AN ORDINANCE AMENDING ARTICLE 6 OF CHAPTER 9 OF THE
MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975
AND REVISING THE PROCEDURES FOR CONTRACTS
WHEREAS, the Village of Deerfield has adopted procedures for
all contracts for public works and improvements and for all
purchase orders or other contracts for supplies or services; and
WHEREAS, the Mayor and the Board of Trustees believe it is
in the best interest of the Village to update and revise those
procedures.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Section 9 -16 of Chapter 9 of-the Municipal
ONE: Code of the Village of Deerfield of 1975, as
amended, be and is hereby further amended by
deleting the Section heading and subsection (a) thereof and by
substituting in lieu thereof the following:
"Sec. 9 -16. Contracts over $10,000.
(a) Competitive Bids. Except as otherwise
provided in this Code, all contracts for public
works or improvements not to be paid for in part
or in whole by special assessment or special
taxation when the expense thereof exceeds $10,000,
and all purchase orders or contracts of whatever
nature for labor, materials, equipment or supplies
involving amounts in excess of $10,000 made by or
on behalf of the Village shall be let by free and
open competitive bidding after advertisement to
the lowest responsible bidder. Notwithstanding
the foregoing, such purchase orders or contracts
may be entered into by the appropriate officers
without adherence to bidding procedures if
authorized by the affirmative vote of two- thirds
(2/3) of the trustees then holding office."
SECTION Section 9 -17 of Chapter 9 of the Municipal Code of
TWO: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by deleting
subsections (a), (b) and (c) thereof and by substituting in lieu
thereof the following:
Na) Newspaper. Notice inviting bids shall
be published once in at least one newspaper

published or of general circulation in the Village
and at least fifteen (15) days preceding the
scheduled bid opening date. The bid opening date
shall be no more than forty -five (45) days from
the date of newspaper publication. The newspaper
notice shall include a general description of the
article or service to be purchased,-shall-state
where the bid package may be secured, and shall
state the time and place for opening bids.
(b) Bidders' List. The appropriate
department head shall also solicit sealed bids
from all responsible prospective suppliers or
contractors who have requested their names to be
added to a "Bidders' List" which the appropriate
department head shall maintain in a current
format, by sending them a copy of such newspaper
notice or such other notice as will acquaint them
with the proposed purchase or contract.
(c) Bulletin Board. The appropriate
department head shall also advertise all pending
purchases or bid awards by a notice posted on the
public bulletin board in the Village Hall."
SECTION Article 6 of Chapter 9 of the Municipal Code of
THREE: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by adding thereto
Section 9 -17A as follows:
"Sec. 9 -17A. Bid Package.
The appropriate department head shall prepare a -
bid package which shall include the specifications
and other required documents. The Village may
charge an administrative fee for the bid package
to cover the costs of preparation."

SECTION Article 6 of Chapter 9 of the Municipal Code of
FOUR: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by adding Section 9-
19A thereto as follows:
"Sec. 9 -19A. Certification Requirement.
All bids shall be accompanied by an executed
certification form in a condition satisfactory to
the Village complying with the provisions of
chapter 38, paragraph 33E -1 et seq. of the
Illinois Revised Statutes. Failure to fully comply
with the requirements of said chapter 38,
paragraph 33E -1 et seq. of the Illinois Revised
Statutes shall render a bid unacceptable."
SECTION Section 9 -20 of Chapter 9 of the Municipal Code of
FIVE: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by deleting
subsections (a) and (b) thereof and by substituting in lieu
thereof the following:
"(a) Sealed. Bids shall be submitted sealed to
the appropriate department head and shall be identified
as a bid on the envelope.
(b) Opening. Bids shall be opened in public at
the time and place stated in the public notices and the
department head shall within seven (7) days of the bid
opening date prepare a tabulation and recommendation to
the Village Manager who shall make a written report and
recommendation to the Board of Trustees."
SECTION Section 9 -21 of Chapter 9 of the Municipal Code of
SIX: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by deleting the
second sentence thereof and by substituting in lieu thereof the
following:
"Bids which do not conform to the bid forms
provided or are received by a facsimile machine or

are substantially incomplete or are otherwise
vague or uncertain may be rejected provided that
minor omissions or errors not affecting the bid
amount may be corrected."
SECTION Article 6 of Chapter 9 of the Municipal Code of
SEVEN: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by adding thereto
Section 9 -23A as follows:
"Sec. 9 -23A. Contracts between $1,000 and $10,000
All contracts for public works or
improvements not to be paid for in part or in
whole by special assessment or special taxation
and all purchases of supplies and other
contractual services involving a special item or
an amount more than $1,000 but less than $10, -000,
shall be awarded in accordance with the rules and
procedures established from time to time by the
Village Manager or, in the event the Village
Manager shall so direct, by the Finance Officer."
SECTION Section 9 -24 of Chapter 9 of the Municipal Code of
EIGHT: the Village of Deerfield of 1975, as amended, be
and is hereby further amended by deleting the
Section heading and the first paragraph thereof and by
substituting in lieu thereof the following:
"Sec. 9 -24. Contracts under $1000.
All contracts for public works or improvements not
to be paid for in part or in whole by special
assessment or special taxation involving an amount
less than $1000 and all purchases of supplies, and
other contractual services of less than the
estimated value of $1000 may be made by the
Village Manager or person designated by him in the
open market, without newspaper advertisement and
without observing the procedures prescribed in

AND REVISING THE PROCEDURES FOR CONTRACTS
Sections 9 -16 and 9 -23, as long as said contract
price does not result in exceeding the amounts
authorized therefor in the Annual Budget."
SECTION That the Village Clerk is hereby directed to
NINE: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
TEN: effect from and after its passage, approval and
publication, as provided by law.
