VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-01-2 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE FOR ZENGLER CLEANERS AT 1452 WAUKEGAN ROAD, DEERFIELD, ILLINOIS WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing on the application of the owner (the "Applicant ") of certain property legally described herein and commonly known as 1452 Waukegan Road (the "Subject Property") for an amendment to the Special Use granted by Ordinance 0 -92 -31 to permit the renovation and expansion of the existing dry cleaning establishment, with a drive - through facility on the Subject Property, located within the Village of Deerfield in the C -2 Outlying Commercial District; and, WHEREAS, said public hearing was held pursuant to public notice duly given in the time and manner provided by law; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering evidence and supporting materials offered at said hearing, made written findings of fact and recommended to the President and Board of Trustees of the Village of Deerfield that the amendment to the Special Use as proposed by the Applicant be authorized; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed plan and supporting materials submitted by the Applicant, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said amendment to the special use in accordance with the plans and supporting materials submitted by the Applicant, which are incorporated herein and made a part hereof by this reference; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the amendment to the Special Use as hereby authorized fully complies with the requirements and standards set forth in Articles 5.02 -C and 13.11 of the Zoning Ordinance of the Village of Deerfield, and that the amended Special Use is hereby authorized and approved as to the following described Subject Property only, to permit the expansion, renovation and operation of the existing dry- cleaning establishment, with drive - through facility, on the Subject Property to the extent herein authorized, to wit: Lot 1 in Sack's Subdivision, being a subdivision of part of the north half of the North East 1/4 of Section 28, Township 43 North, Range 12, East of the Third Principal Meridian, according to the plat thereof, recorded November 17, 1970 as Document 1481095, in Lake County, Illinois. SECTION 2: That the approval and authorization of said amended Special Use is hereby granted subject to: (i) the requirements that the construction, development and use of the Subject Property for said amended Special Use shall be in accordance with the site plan and elevation drawings by Lynde Anderson and Associates for A. W. Zengler Cleaners, 1452 Waukegan Road, revised 5 -8 -01, and the photometric lighting plan by Ruud Lighting, dated 8/9/01, submitted by the Application, which are attached hereto and incorporated herein by this reference, together with all documents, materials and exhibits filed in support of the application, and the terms of this Ordinance; -2- (ii) Applicant's provision of six (6) additional employee parking spaces for the exclusive use of Subject Property to be constructed and maintained on certain property lying immediately west of and abutting the Subject Property which has been leased from the Commuter Rail Division of the Regional Transportation Authority C Metra") by Applicant pursuant to a Lease Agreement dated 7/25/01; (iii) all representations submitted and made by the Application to the Plan Commission and to the President and Board of Trustees; (iv) Applicant's compliance with the recommendations of the Appearance Review Commission; (v) continued compliance with Ordinance No. 0- 92 -31, which remains in full force and effect, except as specifically amended by this Ordinance; and, (vi) compliance by the Application with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 3: That the amended Special Use, as hereby authorized, shall be binding upon and inure to the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant, or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 4: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this ordinance in the office of the Recorder of Deeds of Lake County, Illinois, at Applicant's expense. SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance -3- should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 2: That the Petitioners have proven to the satisfaction of the Board of Zoning Appeals and the Board of Trustees that strict enforcement of the requirement of Article 2.03 -D, Paragraph 3, of the Zoning Ordinance of the Village of Deerfield for a 10 -foot separation between detached accessory structures and the principal structure will pose practical difficulty or unnecessary hardship as applied to the Subject Property legally described in Section 3 hereof, unless varied as provided herein. SECTION 3: That a variation from the strict provisions of Paragraph 3 of Article 2.03 -D of the Zoning Ordinance of the Village of Deerfield, as amended, is hereby granted with respect to the Subject Property hereinafter described so as to permit the construction of a bay window addition encroaching 3 feet, 4 inches into the minimum 10 -foot separation between detached accessory structures and the principal structure on the Subject Property in accordance with and to the extent provided by the Site Plan, First Floor Plan and Elevations dated May 9, 2001, by JMH Architects, Inc., which plans are incorporated and made a part of this Ordinance by this reference, to wit: Lots 17 and 18 and the south half of Lot 19 in Block 25 in H.M. SECTION 2: That the President and Board of Trustees do hereby authorize and approve the Final Development Plan attached hereto and made a part hereof as Exhibit B as a Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research, Restricted 4847046 o A,l Industrial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said Final Development Plan is hereby granted subject to the following conditions: A. That the construction, development and use of the Subject Property shall be in accordance with the documents, materials and exhibits comprising the Final Development Plan for the Subject Property attached hereto and made a part hereof as Exhibit B. B. That the construction, development and use of the Subject Property shall be in accordance with the terms and conditions of the Parkway North Annexation Agreement. C. The gross leaseable area of the proposed office building shall not exceed 240,739 square feet. D. The height of the proposed building shall not exceed 66 feet, 3 inches at the top of parapet wall, 75 feet at the top of the metal screen wall and 77 feet to the top of the elevator penthouse, and the architectural spire on the west side of the building- shall not exceed the height of 97 feet, zero inches, all in accordance with the Seven Parkway North West Elevation Plan by Wright Architects, revised September 4, 2001. E. Except as expressly provided in this Ordinance or in the Final Development Plan, the construction, development and use of the Subject Property shall be in accordance with the Parkway North Annexation Agreement. F. All representations submitted and made by the Petitioner to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. G. Petitioner's initial and continued compliance with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the Final Development Plan hereby approved and authorized as a Special Use Planned Unit Development of the Subject Property shall be binding upon and inure to the benefit of Petitioner's successors, grantees, transferees and assigns, and any violations of the � — F 7 M conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the special use hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the Office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
