AN ORDINANCE AMENDING THE ZONING MAP AND
APPROVING SPECIAL USES IN C -1 VILLAGE CENTER DISTRICT
WHEREAS, the properties legally described in Exhibits A, B and C attached hereto and
made a part hereof are presently classified. in the P -1 Public Lands District, the R -4 Single and
Two - Family Residential District and the I -2A Village Center Limited Industrial District,
respectively, and in addition to the property legally described in Exhibit D attached hereto which
is presently classified in the C -1 Village Center District comprise the "Subject Property "; and
WHEREAS, Kirby Limited Partnership, an Illinois limited partnership, and the Village of
Deerfield (collectively, the "Applicant ") have filed an application seeking the reclassification of
the properties legally described in Exhibits A, B and C to the C -I Village Center District and to
authorize the development of the Subject Property for a Special Use Planned Development as a
shopping center for consideration by the Plan Commission of the Village of Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a
public hearing on the application of the Applicant for the classification of the properties legally
described in Exhibits A, B and C in the C -1 Village Center District, and to authorize the
development and use of the Subject Property for a Special Use Planned Development to include
and permit the construction of a shopping center as more particularly described below, in
accordance with Articles 5.01 -C,2 and 5.01 -C,2xj of the Zoning Ordinance of the Village of
Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice thereof and was in
all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield considered and reviewed
the evidence adduced, including those exhibits listed on and attached hereto and made a part
hereof as Exhibit E, and thereafter, the Plan Commission made written findings of fact and
recommended that said Special Use of said real estate for a shopping center, including
approximately 197,000 square feet of retail space, approximately 58,000 square feet of office
space, one freestanding restaurant, a freestanding banking facility with drive -thru facility,
including ATM's, a car wash, a freestanding drive -thru pharmacy, a grocery store and other uses,
be granted, subject to certain conditions and restrictions hereinafter set forth; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the classification of the
properties legally described in Exhibits A, B and C in the C -1 Village Center District as
recommended by the Plan Commission; and

APPROVING SPECIAL USES IN C -I VILLAGE CENTER DISTRICT
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and granting
of that portion of said Special Use designated as Buildings 4, 5 and 6 on Exhibit E and by
granting conceptual approval for those buildings designated as Buildings 1, 2, 3, 7, 8, 9 and 10
on Exhibit E, in accordance with the plans and exhibits presented by Applicant and included in
Exhibit E attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS AS FOLLOWS:
SECTION That the Zoning Map of the Village of Deerfield included and made a part
ONE: of the Village Zoning Ordinance passed April 17, 1978, as amended, is
hereby further amended by zoning and classifying the properties legally
described in Exhibits A, B and C to the C -1 Village Center District.
SECTION That the President and Board of Trustees do hereby affirmatively find that
TWO: the Special Uses designated as Buildings 4, 5 and 6 on Exhibit E, as
hereby authorized, fully comply with the requirements and standards set
forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the
Subject Property, as and for an office /retail building, a grocery store, a pharmacy with a drive -
thru facility and a car wash, as specifically proposed, be and the same is hereby authorized and
approved. The foregoing authorization and approval and the conceptual approval of the
buildings designated as Buildings 1, 2, 3, 7, 8, 9 and 10 are subject to the following conditions:
(A) That all use, construction and development shall be in accordance with
Exhibit E prepared by Otis Associates, Inc. and dated July 31, 1998, attached hereto and
made a part hereof, consisting of 21 sheets, including the Final Development Plan, Final
Landscape Plan, Landscape Details, Site Lighting Plan, Elevations and Floor Plans for
Buildings 4, 5 and 6 and Elevations for Buildings 1, 2, 3, 7, 8, 9 and 10, all other
documentary and exhibit filings made pursuant to Planned Unit Development Procedures
as set forth in Article 12.09 of the Village Zoning Ordinance, the terms of this Ordinance,
and all representations by the Applicant to the Plan Commission and President and Board
of Trustees.
(B) That all signage and fencing described on Exhibit E shall remain subject to
the review and approval of the Appearance Commission.

AN ORDINANCE AMENDING THE ZONING MAP AND
APPROVING SPECIAL USES IN C -1 VILLAGE CENTER DISTRICT
(C) That prior to the approval of a Final Development Plan for Buildings 1, 2,
3, 7, 8, 9 and 10 as proposed, Applicant shall present the Final Development Plan at a
public meeting before the Plan Commission, and thereafter, the Corporate Authorities for
a review of the proposed buildings to determine compliance with all aspects of the
Preliminary Development Plan hereby approved conceptually. The Corporate Authorities
may impose such additional restrictions as they deem appropriate at that time.
(D) That all vacations, dedications and resubdivisions as may be required to
permit the reestablishment of Robert York Avenue and the consolidation of the individual
parcels within the proposed development will be accomplished by the cooperation of the
Applicant and the Village of Deerfield.
(E) Village and Applicant enter into a Development Agreement in accordance
with the provisions of the Village of Deerfield Development Code adopted as Ordinance
93 -52.
SECTION That in connection with the approval of the above - described Special Use
THREE: the Applicant is granted the following modifications of the regulations
contained in the C -1 Village Center District pursuant to the provisions of
Article 12.01 -B,1 of the Village Zoning Ordinance.
(A) The height of the roof deck on Building 4 shall not exceed 53 feet in
height and the architectural elements which function as parapet walls and screening for
the mechanical and elevator equipment shall not exceed 71 feet in height;
(B) (i) A fifteen percent (15 %) reduction from the total floor area
computations used in conjunction with the determination of the amount of required
parking for each building; and
(ii) Deduction of thirty -seven (37) parking spaces to accommodate
expanded landscaped and pedestrian areas;
(C) Reduction in size of all parking stalls located within the development and
the underground parking facility to 18 feet in length;
(D) Reduction in number of required stacking spaces per lane from six to five
for the drive -thru bank;

(E) Reduction in amount of required parking reflecting varying peak hour
demands for varied uses;
(F) Reduction of required 25 foot building setback along southern boundary to
permit portions of Buildings 9 and 10 to be located within the required setback; and
(G) Parking lot perimeter screening allowed to permit landscaping of areas as
proposed.
SECTION That any violation of any of the conditions hereinabove set forth,
FOUR: specifically including, but not limited to, execution of the Development
Agreement set forth in Section 2(D) above, shall authorize the revocation
of the Special Use hereby authorized.
SECTION That the Village Clerk is hereby directed to publish this Ordinance in
FIVE: pamphlet form and see to its recordation in the office of the Recorder of
Deeds of Lake County, Illinois at Applicant's expense.
SECTION That this Ordinance shall be in full force and effect from and after its
