AN ORDINANCE APPROVING CERTAIN TENANT IDENTIFICATION
DIRECTIONAL SIGNS AT THE DEERFIELD SQUARE AS AN AMENDMENT
TO THE APPROVED SIGNAGE PLAN FOR DEERFIELD SQUARE
WHEREAS, the petitioner CRM Properties Group, Ltd. is the owner of certain property
commonly known as the Deerfield Square Shopping Center legally described in Section 1 of this
Ordinance ( "Deerfield Square" or the "Subject Property ") and has petitioned the Plan
Commission of the Village of Deerfield under and pursuant to the provisions of Article 5.01 -C,2,j
and Article 13 -11 of the Zoning Ordinance of the Village of Deerfield, as amended, for approval
of an amendment to the approved Signage Plan for Deerfield Square as an amendment to the
Special Use Shopping Center/Planned Unit Development heretofore approved for the Subject
Property in the C -1 Village Center District to allow three (3) proposed tenant identification
directional signs at the Deerfield Square shopping center; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
June 13, 2002 to consider Petitioner's request for an amendment to the approved Signage Plan
for Deerfield Square to allow to allow three (3) proposed tenant identification directional signs at
the Deerfield Square shopping center to identify the tenants doing business on the west side of
Robert York Avenue, the tenants doing business in Building 9, and the tenants doing business in
Building 10, all in accordance with the following exhibits submitted by the Petitioner: (i) a
rendering of the proposed tenant identification directional signs (and alternates) by White Way
Sign Company dated 6/11/02, Sketch No. 79114, (ii) a photographic depiction of the typical light
pole where the signs are to be mounted„ and (iii) an ALTA/ACSM Land Title Survey of the
Subject Property depicting the location of the three (3) proposed tenant identification directional
(2 signs at the north east and the southeast corners of Building 5. and 1 sign at the northwest
corner of Building 3), said exhibits being attached hereto and made a part hereof as Exhibit A;
and,
WHEREAS, said hearing was held pursuant to public notice and conformed in all
respects, in both manner and form, with the requirements of the statutes of the State of Illinois
and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed amendment to the approved Signage Plan for the Deerfield Square shopping center and
the evidence and supporting materials offered at said hearing, has submitted its written report and
recommendation to the President and Board of Trustees of the Village of Deerfield that said
amendment to the approved Signage Plan should be approved as an amendment to the Special
Use Shopping Center/Planned Unit Development for Deerfield Square in the C -1 Village Center
District; and,
WHEREAS, the President and Board of Trustees find that said amendment to the
approved Signage Plan for the Subject Property should be approved as an amendment to the
Special Use Shopping Center/Planned Unit Development for Deerfield Square in the C -1 Village
Center District, authorizing and permitting three (3) tenant identification directional signs on the
Subject Property, all in accordance with the plans and exhibits presented by the Petitioner and
attached hereto as Exhibit A hereof,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees of the Village of Deerfield do
hereby find that the amendment to the approved Signage Plan for Deerfield Square fully complies
with the requirements and standards set forth in Article 5.01 -C,2xj and in Article 13.11 of the
Zoning Ordinance of the Village of Deerfield and should be authorized and approved as an
amendment to the previously approved Signage Plan for Deerfield Square, and as an amendment
to the Special Use Shopping Center/Planned Unit Development of the Subject Property legally
described as follows:
Lots 1 and 2 in the Shops at Deerfield Square, being a resubdivision
of par t of the Northeast Quarter of Section 32 and the Northwest
Quarter of Section 33, Township 43 North, Range 12 East of the
Third Principal Meridian, according to the Plat thereof recorded
August 15, 2001 as document number 4746622, Lake County,
Illinois.
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do
hereby authorize and approve the following amendment to the approved Signage Plan for
Deerfield Square legally described herein as an amendment to the Special Use Shopping
Center/Planned Unit Development of the Subject Property in the C -1 Village Center District,
subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance:
A. Three (3) non - illuminated tenant identification directional signs shall be
allowed in accordance with the following attached hereto as Exhibit A: (i) a
rendering of the proposed signs by White Way Sign Company dated
6/11/02, Sketch No. 79114, (ii) photographic depictions of the typical light
standard to which the proposed signs are to be affixed, and (iii) an
ALTA/ACSM Land Title Survey of the Subject Property depicting the
location of the proposed tenant identification directional signs.
SECTION 3: That the approval and authorization of said amendment to the approved
Signage Plan for Deerfield Square is hereby granted subject to the following conditions:
A. That all construction, maintenance and use of the tenant identification
directional signs hereby approved .shall be in accordance with the
supporting documents, materials and exhibits comprising the Signage Plan
for Deerfield Square, as amended in accordance with the documents,
materials and exhibits attached hereto and made a part hereof as Exhibit A.
B. Except as expressly provided herein, the construction, development and
use of the tenant identification directional signs hereby approved shall be in
accordance with the final development plan heretofore approved as a
Special Use Planned Unit Development of the Subject Property in the C -1
Village Center District.
SECTION 4: That the amendment to the approved Signage Plan for Deerfield Square
hereby approved and authorized as an Amended Special Use Shopping Center/Planned Unit
Development of the Subject Property in the C -1 Village Center District shall be binding upon and
inure to the benefit of Petitioner's successors, grantees, transferees and assigns, and any violation
of the conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or
assigns shall authorize revocation of the amended special use hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to record this
ordinance in the office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law
