ORDINANCE NO. 0 -80- 41
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1063 FOREST AVENUE, DEERFIELD, ILLINOIS
WHEREAS, MR AND MRS. JOHN RIVARA have petitioned for a variation from the
strict provisions of Articles 4.3 -6 and 10.1 -1 of the Zoning Ordinance of the
Village of Deerfield, passed April 17, 1978, as amended, to permit the con-
struction of a room addition to an existing non- conforming building while not
altering the existing 2.67 foot minimum single side yard which does not meet
the required 5 foot minimum and the existing 6.97 foot total side yard which
does not meet the required 14 foot minimum total side yard; and
WHEREAS, pursuant to notice duly published, as required by statute, a pub-
lic hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and Board
of Trustees its written findings of fact and recommendation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning Board
ONE: of Appeals are concurred in and adopted as the findings of the
fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships in
TWO: the way or carrying out the strict letter of the provisions of
the Zoning Ordinance of the Village of Deerfield as applied to
Petitioners' property, which is legally described as follows:
Lot 63 and 64 in Block 6 in Deerfield Park Land and
Improvement Association's Subdivision, being a
subdivision of part of the Southeast 1/4 of Section
29, Township 43 North, Range 12, East of the Third
Principal Meridian according to the plat thereof
recorded May 5, 1898 as Document Number 70892 in
Book D of Plats, pages 64 through 67 inclusive,
Lake County, Illinois.
SECTION That a variation from the strict provisions of Articles 4.3 -6
THREE: and 10.1 -1 of the Zoning Ordinance of the Village of Deerfield,
passed April 17, 1978, as amended, with respect to the property
hereinabove described, is hereby granted so as to permit the construction of a
room addition to an existing non - conforming building while not altering the
existing 2.67 foot minimum single side yard which does not meet the required 5
foot minimum and the existing 6.97 foot total side yard which does not meet
the required 14 foot minimum total side yard, all in accordance with the plans
presented and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the Zoning
Ordinance and with all other applicable ordinances of the Village
of Deerfield.
SECTION That this Ordinance shall be in full force and effect from and
FIVE: after its passage, approval and publication, as provided by law.
