AN ORDINANCE AUTHORIZING AN AMENDMENT TO A
SPECIAL -USE INDUSTRIAL PLANNED DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of AMERICAN
NATIONAL BANK AND TRUST COMPANY as Trustee under a Trust Agreement
dated August 31, 1983 and -known as Trust Number 59087, Owner (herein-
after referred to as "Applicant ") to consider a certain text amend-
ment to the Zoning Ordinance of the Village of Deerfield relative to
permitting certain retail business uses in the I -1 Office, Research,
Restricted Industrial District as a special use upon certain condi-
tions and in certain circumstances as part of the Special Use of the
Subject Property identified on Exhibit A attached hereto, which
Special -Use Industrial Planned Development was previously approved
pursuant to Ordinance 84 -63; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, following adoption of Ordinance No. 84 -63 approving
Applicant's Special -Use Industrial Planned Development, the Plan
Commission gave further consideration to certain text amendments
previously requested by Applicant as part of the Special -Use
Industrial Planned Development and the Corporate Authorities adopted
Ordinance No. 85 -_0 approving said text amendments; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the recommendations of the Plan
Commission as to these amendments should be applied to the Subject
Property as part of the Special -Use Industrial Planned Development.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find the Amended Special Use permitting
Applicant to include the retail business uses set forth
in Article 6- 1.3,2b of the Zoning Ordinance, as amended, of the
Village of Deerfield, as hereby authorized, fully complies with the
requirements and standards set forth in Article 13.11 -4 of the
Village Zoning Ordinance, and the Amended Special Use of the real
estate, as and for purposes of an Industrial Planned Unit
Development as set forth on Exhibit B, be and the same is hereby
authorized and approved.
SECTION That all use, construction and development shall be in
TWO: accordance with the conditions set forth in Article
6- 1.3,2b of the Zoning Ordinance, as amended, of the
Village of Deerfield, the terms of this Ordinance and all representa-
tions by the Applicant to the Plan Commission and President and Board
of Trustees. 4
SECTION That any violation of the condition hereinabove set
THREE: forth by the Applicant or its successors, grantees,
transferees or assigns shall authorize the revocation
of the Amended Special Use granted hereby.
SECTION That the Village-Clerk is hereby directed to publish
FOUR: this Ordinance in pamphlet form and to record said
Ordinance and Exhibit B in the office of the Recorder
of Deeds of Lake County, Illinois at Applicant's expense.
SECTION That except to the extent specifically amended hereby,
FIVE: all provisions of Ordinance No. 84 -63 shall remain in
full force and effect and all undertakings of the
Applicant or its successors, shall remain in full force and effect
as if fully restated herein.
SECTION That this Ordinance shall be in full force and effect
SIX: from and after its passage, approval and publication,
as provided by law.
