O-01-24VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-01-24 AN ORDINANCE AUTHORIZING A PLAT OF VACATION OF EASEMENTS, INCLUDING THE VACATION OF PART OF ROBERT YORK ROAD PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, this 18th day of June , 2001. Published in pamphlet form by authority of the President and Board of Trustees of the Village of Deerfield, Lake and Cook Counties, Illinois, this 19th day of June , 2001. WHEREAS, the President and Board of Trustees of the Village of Deerfield have approved the final Plat of Subdivision of the Shops at Deerfield Square, as a resubdivision of certain property in part of the northeast quarter of Section 32 and the northwest quarter of Section 33, Township 43 North, Range 12 East, in the Village of Deerfield, Lake County, Illinois; and, WHEREAS, said final Plat of Subdivision of the Shops at Deerfield Square includes a dedication of new right -of -way for relocated Robert York Avenue, and includes the grant of new public utility, drainage and other easements as described therein; and, WHEREAS, certain property previously dedicated as right -of -way for Robert York Road, and certain easements previously granted for public utility, drainage and other purposes, as described in the Plat of Vacation of Easements attached hereto and incorporated herein by this reference, will be replaced by the new right -of -way and easements granted by said Plat of Subdivision and are no. longer necessary for public use; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the public interest would be subserved by vacating the former right -of -way for Robert York Road and said public utility, drainage and other easements as described in the Plat of Vacation of Easements attached hereto and incorporated herein by this reference; and WHEREAS, the vacation of a public street requires the affirmative vote of three quarters of the Village Trustees holding office pursuant to Section 11 -91 -1 of the Illinois Municipal Code; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the Plat of Vacation of Easements attached hereto and made a part hereof as Exhibit A be and the same is hereby approved. SECTION 2: That the portion of Robert York Road, as described and depicted on said Plat of Vacation of Easements attached hereto and made a part hereof, be and the same is hereby vacated. SECTION 3: That the Village Clerk of the Village of Deerfield be and he is hereby authorized and directed to file certified copies of this Ordinance and said Plat of Vacation of Easements with the Recorder of Deeds of Lake County, Illinois. SECTION 4: This Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
