance Guarantee. Except as provided in the following subparagraphs,
Developer shall submit a performance guarantee as required by Article IV of the Development Code.
A. In accordance with Article IV and Section 3- 102- B(4)(c) of the Development
Code, Developer shall provide to Village, in a form satisfactory to the Village, an irrevocable
commercial letter of credit equal to twenty percent (20 %) of the total cost estimate for all
public improvements depicted on the Improvement Plan and for the following private
improvements: utilities, drainage, parking lot, landscaping and fencing (collectively, the
"Guaranteed Improvements ").
B. In lieu of providing the letter of credit required pursuant to subparagraph 5.A
prior to the time of adoption of the Final Development Plan authorizing the Special Use
Planned Unit Development for the Subject Property as required by the Development Code,
Developer may elect to provide the Village with the unconditional commitment of a
commercial bank or financial institution authorized to do business in Illinois to provide the
required letter of credit within one (1) year from the time of adoption of the Final
Development Plan. In no event, however, shall Developer be entitled to the issuance of any
permit for work on the Subject Property, nor shall Developer commence any site
development or utility work on or adjacent to the Subject Property, until the required letter of

credit has been deposited with the Village in replacement of such alternate performance
guarantee.
C. At the time that Developer completes the Guaranteed Improvement(s) in
accordance with the Improvement Plan and makes payments for such Guaranteed
Improvement(s), and as a prerequisite to any partial reduction of the performance guarantee,
Developer shall provide Village with documentation: (i) identifying the specific Guaranteed
Improvements completed by Developer, (ii) the estimated cost for such Guaranteed
Improvements, (iii) certificates from the Inspecting Engineer (defined below) that such
Guaranteed Improvements have been fully and satisfactorily completed, (iv) all appropriate
contractor and/or subcontractor lien waivers for the work performed and materials supplied
for the specific Guaranteed Improvements, and (v) such other and further invoices, bills,
contracts or documentation as the Village shall reasonably request to evidence completion of
the Guaranteed Improvements in accordance with the Improvement Plan. Except as
expressly modified herein, all reductions and the final discharge of the letter of credit shall
be in accordance with Sections 4 -107 and 4 -109 of the Development Code.
D. Developer is a not - for - profit corporation and, based on the Village's review
and approval of the Final Improvement Plan, the schedule of development and Developer's
financing, the Village, pursuant to Sections 3- 102- B(4)(c) and Section 4 -102 of the
Development Code, has approved a reduced performance guarantee as described in
subparagraph 5.A hereof.
6. Approved Conditions, Requirements and Variations. Pursuant to Section 3 -102-
B(4)(d) of the Development Code, the public and private improvements identified on the
Improvement Plans shall conform to the Design and Improvement Standards set forth in Article V of

the Development Code, except for the following specific conditions, requirements, and variations, as
contemplated by the Final Development Plan and Improvement Plan, which are hereby approved, to
wit: NONE.
7. Permit Fees. Pursuant to Section 6 -7 of the Municipal Code of the Village of
Deerfield, no building or plumbing permit fees shall be charged for the issuance of a building permit
for construction of a private high school on the Subject Property in accordance with the Final
Development Plan authorizing such construction. Except as specifically provided herein, nothing in
this Agreement shall be construed as waiving or modifying any plan review fees, inspection fees or
other fees applicable to development of the Subject Property or to the construction of a private high
school on the Subject Property
8. Compliance with Other Rules and Regulations. Except as specifically provided
herein, the development of the Subject Property shall proceed in accordance with the ordinances
described hereinabove and with applicable provisions of the Deerfield Municipal Code.
9. Inspecting Engineer. Pursuant to Section 4 -106 of the Development Code, the
Village Engineer, or any mutually acceptable registered professional engineering firm designated by
the Village Engineer, shall be the "Inspecting Engineer" authorized to ensure that the development
complies with the approved Improvement Plan, the Village Standards and Specifications Manual and
this Agreement. To the extent that the Village Engineer designates a professional engineering firm
to serve as the Inspecting Engineer, such Inspecting Engineer shall invoice the Village for
engineering services rendered and the developer shall promptly reimburse the Village for such
engineering fees and costs.
10. Remedies. Upon breach of this Agreement, any party in a court of competent
jurisdiction may obtain all appropriate relief, including, but not limited to, specific performance,

