VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-01-23 AN ORDINANCE AMENDING PORTIONS OF ARTICLE 13 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR POSTING NOTICE OF PUBLIC HEARINGS WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing on the application of the corporate authorities of the Village. of Deerfield (the "Applicant ") to consider a certain text amendment to the Zoning Ordinance of the Village of Deerfield to require that additional notice of public hearings be given by the posting of signage on the property which is the subject of a public hearing under the provisions of the Zoning Ordinance; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing pursuant to public notice to consider the proposed amendments, said hearing and notice conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the provisions of the Deerfield Zoning Ordinance, as amended; and, WHEREAS, the Plan Commission, after considering the evidence adduced at said hearing, submitted their written findings of fact and report to the Board of Trustees of the Village of Deerfield recommending a text amendment to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 13.07 -D (Public Hearing) of Article 13 of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended by adding the following as Section 13.07 -D,3 thereof: Posting of Sign Notice. (a) Display of Sign Notice by Applicant. The applicant shall post and display a sign notice supplied by the Village continuously for a period not more than thirty (30) nor less than fifteen (15) days before the public hearing. The sign shall be two -sided with a minimum sign face of fourteen (14) inches by twenty -two (22) inches. After the public hearing has been concluded, the applicant shall promptly remove the sign and return it to the Village. (b) Location of Sign Notice. A sign notice shall be displayed on the street frontage of the property that is the subject of the public hearing. Unless otherwise directed by the Director of Building and Zoning, the sign shall be placed not closer than twelve inches (12 "), nor further than ten feet (10') from the right -of -way line of the fronting street, at a location easily visible to the public. Properties having more than one street frontage shall display one sign on each frontage. Properties having three hundred fifty feet (350') or more of frontage on one street shall display two (2) signs, and one additional sign for each additional two hundred feet (200') of street frontage thereafter. Where the Director of Building and Zoning determines that a ground sign is not feasible, or will be less effective than a wall sign in providing notice to the public, the sign notice provided herein can be placed in a window facing the street frontage of the subject property. (c) Content of Sign Notice. The sign notice provided by the Village and displayed by the Applicant shall indicate that a public hearing is to be held concerning the property on which the sign is located. Said sign shall note the date of the public hearing which is to be held at the Village Hall and a phone number to call for additional information. SECTION 2: That Section 13.08 -C (Public Hearing) of Article 13 of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended by adding the following as Section 13.08 -C,3 thereof: 3. Posting of Sign Notice. The Applicant shall post and display a sign notice in accordance with the provisions of Section 13.07 -D,3. SECTION 3: That Section 13.09 -E (Public Hearing) of Article 13 of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended by adding the following as Section 13.09 -E,3 thereof: 3. Posting of Sign Notice. The Applicant shall post and display a sign notice in accordance with the provisions of Section 13.07 -D,3. SECTION 4: That Section 13.10 -C (Public Hearing) of Article 13 of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended by adding the following as Section 13.10 -C,3 thereof: 3. Posting of Sign Notice. The Applicant shall post and display a sign notice in accordance with the provisions of Section 13.07 -D,3. SECTION 5: That Section 13.11 -C (Public Hearing) of Article 13 of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same is hereby further amended by adding the following as Section 13.11 -C,3 thereof: 3. Posting of Sign Notice. The Applicant shall post and display a sign notice in accordance with the provisions of Section 13.07 -D,3. SECTION 6: This Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 18th day of June 2001.
