ORDINANCE NO. 0 -86 -29
AN ORDINANCE AUTHORIZING AN AMENDMENT
TO AN EXISTING SPECIAL USE - COMMERCIAL
AND INDUSTRIAL PLANNED UNIT DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Venture 40,
an Illinois Joint Venture and the LaSalle National Bank under Trust
Agreement No. 106505 and dated June 1, 1983, (herein collectively
referred to as "Applicant ") to authorize an amendment to Ordinance
No. 85 -43 authorizing a Special Use - Commercial and Industrial
Planned Unit Development to provide for the development and use of
certain real estate described on Exhibit A hereto and for a Special
Use - Planned Unit Development, under and pursuant to the provisions
of Articles 5.2 -3,8, 12.1, 12.1 -2, 12.5 and 13.11 of the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission, the President and Board of Trustees have considered
and reviewed the Amended Final Development Plan of portions of the
Subject Property consisting of an Amended Architectural Plan
prepared by Aumiller Youngquist, P.C. providing for the enclosure of
the deck area on the South and East sides of the Building thereby
adding 900 square feet to the restaurant area and creating a
deficiency of eleven (11) parking spaces pursuant to the Joint
Parking Agreement submitted by applicants in addition to all other
documentary filings required by the Zoning Ordinance of the Village
of Deerfield reflecting all revisions from the original Final
Development Plan which was made a part of Ordinance No. 85 -43; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the authorization and granting of said Amendment
to Special Use - Commercial Planned Unit Development in accordance
with the Amended Plan for the C -2 PUD East marked Exhibit B and
attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:

SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find that the Amended Special Use, as
hereby authorized, fully complies with the require-
ments and standards set forth in Article 13.11 -4 of the Village
Zoning Ordinance, and the Amended Special Use of the real estate, as
and for purposes of a Commercial Planned Unit Development as set
forth on Exhibit B, be and the same is hereby authorized and
approved subject to the conditions hereinafter set forth.
SECTION That the approval and authorization of said Amended
TWO: Special Use hereby granted is subject to the following
condition:
That all use, construction and development shall be in
accordance with the Amended Final Development Plan, consisting of an
Amended Architectural Plan dated , 1986, prepared by
Aumiller Youngquist, P.C., a copy of which is marked Exhibit B and
attached hereto and made a part hereof, all other documentary and
exhibit filings made pursuant to Planned Unit Development Procedures
as set forth in Article 12.9 of the Village Zoning Ordinance, the
terms of this Ordinance and all representations by the Applicant to
the Plan Commission and President and Board of Trustees.
SECTION That any violation of the condition hereinabove set
THREE: forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation
of the Special Use hereby authorized.
SECTION As part of this Ordinance granting the Amended Special
FOUR: Use and approving the Amended Final Development Plan,
the following modification of the regulations estab-
lished in the C -2 Outlying Commercial District is hereby authorized,
all in accordance with the Amended Architectural Plan and the
representations-of the Applicant:
1. Provision of an additional eleven (11) spaces of
parking for C -2 PUD on portions of the adjoining
I -1 PUD in accordance with the Amended Final
Development Plan.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Amended Architectural Plan" in the office of the Recorder of Deeds
of Lake County, Illinois at Applicant's expense.

SECTION That except to the extent specifically amended hereby,
SIX: all provisions of Ordinance No. 85 =43 shall remain in
full force and effect and all undertakings of the
Applicant or its successors, shall remain in full force and effect
as if fully restated herein.
SECTION That this Ordinance shall be in full force and effect
SEVEN: from and after its passage, approval and publication
as provided by law.
