AN ORDINANCE AMENDING A
SPECIAL USE IN C -1 VILLAGE CENTER DISTRICT
WHEREAS, Kirby Limited Partnership, an Illinois limited partnership, CRM Properties
Group Ltd. and Deerfield Square Limited Partnership (collectively the "Applicant ") has filed an
application to authorize the development of the properties legally described in Exhibit A (the
"Subject Property "), attached hereto and made a part hereof, for an Amendment to Special Use -
Planned Development as a shopping center for consideration by the Plan Commission of the Village
of Deerfield; and
WHEREAS, by virtue of Ordinance No. 0 -98 -34 adopted by the Corporate Authorities of
the Village of Deerfield conceptual approval was granted as to Building 1 (the Subject Property
herein) and thereafter final approval was given for said Building by virtue of Ordinance 0- 99 -51;
and
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public
meeting on the application of the Applicant to authorize the development and use of the Subject
Property for an Amendment to Special Use - Planned Development to include and permit changes to
the previously approved Final Development Plan for Building 1, including a Special Use approval
of a Stoney River Legendary Steak House Restaurant, in accordance with Articles 5.01 -C,2; 5.01 -
C,2J; 5.10- C,2,a,3; and 13.11 of the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield considered and reviewed the
evidence adduced, including Elevations and Plans for Building 1 prepared by Ortega & Associates
dated December 16, 1999 and a Landscape Plan prepared by Douglas Hills Associates dated January
24, 2000 each attached hereto and made a part hereof as Exhibit B; and
WHEREAS, and thereafter, the Plan Commission made written findings of fact and
recommended that said Amended Special Use of said real estate for a restaurant as depicted in the
revised Final Development Plan for Building 1 all as identified above, be granted, subject to certain
conditions and restrictions hereinafter set forth; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined
that the best interests of the Village will be served by the authorization and granting of that portion
of said Amendment to Special Use consisting of amendments to the previously approved Final
Development Plan for Building 1, including approval of the restaurant, in accordance with the plans
and exhibits presented by Applicant and included in Exhibit B attached hereto and made a part
hereof.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS
AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby affirmatively find that the
ONE: Amendment to Special Use consisting of amendments to the previously
approved Final Development Plan for Building 1, including approval of the
restaurant described herein, as depicted on Exhibit B, as hereby authorized, fully complies with the
requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance,
and the Amendment to Special Use of the Subject Property, be and the same is hereby authorized
and approved. The foregoing authorization and approval is subject to' the following conditions:
(A) That all use, construction and development shall be in accordance with all
elements of Exhibit B as more particularly described above, attached hereto and made a part
hereof, all other documentary and exhibit filings made pursuant to Planned Unit
Development procedures as set forth in Article 12.09 of the Village Zoning Ordinance, the
terms of this Ordinance, and all representations by the Applicant to the Plan Commission and
President and Board of Trustees.
(B) . That except to the extent specifically modified hereby, the provisions of
Ordinance No. 0 -98 -34 and 0 -99 -51 shall remain in full force and effect as they pertain to
the Subject Property.
SECTION That any violation of any of the conditions hereinabove set forth shall

SECTION That the Village Clerk is hereby directed to publish this Ordinance in
