AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 959 APPLETREE LANE, DEERFIELD, ILLINOIS
WHEREAS, Mr. and Mrs. John Sanner have petitioned for a variation from the strict
provisions of Article 4.03 -F,3,b of the Zoning Ordinance of the Village of Deerfield, passed April
17, 1978, as amended, as applied to the property legally described below which would permit an
encroachment of three feet onto the required 8 foot sideyard to accommodate the construction of an
addition to the existing structure; and
WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on
said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield;
and
WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees
its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS
AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning Board of
ONE: Appeals are concurred in and adopted as the findings of fact of the President
and Board of Trustees.
SECTION That the Board of Trustees finds that there are practical difficulties and
TWO: particular hardships in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners'
property, which is legally described below and made a part hereof.
LOT 15 IN WEST DEERFIELD MANOR, BEING A SUBDIVISION OF THE
EAST HALF OF THE SOUTH WEST QUARTER OF THE SOUTH WEST
QUARTER OF SECTION 29, TOWNSHIP 43 NORTH, RANGE 12, EAST OF
THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF,
RECORDED JUNE 20, 1927 AS DOCUMENT 300856 IN BOOK "R" OF PLATS,
PAGE 69 IN LAKE COUNTY, ILLINOIS.

with respect to the property hereinabove described, is hereby granted so as
to permit an encroachment of three feet onto the required 8 foot sideyard to accommodate the
construction of an addition to the existing structure, with the stipulation that elevation of the ridge
line of the new structure not exceed the elevation of the ridge line of the existing structure by more
than one foot.
SECTION That the variation hereby granted is subject to compliance by the Petitioners
FOUR: with all other applicable provisions of the Zoning Ordinance and with all
other applicable ordinances of the Village of Deerfield.
SECTION That this Ordinance shall be in full force and effect from and after its passage,
FIVE: approval and publication as provided by law.
