AN ORDINANCE AUTHORIZING AN AMENDMENT TO A
SPECIAL USE WITH RESPECT TO THE DEERFIELD STATE BANK
PROPERTY COMMONLY KNOWN AS 700 DEERFIELD ROAD, DEERFIELD, ILLINOIS
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the Deerfield
State Bank (hereinafter "Petitioner ") to authorize the amendment to
a Special Use of certain real estate commonly known as 700 Deerfield
Road, Deerfield, Illinois ( "Subject Property ") to permit an
expansion of the second floor of the existing bank building, as
hereinafter described, under and pursuant to the provisions of Articles
5.1= 3,.2:0 -3,2 and 13.11 -4 of the Zoning Ordinance of the Village of
Deerfield; and
WHEREAS, the Village of Deerfield had previously permitted the
use of a portion of the Subject Property as a bank; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of,fact
including express affirmative findings of compliance with the
provisions of Articles 5.1 -3 and 13.11 -4 of the Village Zoning
Ordinance and recommended that said amendment for Special Use of the
Subject Property be approved and authorized in accordance with the
Site Plan dated October 2, 1986, prepared by Thompson Dyke &
Associates, Ltd., and the Location Plan and Second Floor Plan, each
dated May 23, 1986 and prepared by Robert Frager Associates, and the
testimony adduced by the Petitioner at said hearing and subject to
certain conditions and restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the Plan
ONE: Commission are concurred in and adopted as the
findings of the President and Board of Trustees of the
Village of Deerfield and the amendment to Special Use of the Subject
Property, as and for an expansion of the Bank by the addition to the
second floor, as hereinafter described, subject to the conditions
and restrictions hereinafter set forth, be and the same is hereby
authorized and approved.
SECTION That the approval and authorization of said Special Use

Petitioner with all other applicable ordinances of the
Village of Deerfield and is subject to the following further
conditions:

1. That all use, construction and development of the
Subject Property shall be in accordance with all
the components of the Site Plan dated October 2,
1986, prepared by Thompson Dyke & Associates,
Ltd., the Location Plan and Second Floor Plan,
each dated May 23, 1986 and prepared by Robert
Frager Associates, a copy of each is included and
marked as Exhibit B and attached hereto and made
a part hereof, and all representations made by
the Petitioner to the Plan Commission and
President and Board of Trustees of the Village of
Deerfield.
2. That the one parking space located at the
northeast corner of the proposed site plan shall
be eliminated.
3. That the proposed stockade fence on the north
side of the berm along the north property line
be eliminated and arbor vitae be provided instead.
4. That lighting of the parking area shall be
permitted no later than 9 p.m. and shall be
limited to 12 foot high light standards, located
in the landscape islands in the parking area
which lights shall be shielded to minimize
spillover lighting into the residential areas
adjacent to the Subject Property.
5. That Petitioner "s proposal for the Waukegan Road
entrance to the Subject Property shall be
referred to the Village's consulting engineer and
thereafter the configuration.of,-said entrance
shall be subject to the approval of the corporate
authorities.
6. That in the event that the Village of Deerfield
decides to delay requiring the Petitioner to
develop the parking area as proposed and approved
so that an overall parking plan for the northeast
quadrant of the Village Center can be developed,
the Petitioner shall provide a letter of credit
in the full amount of $100,000 and in form
satisfactory to the Village of Deerfield to
insure the availability of funds for anticipated
parking lot development costs.
