AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS
OF CHAPTER 20 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD
WHEREAS, the Corporate Authorities of the Village of Deerfield have
received a petition from THE ZION LUTHERAN CHURCH ( "Petitioner "), the owner of
real estate within-the Village of .Deerfield commonly described as 10 Deerfield
Road, Deerfield, Illinois, seeking a variation from the strict application of
the provisions of Section 19.28(2) of the Municipal Code of the Village of
Deerfield of 1975, as amended, enabling said Petitioner to maintain a driveway
having a width of 44 feet in lieu of the 30 foot maximum width allowed
thereby; and
WHEREAS, Petitioner has presented evidence and testimony establishing the
hardship created by strict compliance with the provisions of said Section
19.28(2); and
WHEREAS, the Corporate Authorities of the Village of Deerfield have
considered the evidence and testimony adduced and deem it to be in the best
interests of the Village of Deerfield to permit said variation from the strict
application of Section 19.28(2) so as to permit Petitioner to maintain a
driveway 44 feet in width in lieu of the permitted 30 feet in width.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Petitioner be permitted to maintain a driveway having
ONE: a width of 44 feet in lieu of the 30 foot maximum established
by Section 19.28(2) of the Municipal Code of the Village of
Deerfield of 1975, as amended, on the property commonly known as 10 Deerfield
Road, Deerfield, Illinois.
SECTION That Petitioner be required to comply with all other applicable
TWO: laws and ordinances of the Village of Deerfield as they apply to
the subject property.
SECTION That this Ordinance shall be in full force and effect from and
THREE: after its passage, approval and publication, as provided by law.
