ORDINANCE NO. 0 -85 -09
AN ORDINANCE AMENDING ARTICLES 2, 5, 6, 8, 9 and 12
OF THE ZONING ORDINANCE OF THE VILLLAGE OF DEERFIELD
WHEREAS, The Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the Board of
Trustees of the Village of Deerfield to consider certain text
amendments to the Zoning Ordinance; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, The Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact in
favor of certain of the proposed text amendments to the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the recommendations of the Plan
Commission as to the proposed text amendments will serve the best
interests of the Village of Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Article 9.3 -8 of the Zoning Ordinance of the
ONE: Village of Deerfield, as amended, be and the same is
further amended by deleting subsection 6, "Height" in
its entirety, renumbering subsection 7, "Area" to subsection 6 and by
substituting a new subsection 2 as follows:
"2. Location and Number.
Overhead banners may only be located on the
Deerfield Road railroad overpass structure and
the height of any such banner shall be limited to
the height of the overpass structure."
SECTION That Article 8.2 -3 of the Zoning Ordinance of the
TWO: Village of Deerfield, as amended, be and the same is
hereby further amended by deleting subsection 9 "Roping
of Parking Facilities" in its entirety and renumbering subsection 10
"Provisions for the Handicapped" as subsection 9.
SECTION That Article 2.4 -9 of the Zoning Ordinance of the
THREE: Village of Deerfield, as amended, be and the same is
hereby further amended by amending the caption and the
first sentence of subsection 2 thereof, as follows:
"1. Off- Street Parking - Non - Residential Areas
and Certain Multi- Family Residential Uses.
The following landscaped and planted areas shall
be provided for all parking areas for
non - residential areas and multi- family uses
providing parking for four (4) or more vehicles."
SECTION That Articles 5.1- 2,3,d; 5.2- 2,3,e; 5.3- 2,3,d;
FOUR: 6.1 -3,1,a and b and 8.2 -5,3 of the Zoning Ordinance of
the Village of Deerfield, as amended, be and the same
is hereby further amended by substituting the word "facility" in
lieu of the word "clinic" in each case where it appears.
SECTION That Article 14.2 of the Zoning Ordinance of the
FIVE: Village of Deerfield, as amended, be and the same is
further amended by deleting therefrom the definition
of "clinic" and substituting the definition of "facility" as follows:
"Facility: Offices of health professionals which
contain facilities for examination and treatment
of patients but not for their lodging."
SECTION That Article 12.1 -2 of the Zoning Ordinance of the
SIX: Village of Deerfield, as amended, be and the same is
hereby further amended by inserting the word "height"
between the words "width" and "parking" in the seventh line thereof.
SECTION That Article 6 -1.3,2 of the Zoning Ordinance of the
SEVEN: Village of Deerfield, as amended, be and the same is
hereby further amended by deleting said Article in its
entirety and substituting in lieu thereof the following:
"6.1 -3 Special Uses
2. Retail Business Uses
a. The following uses may be permitted in an
office building when authorized as a Special
Use and when operated primarily for the
convenience of the tenants:
(1) Book and stationery stores
(2) Office supply stores
(3) Restaurants, sit -down
b. Planned Unit Developments
(1) The following uses may be permitted in
office buildings within an I -1 Planned
Unit Development of 20 acres or larger
in addition to those uses set out in
6.1 -3, 2, a, when such uses would be
operated primarily for the convenience
of the tenants of the buildings within
the Planned Unit Development.
(a) Automatic teller machine
(b) Travel agency
(c) Newstands /drug store
(d) Florist
(e) Photocopy or printshop
(2) When authorized in accordance with the
provisions of 6.1 -3, 2, a, and /or b,
the hours of operation of said uses
shall be limited to the traditional
hours of operation of an office
building.
(3) The maximum amount of floor space
devoted to such uses within the entire
Planned Unit Development and within a
particular building within the Planned
Unit Development shall not be greater
than that which is approved by the
Village as being reasonable to serve
the .tenants of the buildings within the
Planned Unit Development."
SECTION That the Village Clerk is hereby directed to publish
EIGHT: this Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinanceg in conflict
NINE: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That this Ordinance shall be in full force and effect
TEN: from and after its passage, approval and publication,
as provided by law.
