ORDINANCE NO. 2024- 0-24-34
AN ORDINANCE AMENDING SECTIONS 9.02-B AND 9.02-F OF "THE
DEERFIELD ZONING ORDINANCE 1978," AS AMENDED,
REGARDING SIDEWALK SIGNS
WHEREAS, the Village of Deerfield is a home rule municipal corporation in
accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970;
and
WHEREAS, the Village has the authority to adopt ordinances and to promulgate
rules and regulations that pertain to its government and affairs; and
WHEREAS, Section 9.02-B of the "The Deerfield Zoning Ordinance 1978," as
amended ("Zoning Ordinance', sets forth regulations that govern the posting and
maintenance of signs in the Village commercial zoning districts ("Commercial District
Sign Regulations'); and
WHEREAS, Section 9.02-F of the Zoning Ordinance sets forth regulations that
govern the posting and maintenance of signs in the Village Public Lands districts ("Public
Lands District Sign Regulations'); and
WHEREAS, the Village desires to amend the Commercial District Sign Regulations
and Public Lands District Sign Regulations to more efficiently regulate the use of sidewalk
signage on public sidewalks and sidewalks on private property ("Proposed Amendments');
and
WHEREAS, a public hearing by the Plan Commission to consider the Proposed
Amendments to the Zoning Ordinance was duly advertised on September 19, 2024, in the
Deerfield Review, and was held on October 10, 2024; and
WHEREAS, on October 10, 2024, the Plan Commission approved findings of fact in
support of the Proposed Amendments, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance, and voted to recommend approval of the Proposed Amendments by
the Village Board; and
WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the President and Board of Trustees have determined that it will serve
and be in the best interests of the Village to adopt the Proposed Amendment of the Zoning
Ordinance pursuant to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:

SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENT TO SECTION 9.02-B OF THE ZONING
ORDINANCE. Section 9.02-B titled "Commercial Districts," of Article 9, titled "Signs," of
the Zoning Ordinance is hereby amended and shall read as follows:
"9.02-B Commercial Districts
In all Commercial Districts, only the following signs are permitted and then
only if accessory and incidental to a permitted or Special Use in such districts:
16. Sidewalk Signs
a. Definition.
For purposes of this Section 9.02-B, the term "Sidewalk Sign"
means a self -supported sign designed to be moved easily and
npt-Wrmanently attached to a building. structure or the
ground, including. but not limited to, signs that have A- or T-
frames, and sandwich board signs.
b. Number.
J1 No more than one Sidewalk Sign may be placed b.�
a business on a�public or private sidewalk, or other
right-of-way adjacent to the property used by that
business.
L2 In addition to the sign that is allowed pursuant to
Section 16.b.1 above, a business that either has a
drive-thru or is a car wash with a drive -aisle may
have no more than one Sidewalk Sign located
along the drive-thru or car wash drive -aisle.
J3 Only businesses located on the ground floor of a
building may display a Sidewalk Sign.

!LU All Sidewalk Signs must be located in front of and
within l64eet of the entrance of the business that
is hosting the Sidewalk Sign, except for Sidewalk
Signs that are located in or along a drive-thru or a
car wash drive-aisl .
U2 Sidewalk Signs, if placed on a sidewalk, must be
placed in a location that leaves at least a 36-inch
pedestrian pathway that is unobstructed, unless
the Villa e_ Manager requires a wider
unobstructed pathway.
"3 No Sidewalk Sign may be installed in a manner
that obstructs or encroaches into a parking space
¢Any Sidewalk Sign installed along a drive-thru or
car wash drive aisle must be installed in a location
that does not obstruct sight lines or obstruct traffic
circulation.
f. Materials.
U Sidewalk Signs must be self-supporting and of
sufficient weight so that the signs will safely
remain stationary when displayed: provided that
sidewalk signs cannot be weighted down with
weighted bases, weights, sandbags, or other
similar items.
t2 Sidewalk Sign frames must be constructed out of
wood or metal only.
g. Prohibited Sidewalk Signs.
Sidewalk Signs that contain letter boards, flashing or moving
right lights. or movement of any kind are prohibited.
h. Hours of Display.
Sidewalk signs may be dis la ed only during- the hours in
which the business is open to the public, and in no event
between the hours of 9:00 p.m. and 8:00 a.m."
SECTION THREE: AMENDMENT TO SECTION 9.02-F OF THE ZONING
ORDINANCE. Section 9.02-F titled "Public Lands District," of Article 9, titled "Signs," of
the Zoning Ordinance is hereby amended and shall read as follows:
"9.02-F Public Lands District

The unique nature of the Public Lands District is reflected in the types of uses
allowed in the District, location of such properties in the midst of the
residential, commercial and industrial district and the need for the provision
of public facilities. Because of this uniqueness, signage in the Public Lands
District should be appropriate for the area in which the property is located,
should be sensitive to the neighboring land uses, and should serve the public
properly. Any signage accessory to a use in the Public Lands District should be
restricted to that which is necessary to serve the public, taking into
consideration the area and land uses most impacted by the signage. Therefore,
signs will be permitted and then only if accessory and incidental to a Special
Use allowed in the district. Such signage may consist of, but is not limited to,
the types of signs listed below if a public need for such signage is determined
by the Board of Trustees, except for Sidewalk Signs (as defined below)
and temporary signs, which do not require Board of Trustees
approval.
4. Sidewalk Sims

SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to publish
this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.

SECTION FIVE: EFFECTIVE DATE. This Ordinance will take full force and effect
on March 1, 2025, following its passage and approval in the manner provided by law.
