O-24-32VILLAGE OF DEERFIELD ORDINANCE NO. 2024- 0-24-32 AN ORDINANCE AMENDING SECTION 9.02-F OF "THE DEERFIELD ZONING ORDINANCE 1978," AS AMENDED, REGARDING DIGITAL MONUMENT SIGNS WHEREAS, the Village of Deerfield is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Section 9.02-F of the "The Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordinance'), sets forth regulations that govern the posting and maintenance of signs in the Village Public Lands District ("Public Lands District Sign Regulations'); and WHEREAS, the Village desires to amend the Public Lands District Sign Regulations to regulate the erection of digital monument signs in the Public Lands District ("Proposed Amendment'); and WHEREAS, a public hearing by the Plan Commission to consider the Proposed Amendments to the Zoning Ordinance was duly advertised on September 19, 2024, in the Deerfield Review, and was held on October 10, 2024; and WHEREAS, on October 10, 2024, the Plan Commission approved findings of fact in support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Amendment by the Village Board; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the President and Board of Trustees have determined that it will serve and be in the best interests of the Village to adopt the Proposed Amendment of the Zoning Ordinance pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO SECTION 9.02-F OF THE ZONING ORDINANCE. Section 9.02-F titled "Public Lands District," of Article 9, titled "Signs," of the Zoning Ordinance is hereby amended and shall read as follows: 4895-7514-7757, v. 3 "9.02-F Public Lands District The unique nature of the Public Lands District is reflected in the types of uses allowed in the District, location of such properties in the midst of the residential, commercial and industrial district and the need for the provision of public facilities. Because of this uniqueness, signage in the Public Lands District should be appropriate for the area in which the property is located, should be sensitive to the neighboring land uses, and should serve the public properly. Any signage accessory to a use in the Public Lands District should be restricted to that which is necessary to serve the public, taking into consideration the area and land uses most impacted by the signage. Therefore, signs will be permitted and then only if accessory and incidental to a Special Use allowed in the district. Such signage may consist of, but is not limited to, the types of signs listed below if a public need for such signage is determined by the Board of Trustees. 5. Digital Monument Signs for a Public High School. A digital monument sign may only be erected in the Public Lands District on property used for a public high school only. subject to the following: a. The display on a digital monument sign must remain static for at least 10 seconds before the display changes, and may not scroll, flash, shimmer, change colors so as to distract drivers. b. Sound. The digital monument sign must not emit sound. C. Area. No digital monument sign may exceed 44 square feet. d-. Height. No digital monument sign may exceed _nine feet in height. including support elements. e. Brightness. The maximum permitted brightness of a digital monument sign is 7,000 nits during the day and 1,500 nits at night. The brightness of a digital monument sign must automatically reduce as the amount of natural light decreases with nightfall. 2 4895-7514-7757, v. 3 f. Hours of Disnla The display of digital monument signs is restricted to the hours between 6:00 a.m. and 8:00 p.m.. Sunday through Tuesday and 6:00 a.m. and 9:30 n.m.. Wednesday through Saturday. Location. A digital monument sign must be located no less than 100 feet from any residentially zoned property. A digital monument sign must be located directly adjacent to a state route highway owned and o erated by the Illinois Department of Transnortation. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
