ORDINANCE NO. 0-01-34
AN ORDINANCE AMENDING ARTICLE 9.02 -A,1 OF THE
ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, the owner of the property commonly known as the First Presbyterian
Church at 824 Waukegan Road, has petitioned for a text amendment to Article 9.02 -A, l of the
Zoning Ordinance of the Village of Deerfield to allow identification signage for a childcare facility
operated in conjunction with a place of worship; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
August 23, 2001, to consider said text amendment, said hearing being held pursuant to public
notice duly given and published as required by statute and conforming in all respects, in both
manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
evidence presented at said hearing, has made written findings of fact and recommended a text
amendment to the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the
recommendation of the Plan Commission and have determined that it is in the best interests of the
Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That Section 9.02 -A,1 of Article 9 of the Zoning Ordinance of the Village
of Deerfield, as amended, be and the same is hereby further amended to add the following as
subsection d thereof:
d. Identification Sig_nage for a Childcare Facility perated in Conjunction with a
Place of Worship.
(1) Number and Content
There shall not be more than one (1) identification sign for each zoning lot.
Such sign shall indicate only the name and/or address and logo of the
childcare facility.
(2) Tyne
Identification signs may be wall signs only.
(3) Area
No identification sign shall have more than one sign face. The gross
surface area of the sign shall not exceed eight (8) square feet.
(4) Location
Identification signs shall be located on the same zoning lot as the principal
use to which they are accessory, and shall be located on the outermost wall
of the principal building fronting a public street, public right -of -way,
easement for access, or parking area.
(5) Height
Identification signs shall have a maximum height not to exceed twelve (12)
feet above the building grade.
SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 3 : That this Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
