AN ORDINANCE GRANTING A
VARIATION FOR DRIVEWAY WIDTH
WHEREAS, the Corporate Authorities of the Village of Deerfield
have received a petition from David K. Gordon ( "Petitioner "), the
owner of real estate within the Village of Deerfield commonly
described as 17 Birchwood Avenue, Deerfield, Illinois, seeking a
variation from the strict application of the provisions of
Section 19.28(1) of the Municipal Code of 1975 of the Village of
Deerfield, as amended, enabling said Petitioner to maintain a
driveway having a width of 26 feet measured at the property line
and extending only to the existing sidewalk in lieu of the 18
foot maximum width allowed thereby; and
WHEREAS, Petitioner has presented evidence and testimony
establishing the hardship created by strict compliance with the
provisions of said Section 19.28(1).
WHEREAS, the Corporate Authorities of the Village of Deerfield
have considered the evidence and testimony adduced and deem it to
be in the best interests of the Village of Deerfield to permit
said variation from the strict application of Section 19.28(1) so
as to permit Petitioner to maintain a driveway 26 feet in width
measured at the property line and extending only to the existing
sidewalk in lieu of the required 18 feet in width.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Petitioner be permitted to maintain a driveway
ONE: having a width of 26 feet measured at the property
line and extending only to the existing sidewalk
in lieu of the 18 foot maximum established by Section 19.28(1) of
the Municipal Code of the Village of Deerfield of 1975, as
amended, on the property commonly known as 17 Birchwood Avenue,
Deerfield, Illinois.

SECTION That Petitioner be required to comply with all
TWO: other applicable laws and ordinances of the Village
of Deerfield as they apply to the subject property.
SECTION That this Ordinance shall be in full force and

publication as provided by law.
