AN ORDINANCE AMENDING CHAPTER 2,
ARTICLE 8, DIVISIONS 3, 4 AND 5 OF THE
MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION That Division 3 entitled "Building and zoning
ONE: Department" of Chapter 2, Article 8 of the
Municipal Code of the Village of Deerfield
of 1975, as amended, be and the same is further amended by
deleting Division 3 in its entirety and substituting in lieu
thereof the following:
"Division 3. Department of Community Development
Sec. 2 -90. Establishment of Department of Community
Development.
There is hereby established the Department of Community
Development, an administrative department of the Village.
This Department shall consist of the Director of Community
Development and such other employees as the Board shall,
from time to time, authorize.
Sec. 2 -91. Director of Community Development; appointment;
control and supervision.
There is hereby established the position of Director
of Community Development who shall be appointed by the
Village Manager. The Director of Community Development
shall have control and supervision over all employees
assigned to the Department of Community Development,
subject to the approval of the Village Manager, and
be responsible for all matters related to land use planning,
zoning and building code enforcement.
Sec. 2 -92. Powers and duties of Director of Community
Development.
(a) The Director of Community Development shall:
(1) Enforce, or cause to be enforced, all laws
and ordinances relating to the construction, repair
or alteration of buildings and structures and the use

of streets or parkways in connection therewith, and
make, or cause to be made, all inspections needed for
that purpose;
(2) Issue, or cause to be issued, all proper permits
for such work after payment of the fees required to
the Director of Finance;
(3) Enforce or cause to be enforced all Village
Ordinances relating to the installation, care and standards
of plumbing, electric signs, electrical wiring and electrically
operated equipment;
(4) Perform or cause to be performed all duties
assigned by this Code, or by any other ordinances or
laws relating to his office;
(5) Be the zoning enforcement officer of the Village
and see to the enforcement of the Zoning Ordinance.
(6) Enforce or cause to be enforced the provisions
of the BOCA Basic Property Maintenance Code as adopted
by the Village of Deerfield from time to time pursuant
to Chapter 13, Section 13 -1, of the Municipal Code of
the Village of Deerfield and in the course of said enforcement
issue or cause to be issued any such citations or orders
resulting from violations of said Code and initiate
prosecution of any such violations with the cooperation
of the Village Prosecutor of the Village of Deerfield.
Sec. 2 -93. Stop order requirements.
(a) The Director of Community Development or his
designee shall have the power to order all work stopped
on construction, alteration or repair of any building
when the work is being done in violation of any provision
of this Code or any ordinance relating thereto, or in
violation of the zoning ordinance.
(b) Work shall not be resumed after the issuance
of such an order except on the written permission of
the Director of Community Development, provided, that
if the stop order is an oral one, it shall be followed
by written stop order within an hour. Such written
stop order may be served by any police officer.

Sec. 2 -94. Entry powers of Director of Community Development.
The Director of Community Development or his designee
shall have the power to make or cause to be made entry
into any building or premises where the work of altering,
repairing or constructing any building or structure
is being conducted, for the purpose of making inspections
at any reasonable hour.
Sec. 2 -95. Reports to Lake and Cook County.
Within fifteen (15) days after the issuance of
a building permit, the Director of Community Development
or his designee shall send a copy of the permit, together
with a complete legal description of the area to which
the permit pertains, and the real estate index number,
if any, to the County assessor and Township assessor
in which County and Township said area is situated."
SECTION That Division 4 entitled "Department of
TWO: Public Works" of Chapter 2, Article 8 of the
Municipal Code of the Village of Deerfield
of 1975, as amended, be and the same is further amended by
deleting Division 4 in its entirety and substituting in lieu
thereof the following:
"Division 4.
Department of Public Works and Engineering.
Sec. 2 -96. Establishment of Department of Public Works
and Engineering.
There is hereby established a Department of Public
Works and Engineering, an administrative department
of the Village. This Department shall consist of the
Director of Public Works and Engineering and such other
employees as the Board shall, from time to time, authorize.
Sec. 2 -97. Appointment of Director of Public Works and
Engineering; control and supervision.

There is hereby established the position of Director
of Public Works and Engineering who shall be the head
of the Department. The Director shall be appointed
for an indefinite term by the Village Manager and shall
have control and supervision over all employees assigned
to the department subject to the approval of the Village
Manager.
Sec. 2 -98. Powers and duties of Director of Public Works
and Engineering.
(a) The Director of Public Works and Engineering
shall:
(1) Have charge and supervision over all public
property of the Village, including all streets, parks,
parkways, sidewalks, municipal buildings and all other
property of the Village not specifically assigned to
some other officer;
(2) Have charge of, and be responsible for,
the care, maintenance and operation of the water system,
the sanitary sewer system and disposal plant, the street
lighting system, all streets and sidewalks and the drainage
thereof;
(3) Have charge of and be responsible for the
condition of all motor vehicles; trucks and other public
works equipment of the Village; and of all buildings
or places in which the same are housed or kept.
(4) Conduct all required inspections of Village
improvements constructed or installed by contractors;
(5) Perform all duties assigned by this.Code
or by other Ordinances or Laws relating to this office;
(6) Have the power to order all work stopped
on the construction, alteration or repair of any municipal
improvement when the work is being done in violation
of any provision of this Code or any ordinances relating.

SECTION That Division 5 entitled "Engineering
THREE: Department" of Chapter 2, Article 8 of the
Municipal Code of the Village of Deerfield
of 1975, as amended, be and the same is further amended by
deleting Division 5 in its entirety.
SECTION That the Village Clerk is hereby directed
FOUR: to publish this Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances
FIVE: in conflict herewith are, to the extent of
such conflict, hereby repealed.
SECTION That this Ordinance shall be in full force
SIX: and effect from and after its passage, approval
and publication as provided by law.
