AN ORDINANCE VACATING PORTIONS OF CERTAIN
-STREETS, ALLEY AND EASEMENTS IN THE VILLAGE OF DEERFIELD
WHEREAS, in the past, the Village of Deerfield had accepted dedication of rights -
of -way for Railway Avenue (now known as Waverly Court), a portion of Central Avenue
located west of the proposed Robert York Avenue; and a certain public alley as shown in
Hall and Osterman's addition to the town of Deerfield; and
WHEREAS, the Village of Deerfield had owned and maintained these rights -of -way
for public use; and
WHEREAS, under the current project known as the South Commons Project, there
is no longer a need for such rights -of -way; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield, after
due investigation and consideration, have determined that the nature and extent of the
public use and public interest will be subserved by vacating Railway Avenue (Waverly
Court; that portion of Central Avenue located west of the proposed Robert York Avenue;
and the public alley as shown in Hall and Osterman's addition to the town of Deerfield,
said street, portion of street, and alley as hereinafter legally described; and
WHEREAS, said street, portion of street, and alley are located within the Village of
Deerfield; and
WHEREAS, the Village of Deerfield has agreed with the South Commons Venture
and various utilities to vacate certain easements as shown and legally described on the
"Plat of Vacation."
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION Those portions of public streets and alley in the Village of
QNE: Deerfield having heretofore been dedicated for public use,
which portion of said streets and alley are legally described on
Exhibit A attached hereto and made a part hereof, as shown
and designated by the words "hereby vacated" on the plat
hereto attached; which plat for greater certainty is hereby
made a part of this Ordinance, be and the same is hereby
vacated and closed, inasmuch as the same is no longer
required for public use and the public interests to be
subserved is such as to warrant the vacation of these streets
and alley.
SECTION The Village of Deerfield hereby approves the release of
TWO: easements as legally described and shown on the "Plat of
Vacation.°
SECTION That upon passes and approval of this ordinance, the Village
THREE: Clerk shall file for record with the office of the Recorder of
Deeds of Lake County, Illinois, a certified copy of this
Ordinance, together with the plat hereto attached.
SECTION This Ordinance shall be in full force and effect from and after
FOUR: its passage, approval and publication, as provided by law.
