AN ORDINANCE AUTHORIZING AN AMENDMENT TO
SPECIAL USE WITH RESPECT TO THE HOLY CROSS CHURCH
PROPERTY COMMONLY KNOWN AS 724 ELDER LANE. DEERFIELD. ILLINOIS
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of HOLY CROSS
CHURCH (the "Petitioner ") to authorize an amendment to the Special Use
of certain real estate commonly known as 724 Elder Lane, Deerfield,
Illinois, and hereinafter described, to approve an expansion of the
existing school facility located at the said real estate to include
a new parish hall /gymnasium structure, all in accordance with
Articles 4.3 and 13.11 -4 of the Zoning Ordinance of the Village of
Deerfield, as amended; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering and reviewing the evidence adduced, including the
submitted Site Plan, dated April 20, 1987, and prepared by
O'Donnell, Wicklund, Pigozzi and Peterson, Architects, Inc., made
written findings of fact including express affirmative findings of
compliance with the provisions of Articles 4.3;and.13.11- 4,:of.:the
Village Zoning Ordinance and recommended that said amendment to the
Special Use of said real estate be approved and authorized in
accordance with the plans presented and the testimony adduced by the
Petitioner at said hearing and subject to certain conditions and
restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the Plan
ONE: Commission as to the evidence adduced and the Site
Plan are concurred in and adopted as the findings of
the President and Board of Trustees and the amendment to Special Use
of the real estate legally described in Exhibit A attached hereto
and made a part hereof to approve the expansion of the existing
school facility located at the said real estate to include a new
parish hall /gymnasium structure and the proposed Site Plan, dated
April 20, 1987, and prepared by O'Donnell, Wicklund, Pigozzi and
Peterson, Architects, Inc., marked Exhibit B attached hereto and
made'a part hereof, subject to the conditions and restrictions
hereinafter set forth, be and the same is hereby authorized and
approved.

SECTION That the approval and authorization of said amendment
TWO: to Special Use hereby authorized is subject to the
requirements that all use shall be in accordance with
all Exhibits, testimony, representations submitted and made by the
Petitioner to the Plan Commission and President and Board of Trustees
and is also subject to compliance by Petitioner with all other
applicable ordinances of the Village of Deerfield.
SECTION That any violation of the conditions hereinabove set
THREE: forth shall authorize the revocation of the amendment
to Special Use hereby authorized.
SECTION That the approval and authorization of said amendment
FOUR: to Special Use hereby authorized is subject to the
requirements that this Ordinance shall be recorded in
the Office of the Recorder of Deeds of Lake County, Illinois, and
all fees for such recordation and expenses incurred therefor shall
be paid by the Petitioner.
SECTION That all ordinances or parts of ordinances in conflict
FIVE: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That the Village Clerk is hereby directed to publish
SIX: this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and effect

the plat thereof recorded November 5, 1917, as Document 174609, in Book "K"
of Plats, page 4, lying east of the Easterly line of Waukegan Road, west of
a line 800 feet west of and parallel with the East line of said Lot 6, in
Ender Park Subdivision, north of a line 100 feet north of and parallel with
the North line and said North line extended in Duffy's Subdivision south of a
line described as follows: Beginning on the Easterly right -of -way line of
