AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE IN THE C -2 OUTLYING COMMERCIAL DISTRICT
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a
public hearing on the application of First Bank and Trust Company of Illinois as Trustee under
Trust No. 10 -2090 and Heritage - Deerfield, L.L.C., an Illinois limited liability company
(hereinafter collectively referred to as `.`Applicant "), to authorize the development and use of
certain real estate described on Exhibit A hereto (the "Subject Property ") as a Special Use for a
one -story office building, under and pursuant to the provisions of Articles 5.02 -F,I,a and 13.11
of the Zoning Ordinance of the Village of Deerfield, as amended, as hereinafter more particularly
described on the Subject Property; and
WHEREAS, pursuant to Ordinance No. 83 -47, the Subject Property was included as part
of a Special Use granted to the property immediately to the north, although no use was identified
for the Subject Property at that time; and
WHEREAS, said hearing was held pursuant to duly published notice thereof and was in
all respects held according to law; and
WHEREAS, following consideration of the recommendations of the Plan Commission
and the Preliminary Development Plan by the President and Board of Trustees, the President and
Board of Trustees have considered and reviewed the Revised Final Development Plan, consisting
of the Site Plan and Elevations dated March 10, 1997 and March 4, 1997, respectively, by
Warren Johnson Architects, Inc., and the Landscaping Plan dated March 4, 1997 prepared by
Daniel Weinbach & Partners, Ltd. (collectively, the "Final Development Plan"); and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and granting
of said Amended Special Use and certain specific variations, subject to certain conditions and in
accordance with the Final Development Plan for the Subject Property marked Exhibit B and
attached hereto and made a part hereof.
. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby affirmatively find that
ONE: the Amendment to Special Use as hereby authorized, fully complies with
the requirements and standards set forth in Articles 5.01 -F,1,a and 13.11 of
the Zoning Ordinance, and the Amended Special use of the Real Estate, as and for purposes of a
one -story office building as set forth on Exhibit B subject to certain conditions and the granting

of certain variations as more particularly set forth on Exhibit B and the same is hereby authorized
and approved.
SECTION That the approval and authorization of said Amended Special Use hereby
TWO: granted is subject to the following conditions:
1. That the following permitted uses in the C -2 Outlying Commercial District be
classified as Special Uses for the purpose of the Subject Property:
Bakeries, excluding bagel shop not to exceed 2,400 sq. ft. in area
Delicatessens
Department Stores
Food Stores, Grocery Stores, and Supermarkets
Garden Supply Stores, including lawn mower sales and repair
Meat and Fish Stores, retail sales only
Package Liquor Store
Pet Shops
Phonograph Record, Tape and Sheet Music Stores
On- Premises Dry Cleaning and Laundry Establishment (pick -up and drop -off only
facilities would continue to be Permitted Uses)
Food Catering Establishments
Recreational and Social Facilities;
2. That all lighting, with the exception of security lighting, shall be placed on a timer
and automatically turned off at the close of business hours or 11:00 p.m.,
whichever is earlier; and
3. That all use, construction and development shall be in accordance with the
submitted Final Development Plan, a copy of which is included and made a part
hereof, all other documentary and exhibit filings made pursuant to the Village
Zoning Ordinance, the terms of this Ordinance, the terms of a Development
Agreement between the Applicant and the Village, and all representations by the
Applicant to the Plan Commission and President and Board of Trustees.
SECTION That the President and Board of Trustees do hereby grant and authorize the

The requirement of a minimum gross area of two (2) acres is waived and the
development of the 1.28 acres included in the Subject Property is permitted in
accordance with and as depicted on the Final Development Plan marked and
attached as Exhibit B.
SECTION That the Amended Special Use hereby authorized shall be binding upon
FOUR: and inure to the benefit of Applicant's successors, grantees, transferees
and assigns and any violation of the conditions hereinabove set forth by
the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of
the Amended Special Use hereby authorized.
SECTION That the Village Clerk is hereby directed to publish this Ordinance in
FIVE: pamphlet form and to record said Ordinance and that portion of Exhibit B
known as the "Final Site Plan" in the office of the Recorder of Deeds of
Lake County, Illinois at Applicant's expense.
SECTION That this Ordinance shall be in full force and effect from and after its

WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a