injunction or damages. Notwithstanding the foregoing, before the failure of any party to perform its
obligation under this Agreement may be considered a breach, the party claiming such failure shall
notify, in writing, the party alleged to have failed to perform, and shall demand performance. No
breach may be found to have occurred if performance has commenced to the reasonable satisfaction
of the complaining party within thirty (30) days of receipt of such notice and if the failing party
pursues diligently the curing of such failure.
11. Estoppel Certificate. Developer, its successors or assigns may request and obtain
from the Village a letter or certificate, stating: (i) whether this Agreement and the Ordinances and
resolutions referred to herein are in full force and effect; (ii) which covenants and requirements of
this Agreement and said Ordinances have been fully performed to the best of the Village's
knowledge; (iii) that the Developer is not in default of its obligations under this Agreement and such
Ordinances, or if Developer is in default, the nature and extent of such default; and (iv) the nature
and extent of any amendment or modification to this Agreement or such Ordinances.
12. Notices. All notices, elections and other communications between the parties hereto
shall be in writing and shall be mailed by certified mail, return receipt requested, postage prepaid, or
delivered personally to the parties at the following addresses, or to such other addresses as the
parties by notice shall designate:

13. Successors and Assigns. This Agreement shall be binding upon the parties, their
respective successors and assigns.
14. Authority. The parties warrant and represent that they have the power and authority
to enter into this Agreement in the names, titles and capacities herein stated.
15.. Miscellaneous.
(a) Captions. The captions herein are inserted for the convenience of the parties
and are not to be construed as an integral part of the Agreement.
(b) Governing Law. This Agreement shall be governed by and construed in
accordance with Illinois law.
(c) Severability. If any provision, covenant, agreement or portion of this
Agreement is held invalid, such invalidity shall not affect the application or validity of such other
provisions, covenants or portions of this Agreement.
(d) Entire Agreement. ement. This Agreement supersedes any prior agreements,
negotiations and exhibits and is a full integration of the entire Agreement of the parties. The
exhibits to this Agreement are expressly incorporated herein.
(e) Counterparts and Duplicate Original. This Agreement may be executed in any
number of counterparts and duplicate originals, each of which shall be deemed an original, but all of
which shall constitute one and the same instrument.

