AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE FOR SHELL OIL COMPANY
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Shell Oil
Company ( "Applicant "), located at 655 Waukegan Road, Deerfield,
Illinois (the "Subject Property "), to authorize an amendment to
the existing Special Use to allow the expansion of the existing
building and the installation of certain other improvements on
the Subject Property as depicted in the Plan (hereinafter
defined), all in accordance with Articles 5.01 and 13.11 of the
Zoning Ordinance of the Village of Deerfield, as amended; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was, in all respects, held according to law;
and
WHEREAS, the Plan Commission of the Village of Deerfield
after considering and reviewing the evidence adduced, the
submitted Site Plan, floor plan and exterior elevations, each
prepared by Shell Oil Company and dated November 5, 1991, October
25, 1991, and October 29, 1991, respectively and attached hereto
as Exhibit B (collectively, the "Plan "), made written findings of
fact and recommended that said amendment to the Special Use of
the Subject Property be approved and authorized subject to
certain conditions and restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the Plan
ONE: Commission as to the evidence adduced and the
submitted Plan to allow the expansion of the
existing building and.the installation of certain
other improvements on the Subject Property as depicted in the
Plan are concurred in and adopted as the findings of the
President and Board of Trustees and the amendment to the Special
Use of the Subject Property legally described in Exhibit A
attached hereto and made a part hereof to approve the Plan be and
the same is hereby authorized and approved.
SECTION That the approval and authorization of said
TWO: amendment to Special Use of the Subject Property
is hereby given subject to the requirement that
all use shall be in accordance with all exhibits, testimony,
representations submitted and made by the Applicant to the Plan
Commission and President and Board of Trustees and is also
subject to compliance by Applicant with all other applicable
provisions of the Zoning Ordinance of the Village of Deerfield.
ORDINANCE NO. 0 -92 -60
AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE FOR SHELL OIL COMPANY
SECTION That the approval and authorization of said
THREE: amendment to Special Use of the Subject Property
as hereby granted is subject to the following
conditions:
(1) Applicant shall at its own expense provide
landscaping on the Subject Property as
determined by a certain Streetscape Plan to
be prepared by the Streetscape Design Task
Force of the Village of Deerfield (the
"Streetscape Plan ").
(2) Applicant shall grant the Village of
Deerfield a ; ,5) -foot easement for streetscape
purposes along the west property line of the
Subject Property in form satisfactory to the
Village.
(3) The Applicant shall deposit in an interest
bearing account the sum of $ 6,300.00 to be
held by the Village of Deerfield for the
mutual benefit of Applicant and the Village
of Deerfield to pay for the cost of
streetscaping the Subject Property in
accordance with the Streetscape Plan.
SECTION That any violation of the conditions hereinabove
FOUR: set forth by Applicant or its successors,
grantees, transferees or assigns shall authorize
the revocation of the amendment to Special Use hereby authorized.
SECTION That all approval and authorization of said
FIVE: amendment to Special Use hereby given is subject
to the requirement that this Ordinance shall be
recorded in the Office of the Recorder of Deeds of Lake County,
Illinois, and all fees for such recordation and expenses incurred
therefor shall be paid by the Applicant.
SECTION That the Village Clerk is hereby directed to
SIX: publish this Ordinance in pamphlet form.
