AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE
WITH RESPECT TO THE FIRSTAR BANK PROPERTY
COMMONLY KNOWN AS 700 DEERFIELD ROAD, DEERFIELD, ILLINOIS
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the
Firstar Bank (hereinafter "Petitioner ") to authorize the
amendment to a Special Use of certain real estate legally
described on Exhibit A attached hereto and made a part hereof and
commonly known as 700 Deerfield Road, Deerfield, Illinois
( "Subject Property ") to permit a drive -up automatic teller
machine and related driveway and for approval of a preliminary
plat of consolidation, as hereinafter described, under the
pursuant to the provisions of Articles 5.01- C,2,b.and 13.11 -D of
the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Village of Deerfield had previously permitted
the use of a portion of the Subject Property as a bank; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, and made written findings
of fact including express affirmative findings of compliance with
the provisions of Article 5.01 -C,2,b and 13.11 -D of the Village
Zoning Ordinance and recommended that said amendment for Special
Use of the Subject Property be approved and authorized.in
accordance with the Site Plan, the elevations and First Floor
Plan, prepared by The Hezner Corporation, and the testimony
adduced by the Petitioner at said hearing and subject to certain
conditions and restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the Plan
ONE: Commission are concurred in and adopted as the
findings of the President and Board of Trustees of
the Village of Deerfield and the Amendment to Special Use of the
Subject Property, permitting the addition of a drive -up automatic
teller machine and related driveway in addition to the
preliminary plat of consolidation be and the same are hereby
authorized and approved subject to the conditions and
restrictions hereinafter set forth.

SECTION That the approval and authorization of said
TWO: Amendment to Special Use hereby authorized is
subject to compliance by Petitioner with all other
applicable ordinances of the Village of Deerfield and is subject
to the following further conditions:
1. That all use, construction and development of
the Subject Property shall be in accordance
with the Site Plan, the elevations and First
Floor Plan, prepared by The Hezner
Corporation, a copy of each is included and
marked as Exhibit B and attached hereto and
made a part hereof, and all representations
made by the Petitioner to the Plan Commission
and President and Board of Trustees of the
Village of Deerfield.
2. That except for drive -up canopy lighting
which shall be permitted until dawn, lighting
of the parking area shall be permitted no
later than 9 p.m.
3. That except to the extent specifically
modified hereby, the provisions of Ordinance
No. 0 -87 -02 governing the use of the Subject
Property shall remain in full force and
effect.
SECTION That the approval and authorization of said

subject to the requirement that this Ordinance
shall be recorded in the Office of the Recorder of Deeds of Lake
County, Illinois, and all fees for such recordation and expenses
incurred therefor shall be paid by the Petitioner.

conflict, hereby repealed.
SECTION That the Village Clerk is hereby directed to