AN ORDINANCE APPROVING A FINAL DEVELOPMENT PLAN AND
AUTHORIZING A SPECIAL USE PLANNED UNIT DEVELOPMENT
FOR THE CERCAGOLAND JEWISH HIGH SCHOOL IN THE I -1
OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT
WHEREAS, Petitioner Chicagoland Conservative Jewish High School Foundation, the
owner of certain property commonly known as 1095 Lake Cook Road and legally described on
Exhibit A attached hereto and made a part hereof (the "Subject Property"), has petitioned the Plan
Commission of the Village of Deerfield to permit the development of a private high school as a
Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and
Restricted Industrial District under and pursuant to the provisions of Article 6.01 -C, Paragraph 16,
Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended,
including variations to allow motor vehicle parking in the west, east and south perimeter setbacks of
the proposed Planned Unit Development; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June
10, 2004 to consider Petitioner's proposed Preliminary Development Plan to authorize a private high
school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District, said hearing being held pursuant to public notice and
conforming in all respects, in both manner and form, with the requirements of the statutes of the
State of Illinois and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed Preliminary Development Plan for the Subject Property. and the evidence and supporting
materials offered at said public hearing, submitted its written report to the Board of Trustees of the
Village of Deerfield recoinmending approval of the Preliminary Development Plan to allow a private
high school as a Special Use Planned Unit Development of the Subject Property in the I -1 Office,
Research and Restricted Industrial District; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield concurred in the
- — - recommendation of the Plan Commission to approv-e-t, h e Preliminary Development Plan submitted
by the Petitioners for approval of a private high school as a Special Use Planned Unit Development
of the Subject Property; and,
WHEREAS, Petitioner has now submitted a Final Development Plan to -the Plan
Conunission of the Village of Deerfield for approval of a private high school as a Special Use
Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted
Industrial District pursuant to the Zoning Ordinance of the Village of Deerfield;-and,
WHEREAS, after considering the evidence and supporting materials submitted by the
Petitioner, the Plan Commission has determined that the Final Development Plan is in substantial
conformance with the previously approved Preliminary Development Plan for the Subject Property
and should be approved as a Special Use Planned Unit Development of the Subject Property in the I-
1 Office, Research and Restricted. Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield are of the
opinion that said Final Development Plan should be. approved as a Special Use Planned Unit
Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District
authorizing and permitting the construction, development and use of the Subject Property as a private
high school in accordance with the Final Development Plan attached. hereto and made a part hereof
as Exhibit B, and with the evidence and supporting materials submitted by the Petitioner which are
incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby fund that the Final
-- - - - - -- Development Plan for the Subject Property attached hereto and made a part hereof as Exhibit B fully
complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 16, Article 12.09
and Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve the
Final Development Plan attached hereto and made a part hereof as Exhibit B as a Special Use
Planned Unit Development of the Subject Property authorizing and permitting the construction,
development and use of a private high school on the Subject Property in the I -1 Office, Research and
Restricted Industrial District, including variations to allow motor vehicle parking in the west, east
and south perimeter setbacks to the extent depicted in the Final Development Plan, and subject to the
conditions, regulations and restrictions set forth in Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of said Final Development Plan is hereby
granted subject to the following conditions, regulations and restrictions:
A. That the construction, development and use of the Subject Property shall be
in accordance with the documents, materials and exhibits comprising the
Final Development Plan for the Subject Property attached hereto and made a
part hereof as Exhibit B.
B. That authorized private high school shall include a three -story classroom
building containing 66,300 square feet with a student enrollment capacity of
200, including an unlit soccer field, unlit tennis courts, landscaping, site
lighting, signage, utility, drainage, surface parking for 175 vehicles and traffic
and pedestrian circulation improvements, all in accordance with the Final
Development Plan attached hereto as Exhibit B.
C. The addition of a future three -story classroom building and auditorium
containing 56,240 square feet with a student enrollment capacity of 200 is
authorized in concept, subject to the future submission and approval of an
amendment to the Final Development Plan in accordance with the Zoning
Ordinance of the Village of Deerfield.

E. Petitioner acknowledges that the property abutting and immediately east of
the Subject Property is zoned and used for public uses including
telecominunications antenna towers and structures, and that the future
construction of additional telecommunications antenna towers and structures
on said property is consistent with the Comprehensive Plan of the Village of
Deerfield and is likely to occur. Petitioner represented to the Plan
Commission and the President and Board of Trustees of the Village of
Deerfield that such uses are compatible with the private high school use
approved for the Subject Property by this ordinance and that the Petitioner
has knowingly and voluntarily waived any objections to any such future use
of the abutting property.
F. All representations submitted and made by the Petitioner to the Plan
Commission and to the President and Board of Trustees of the Village of
Deerfield.
G. Petitioner's initial and continued compliance with all other applicable
provisions of the Development Code and Zoning Ordinance of the Village of
Deerfield.
SECTION 4: That the corporate authorities of the Village of Deerfield do hereby approve
the Development Agreement for Chicagoland Jewish High School, a copy of which is attached
in
hereto as Exhibit C hereof, and the Village President and the Village Clerk be and they are hereby
authorized and directed to execute said Development Agreement for and on behalf of the Village of
Deerfield.
SECTION 5: That the Final Development Plan hereby approved and authorized as a Special
Use Planned Unit Development authorizing a private high school on the Subject Property shall be
binding upon and inure to the benefit of Petitioner's successors; grantees, transferees and assigns,
and any violations of the conditions hereinabove set forth by Petitioner or its successors, grantees,
transferees or assigns shall authorize the revocation of the Special Use hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to record this
- - - -Or inane in the Office of the Recorder of Deeds of Cook County, Illinois at Petitioner's expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
