R-81-02RESOLUTION NO. 0 -81- 02 WHEREAS, the Village of Deerfield, Illinois is a municipality exercising Home Rule Powers pursuant to the constitution of the State of Illinois; and WHEREAS, the Village of Deerfield has previously adopted an Ordinance known as "The Deerfield Zoning Ordinance of 1978," (the "Zoning Ordinance "); and WHEREAS, the Zoning Ordinance provides for the division of the Village into zoning districts of various character, number, shape and area as are best suited to effect the purposes set forth in the said Zoning Ordinance; and WHEREAS, on February 19, 1979, the Village of Deerfield adopted a Compre- hensive Plan (the "Comprehensive Plan ") setting forth planning and zoning goals for properties within the Village of Deerfield; and WHEREAS, the area depicted in Exhibit A attached hereto and made a part hereof is included primarily in the R -4 Single and Two Family District; and WHEREAS, the Comprehensive Plan sets forth a goal of development of said areas in a unified manner providing primarily for commercial uses, high density housing and professional offices, NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That a moratorium be declared on the acceptance of petitions ONE: seeking map amendments and /or zoning variations for properties lying within the area depicted on Exhibit A, pending receipt from and adoption of recommendations of the Plan Commission of the Village of Deerfield with respect to either the establishment of a new zoning district or creation of developmental standards facilitating the development of said area in conformity with the goals of the Comprehensive Plan. SECTION That following preparation and submission of the Village Staff TWO: proposals, the Plan Commission of the Village of Deerfield conduct a hearing to consider the issues described in Section One and thereafter, furnish its recommendation with respect thereto, to the Corporate Authorities. SECTION That said moratorium shall remain in full force and effect until THREE: completion of the activities described herein and until rescinded by action of the Corporate Authorities, and in any event, shall terminate six months from the date hereof unless extended by action of the Corporate Authorities. SECTION That the Village Manager i.s di`rected to notify all applicants who FOUR: have pend.ing petitions seeking map amendments and /or zoning variations.in the above described area, of the passage of this Resolution and shall provide said applicants with copies of this Resolution. R -81-02 RESOLUTION APPROVING ANNEXATION AGREEMENT BETWEEN THE VILLAGE OF DEERFIELD AND AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO AS TRUSTEE UNDER TRUST NO. 43716 WHEREAS, AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO AS TRUSTEE UNDER TRUST NO. 437169 is the owner of record of certain real estate, the legal . description of which is set forth in the attached Annexation Agreement; and WHEREAS, pursuant to the provisions of Section 11- 15 -1.1, et seq., of the Illinois Municipal Code, said owner submitted to the Corporate Authorities of the Village of Deerfield a proposed Annexation Agreement with respect to its real estate, a copy of which Agreement is attached hereto and made a part hereof; and WHEREAS, pursuant to notice as required by statute and ordinance, a public hearing was held by the Plan Commission of the Village with respect to the request of said owner to zone its property in the I -1 Office, Research, Restricted Industry District and to amend and modify the Village Zoning Ordinance in various respects so as to permit the development of real estate in the manner proposed in the attached Annexation Agreement and Exhibits attached thereto and made a part thereof, specifically including a plan of development, and written findings of fact and recommendations with respect thereto were made by said Plan Commission and submitted to the Corporate Authorities; and WHEREAS, pursuant to notice as required by statute and .ordinance, a public hearing was held by the Corporate Authorities of the Village with respect to the terms and conditions of said Annexation Agreement; and .WHEREAS, the Corporate Authorities, after due and careful consideration, have concluded that the annexation of the subject property to the Village on the terms and conditions set forth in said attached Annexation Agreement would further the growth of the Village, enable the Village to control the develop- ment of said property and subserve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Annexation A Pmpnt between the Village of Deerfield ONE: and American National Bank -and Trust Company of Chicago as Trus- tee under Trust No. 43716, along with all Exhibits thereto, spe- cifically including a plan of development dated January 19, 1981 prepared Architectonics, Inc. a covy of which is attached hereto and made a part of, be and_t.he same is hereby approve_ 1 SECTION That the President and Clerk of the Village of Deerfield are TWO: hereby authorized and directed to execute said Agreement.
