AN ORDINANCE AUTHORIZING A
SPECIAL USE - C -2 OUTLYING COMMERCIAL DISTRICT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of TERRI
EVERWINE and GABRIEL VITI (collectively, the "Applicant "), to
authorize the development and use of certain real estate
described on Exhibit A hereto for a Special Use as a pet grooming
facility under and pursuant to the provisions of Articles 5.02 -C,
2,g and 13.11 of the Zoning Ordinance of the Village of
Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, following consideration of the recommendations of
the Plan Commission by the President and Board of Trustees, the
President and Board of Trustees have considered and reviewed the
proposed Special Use as a pet grooming facility as submitted by
Applicant; and
WHEREAS, the President and Board of Trustees of the Village
of Deerfield have determined that the best interests of the
Village will be served by the authorization and granting of said
Special Use in accordance with all the testimony and evidence
presented by the Applicant for the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find the Special Use, as hereby
authorized, fully complies with the requirements
and standards set forth in Articles 5.02 -C,2,g and 13.11 of the
Village Zoning Ordinance and the'Special Use of the Subject
Property, as a pet grooming facility, be and the same is, hereby
authorized and approved subject to the conditions hereinafter set
forth.
SECTION That the approval and authorization of said
TWO: Special Use of the Subject Property as and for the
use as more specifically described above
and as hereby granted is.subject to the condition that (i) said
Special Use conform to all other applicable codes, ordinances and

regulations of the Village of Deerfield; (ii) the Applicant
provide one (1) parking space for each 200 square feet of the
premises plus one (1) space for each employee of the Applicant;
(iii) an appropriately sized dumpster be provided; (iv) overnight
boarding of pets is prohibited; and (v) a decorative fence of not
less than four (4) feet in height shall be provided around the
dog run.
SECTION That any violation.of any of the conditions
THREE: hereinabove set forth by the Applicant or its
successors, grantees, transferees or assigns shall
authorize the revocation of the Special Use hereby authorized.
SECTION That the Village Clerk is hereby directed to
FOUR: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
,FIVE: effect from and after its passage, approval and
publication, as provided by law.

"Overall Parcel"
That part of the NE 1/4 of Section 29, T43N, R12 East of
the 3rd P.M., described as follows: Beginning at the
point of intersection of the center line of Telegraph
Road (so called) with the Easterly right of way line of
the Chicago, Milwaukee, St. Paul and Pacific Railway
Company which point is S360321E., 641.1 feet from a point
in the North line of the aforesaid quarter Section; said
last point being 474 feet East of the NW corner of the
aforesaid quarter Section; thence S360321E on the center-
line of said Telegraph Road? (so called) , 471.5 feet;
thence Southwesterly to a point in the Easterly line of
the right of way of the Chicago, Milwaukee, St. Paul &
Pacific Railway Company, 489.3 feet Southerly of the
place of beginning; thence Northerly along the Easterly
right of way line of said Railway to the place of
