AN ORDINANCE AUTHORIZING A SPECIAL USE FOR A
CIB BANK FACILITY AT 700 OSTERMAN AVENUE IN DEERFIELD SQUARE
WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing
on the application of CIB Bank and Jacobs Corporate Center, LLC (collectively, the
"Applicants ") for approval of a Class B Special Use to permit the establishment of a banking
facility at 700 Osterman Avenue in Deerfield Square, said property being legally described on
Exhibit A attached hereto (the "Subject Property") and being located in the Deerfield Square
Planned Unit Development in the C -1 Village Center District; and,
WHEREAS, said hearing was held on February 13, 2003 pursuant to public notice duly
given in the time and manner provided by law; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
testimony, documentary evidence and supporting materials offered at said public hearing, filed
its report with the President and Board of Trustees containing its written findings of fact and
recommendations that the requested Special Use be authorized pursuant to Article 5.01 -C,
Paragraph 2, Subparagraph b(2) of the Zoning Ordinance of the Village of Deerfield to allow a
banking facility to be located, established and operated on the Subject Property as a Special Use
in the Deerfield Square Planned Unit Development in the C -1 Village Center District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and granting
of said Special Use as provided herein and in accordance with the plans and supporting materials
submitted by the Applicants which are incorporated herein and made a part hereof by this
reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that
the proposed CIB Bank facility at 700 Osterman Avenue, hereby authorized as a Special Use of
the Subject Property in the Deerfield Square Planned Unit Development in the C -1 Village
Center' District, fully complies with the requirements and standards for special uses set forth in
Article 5.01 -C, Paragraph 2, Subparagraph b(2), and in Article 13.11 of the Zoning Ordinance of
the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve,
subject to certain conditions as more particularly set forth below, the establishment and operation
of a banking facility at 700 Osterman Avenue in the Deerfield Square Planned Unit Development
as a Special Use of the Subject Property in the C -1 Village Center District.
SECTION 3: That the approval and authorization of said Special Use is granted subject
to: (i) the requirement that the construction, development and use of the Subject Property for said
Special Use shall be in accordance with the plans and supporting materials attached hereto and
made a part of this ordinance as Exhibit B hereof and with all representations made and
submitted by the Applicants to the Plan Commission and the Mayor and Board of Trustees; (ii)
compliance with all documents, materials and exhibits filed in support of the application, and
with the terms of this Ordinance; (iii) relocation of one handicapped parking space from the
north side of the building to the west side of the building; (iv) compliance with the requirements
of the Appearance Review Commission; (v) continued compliance with the requirements of the
Deerfield Square Planned Unit Development, and with the requirements of Ordinance No. 0 -00-
36 and Ordinance No. 0- 98 -34, which remain in full force and effect except as specifically
amended by this Ordinance; and (vi) compliance by the Applicants with all other applicable
provisions of the Zoning Ordinance of the Village of Deerfield.
SECTION 4: That the Special Use as hereby authorized shall be binding upon and inure
to the benefit of the Applicants and Applicants' successors, grantees, transferees and assigns, and
any violation of the conditions herein set forth by the Applicants or their successors, grantees,
transferees or assigns shall authorize the revocation of the Special Use as hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds
of Lake County, Illinois at Applicants' expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

Deerfield, Illinois
This memorandum summarizes our findings regarding the parking study conducted by Kenig,
Lindgren, O'Hara, Aboona, Inc. (KLOA, Inc.) for the proposed CIB Bank to be located at
700 Osterman Avenue in Deerfield, Illinois. The bank will occupy 1,500 square feet within an
existing 6,000 square -foot center that also contains Jacob Homes which occupies 4,500 square
feet. The center has 22 parking spaces, two of which are handicapped spaces. Jacob Homes has
eight employees plus one or two customers a day resulting in utilization of a maximum ten
spaces during the peak periods.
The purpose of this study was to determine whether adequate parking supply exists at the center
to accommodate the peak parking needs of the bank.
Existing Parking Needs
As indicated earlier, the center provides a total of 22 spaces to accommodate a 6,000 square -foot
center at a ratio of one parking space per 240 square feet. Jacob Homes occupy 4,500 square feet
while the proposed bank will occupy the remaining 1,500 square feet. Based on discussions with
Jacob Homes, their peak parking demand was determined to be ten spaces as follows:
- Eight spaces for employees
Two spaces for customers
This leaves twelve spaces available for customers and employees of the proposed CIB Bank.

Future Parking Demand Q

To calculate the future parking demand at the center, the parking demand of the proposed bank
was determined. In order to determine the parking needs at the bank, parking surveys were
conducted at an existing CIB Bank located at 1220 Meadow Road in Northbrook. The surveys
were conducted every half hour on Friday, November 8, 2002 from 8:00 A.M. to 6:00 P.M. and
on Saturday, November 9, 2002 from 8:00 A.M. to 12:00 Noon. The results of the parking
surveys are shown in Table 1. As can be seen, the bank, which is open on weekdays from 8:00
A.M. to 6:00 P.M. and on Saturdays from 8:00 A.M. to 12:00 Noon, has a peak demand of seven
spaces occurring seven times on Friday and eight spaces occurring once on Saturday.
Findings and Recommendations
By combining the existing parking needs at the center and the calculated future demand by the
proposed bank, the frilly occupied center will have a peak demand of 18 spaces or four spaces
less than the supply of 22 spaces. It should be noted that based on the parking ratio approved for
the center, the 1,500 square -foot unit to be occupied by the bank will require seven spaces which
is one space less than the calculated peak demand.
Conclusion
In conclusion, based on the analyses presented, the existing parking supply of 22 spaces is
adequate to accommodate the future parking needs of the proposed 1,500 square -foot CIB Bank.
