ORDINANCE NO. 0 -91 -38
AN ORDINANCE AUTHORIZING AN AMENDMENT
TO SPECIAL USE FOR A PRIVATE SCHOOL AT MAPLEWOOD SCHOOL
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the BOARD
OF EDUCATION OF SCHOOL DISTRICT 109 to'authorize the use or
occupancy of an additional portion of Maplewood School,
Deerfield, Illinois, for a private school to be operated by
Challenger Day School Program under and pursuant to the
provisions of Articles 7.02 and 13.11 of the Zoning Ordinance of
the Village of Deerfield; and
WHEREAS, pursuant to a Special Use granted pursuant to
ordinance 81 -47 a portion of Maplewood School is presently used
for a private school operated by Glenkirk School for Retarded
Children; and
WHEREAS, said hearing was held pursuant to a duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, made written findings of
fact and recommended that said amendment to the special use of
said real estate be approved and authorized subject to certain
conditions and restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the
ONE: Plan Commission are concurred in and adopted as
the findings of .the President and Board of
Trustees and the amended special use of the real estate legally
described in Exhibit A, attached hereto and made a part hereof,
for a private school to be operated by Challenger Day School
Program with an enrollment limit of 25 students, be and the same
is hereby authorized and approved.
SECTION That the approval and authorization of said
TWO: amended special use hereby given is subject to the
requirements that all use shall be in
accordance with all representations submitted and made by
Applicant to the Plan Commission and President and Board of
Trustees, is also subject to compliance by Applicant with all
other applicable provisions of Ordinance No. 81 -47, and-the
Zoning ordinance, specifically including the requirement that the
enrollment of the private school be limited to a maximum of 25
students.
SECTION That the approval and authorization of said
