AN ORDINANCE APPROVING AN AMENDMENT TO THE
APPROVED SIGNAGE PLAN FOR DEERFIELD SQUARE AS AN
AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT
WHEREAS, CRM Properties Group, Ltd. (the "Petitioner ") is the owner of certain
property legally described in Section 1 hereof and commonly known as the Deerfield Square
Shopping Center ( "Deerfield Square" or the "Subject Property") and has petitioned the Plan
Commission of the Village of Deerfield under and pursuant to the provisions of Article 5.01-
C,2J and Article 13 -11 of the Zoning Ordinance of the Village of Deerfield, as amended, for
approval of an amendment to the approved Signage Plan for Deerfield Square as an
amendment to the Special Use Shopping Center/Planned Unit Development heretofore
approved for the Subject Property in the C -1 Village Center District to allow development
identification signs at the Deerfield Road and Waukegan Road entrances to the Deerfield
Square shopping center; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
June 5, 2002 to consider Petitioner's request for an amendment to the approved Signage Plan
for Deerfield Square to allow two (2) development identification signs at the Deerfield Road
and Waukegan Road entrances to the Deerfield Square shopping center, parallel to said
roadways, in accordance with the following exhibits submitted by the Petitioner: (i) a
rendering by White Way Sign Company dated 3/11/02, Sketch No. 78810, (ii) photographic
depictions of the proposed signs, and (iii) an ALTA/ACSM Land Title Survey of the Subject
Property depicting the location of the proposed development identification signs, said exhibits
being attached hereto and made a part hereof as Exhibit A, said hearing being held pursuant
to public notice and conforming in all respects, in both manner and form, with the
requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of
Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed amendment to the approved Signage Plan for the Deerfield Square shopping center
and the evidence and supporting materials offered at said hearing, has submitted its written
report and recommendation to the President and Board of Trustees of the Village of Deerfield
that said amendment to the approved Signage Plan should be approved as an amendment to
the Special Use Shopping Center/Planned Unit Development for Deerfield Square in the C -1
Village Center District; and,
WHEREAS, the President and Board of Trustees find that said amendment to the
approved Signage Plan for the Subject Property should be approved as an amendment to the
Special Use Shopping Center/Planned Unit Development for Deerfield Square in the C -1
Village Center District, authorizing and permitting two (2) development identification
monument signs at the Deerfield Road and Waukegan Road entrances into Deerfield Square,
all in accordance with the plans and exhibits presented by the Petitioner and attached hereto
as Exhibit A hereof,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VELLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees of the Village of Deerfield do
hereby find that the amendment to the approved Signage Plan for Deerfield Square fully
complies with the requirements and standards set forth in Article 5.01 -C,2,j and in Article
13.11 of the Zoning Ordinance of the Village of Deerfield and should be authorized and
approved as an amendment to the previously approved Signage Plan for Deerfield Square, and
as an amendment to the Special Use Shopping Center/Planned Unit Development of the
Subject Property legally described as follows:
Lots 1 and 2 in the Shops at Deerfield Square, being a
resubdivision of par t of the Northeast Quarter of Section 32 and
the Northwest Quarter of Section 33, Township 43 North, Range
12 East of the Third Principal Meridian, according to the Plat
thereof recorded August 15, 2001 as document number 4746622,
Lake County, Illinois.
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do
hereby authorize and approve the following amendment to the approved Signage Plan for
Deerfield Square legally described herein as an amendment to the Special Use Shopping
Center/Planned Unit Development of the Subject Property in the C -1 Village Center District,
subject to the conditions, regulations and restrictions set forth in Section 3 of this
Ordinance:
A. A development identification monument sign containing the name
"Deerfield Square" consisting of reverse channel, brushed aluminum
letters 3.5 inches thick and 2.5 inches off the wall, with white neon
indirect illumination, and a logo panel in brushed aluminum with etched
graphics in black, shall be allowed at the Deerfield Road entrance to the
Shopping Center, parallel to Deerfield Road, in accordance with the
following attached hereto as Exhibit A: (i) a rendering by White Way
Sign Company dated 3/11/02, Sketch No. 78810, (ii) photographic
depictions of the proposed signs, and (iii) an ALTA/ACSM Land Title
Survey of the Subject Property depicting the location of the proposed
development identification signs.
B. A development identification monument sign containing the name
"Deerfield Square" consisting of reverse channel, brushed aluminum
letters 3.5 inches thick and 2.5 inches off the wall, with white neon

graphics in black, shall be allowed at the Waukegan Road entrance to
the Shopping Center, parallel to Waukegan Road, in accordance with
the following attached hereto as Exhibit A: (i) a rendering by White Way
Sign Company dated 3/11/02, Sketch No. 78810, (ii) photographic
depictions of the proposed signs, and (iii) an ALTA/ACSM Land Title
Survey of the Subject Property depicting the location of the proposed
development identification signs.
C. Said development identification signs shall be in lieu of all other
development identification signs that may otherwise be permitted.
SECTION 3: That the approval and authorization of said amendment to the approved
Signage Plan for Deerfield Square is hereby granted subject to the following conditions:
A. That all construction, maintenance and use of the development
identification signs hereby approved shall be in accordance with the
supporting documents, materials and exhibits comprising the
amendment to the Signage Plan for Deerfield Square attached hereto
and made a part hereof as Exhibit A.
B. Except as expressly provided herein, the construction, development and
use of Deerfield Square shall be in accordance with the final development
plan heretofore approved as a Special Use Planned Unit Development of
the Subject Property in the C -1 Village Center District.
SECTION 4: That the amendment to the approved Signage Plan for Deerfield Square
hereby approved and authorized as an Amended Special Use Shopping Center/Planned Unit
Development of the Subject Property in the C -1 Village Center District shall be binding upon
and inure to the benefit of Petitioner's successors, grantees, transferees and assigns, and any
violation of the conditions hereinabove set forth by Petitioner or its successors, grantees,
transferees or assigns shall authorize revocation of the amended special use hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to record this
ordinance in the office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's
expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective
legislative act of a home rule municipality without regard to whether such Ordinance should:
(a) contain terms contrary to the provisions of current or subsequent non - preemptive state
law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state
law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent
that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this
Ordinance shall supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
