AN ORDINANCE AUTHORIZING AN AMENDMENT TO A
SPECIAL USE WITH RESPECT TO THE WHITEHALL NURSING HOME
PROPERTY COMMONLY KNOWN AS 300 WAUKEGAN ROAD, DEERFIELD, ILLINOIS
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of WHITEHALL
NORTH CONVALESCENT HOME PARTNERSHIP to authorize the amendment to a
Special Use of certain real estate commonly known as 300 Waukegan
Road, Deerfield, Illinois, and hereinafter described, for an
expansion to the Nursing Home, as hereinafter described, under and
pursuant to the provisions of Articles 5.2, 13 -:1.1 and 13.11 -4 of the
Zoning Ordinance of the Village of Deerfield; and
WHEREAS, pursuant to Ordinance 72 -70 and as thereafter amended by
ordinance, 76 -67, the Village of Deerfield had previously permitted,
as a Special Use, the use of a portion of the real estate.for a
nursing home.
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact in-
cluding express affirmative findings of compliance with the provisions
of Articles 5.2,.113:..11 and 13.11 -4 of the Village Zoning Ordinance and
recommended that said amendment for Special Use of said real estate
be approved and authorized in accordance with the plans presented and
the testimony adduced by the Petitioner at said hearing and subject
to certain conditions and restrictions hereinafter set forth; and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the Plan
ONE: Commission are concurred in and adopted as the findings
of the President and Board of Trustees and the amendment
to Special Use of Lots 1 and 2 in Golf -View subdivision, being a
Subdivision of part of the South West quarter of Section 33, Township
43 North, Range 12, East of the Third Principal Meridian, all in the
Village of Deerfield, recorded April 1, 1977, as document number
1827850, Plat Book 59, Page 8, as and for an expansion to the Nursing
home, as hereinafter described, subject to the conditions and
restrictions hereinafter set forth, be and the same is hereby
authorized and approved.
SECTION That the approval and authorization of said Special Use
TWO: hereby authorized is subject to compliance by Petitioner
with all other applicable ordinances of the Village of
Deerfield and is subject to the following further conditions:

A. That the addition to the existing nursing home
facility at the southwest corner of the'building
shall not exceed 4 additional bedrooms per each of
2 floors and not exceeding 10 additional beds.
B. That the Petitioner provide not less than 97
parking spaces and in addition designate areas
sufficient to accommodate 8 additional parking
spaces within the Subject Property which shall
remain available for future parking use at such
time as the Village of Deerfield may determine.
SECTION That the approval and authorization of said Amendment to
THREE: Special Use hereby authorized is subject to the
requirement that this Ordinance shall be recorded in
the Office of the Recorder of Deeds of Lake County, Illinois, and all
fees for such recordation and expenses incurred therefor shall be
paid by the Petitioner.
SECTION That all ordinances or parts of ordinances in conflict
FOUR: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and effect
SIX: from and after its passage, approval and publication as
provided by law.
