AN ORDINANCE AUTHORIZING AN AMENDMENT
TO AN EXISTING SPECIAL USE - COMMERCIAL
AND INDUSTRIAL PLANNED UNIT DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Sven
Flodstrom and the LaSalle National Bank under Trust Agreements Nos.
104882 and 106505 and dated August 17, 1982 and June 1, 1983,
respectively, (herein collectively referred to as "Applicant ") to
authorize an amendment to Ordinance No. 82 -43 authorizing a Special
Use - Commercial and Industrial Planned Unit Development to provide
for the development and use of certain real estate described on
Exhibit A hereto and for a Special Use - Planned Unit Development,
under and pursuant to the provisions of Articles 5.2 -3,8, 12.11
12.1 -2, 12.5 and 13.11 of the Zoning Ordinance of the Village of
Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission, the President and Board of Trustees have considered
and reviewed the Amended Final Development Plan of portions of the
Subject Property formerly identified and designated as "C -2 PUD
East" and "I -1 PUD," consisting of an Amended Final Land Use Plan
prepared by Aumiller Youngquist, P.C. and an Amended Final Landscape
Plan for the restaurant portion of the C -2 PUD East prepared by
Camiros, Ltd. and dated July 18, 1985, submitted by applicants in
addition to all other documentary filings required by the Zoning
Ordinance of the Village of Deerfield reflecting all revisions from
the original Final Development Plan which was made a part of
Ordinance No. 82 -43; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the authorization and granting of said Amendment
to Special Use - Commercial Planned Unit Development in accordance
with the Amended Final Development Plan for the C -2 PUD East and
portions of the I -1 PUD marked Exhibit B and attached hereto and
made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find that the Amended Special Use, as
hereby authorized, fully complies with the require-
ments and standards set forth in article 13.11 -4 of the Village
zoning Ordinance, and the Amended Special Use of the real estate, as
and for purposes of a Commercial Planned Unit Development as set
forth on Exhibit B, be and the same is hereby authorized and
approved subject to the conditions hereinafter set forth.
SECTION That the approval and authorization of said Amended
TWO: Special Use hereby granted is subject to the following
condition:
That all use, construction and development shall be in
accordance with the Amended Final Development Plan, dated September 17,
1985, prepared by Aumiller Youngquist, P.C., a copy of which is
marked Exhibit B and attached hereto and made a part hereof, all
other documentary and exhibit filings made pursuant to Planned Unit
Development Procedures as set forth in Article 12.9 of the Village
zoning Ordinance, the terms of this Ordinance and all
representations by the Applicant to the Plan Commission and
President and Board of Trustees.
SECTION That any violation of the condition hereinabove set
THREE: forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation
of the Special Use hereby authorized.
SECTION As part of this Ordinance granting the Amended Special
FOUR: Use and approving the Amended Final Development Plan,
the following modification of the regulations estab-
lished in the C -2 Outlying Commercial District-are hereby
authorized, all in accordance with the Amended Final Land Use Plan
and the representations of the Applicant:
1. Permit a one foot east side yard in lieu of the
twelve feet required.
2. Modification of the landscape screening
requirement on the west side yard so as to permit
four feet of screening in lieu of the five feet
height required and elimination of the screening
requirement on the east side yard and rear yard
in accordance with the Amended Final Landscape
Plan for the C -2 PUD. The screening to be
provided shall be as depicted on the Amended
Final Landscape Plan.
3. Provision of parking for C -2 PUD on portions of
the adjoining I -1 PUD in accordance with the
Amended Final Development Plan.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Amended Final Land Use Plan" in the office of the Recorder of Deeds
of Lake County, Illinois at Applicant's expense.
SECTION That except to the extent specifically amended hereby,
SIX: all provisions of Ordinance No. 82 -43 shall remain in
full force and effect and all undertakings of the
Applicant or its successors, shall remain in full force and effect
as if fully restated herein.
'SECTION That this Ordinance shall be in full force and effect
SEVEN: from and after its passage, approval and publication
as provided by law.

WHEREAS, the Plan Commission of the Village of Deerfield has
