AN ORDINANCE AMENDING ARTICLE 12
OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore
held a public hearing on the application of the Corporate Authorities of the
Village of Deerfield to consider certain text amendments to the Zoning
Ordinance relative to bulk regulations applicable to Senior Citizen Housing;
and
WHEREAS, in order to conform to the provisions of the pending application
of the Corporate Authorities pursuant to Section 202 of the Housing for the
Elderly Program and Section 8 of the Rental Housing Assistance Payment Program
the Plan Commission has also considered expanding the definition "Elderly,
Housing For:" as set forth in the Zoning Ordinance of the Village of Deer-
field, to include the handicapped, and
WHEREAS, said hearing was held pursuant to duly published notice thereof
and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after consider-
ing the evidence adduced, made written findings of fact and proposed
alternative text amendments to the Zoning Ordinance of the Village of
Deerfield to achieve the objectives sought by the Corporate Authorities of the
Village of Deerfield; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield
have determined that the recommendation of the Plan Commission will serve the
best interests of the Village of Deefield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Articles 12.4 -5 and 12.4 -12 of the Zoning Ordinance of
ONE: the Village of Deerfield, as amended, be and the same are each
further amended by deleting said Articles and substituting in
lieu thereof, the following:
"12.4 -5 Minimum Land Area per Dwelling Unit
In a Commercial Planned Unit Development containing
dwelling units, a minimum land area of 2,500 square
feet per dwelling unit shall be provided, except in
the case of Senior Citizen Housing wherein a minimum
land area of 600 square feet per dwelling unit shall
be required."
1112.4 -12 Parking and Loading Requirements
Adequate off - street parking and loading facilities
shall be provided and in no event shall the parking or
loading facilities be less than required in Article 8,
Off- Street Parking and Off- Street Loading, except in
case of Senior Citizen Housing wherein the required
number of parking spaces per.dwelling unit shall be

SECTION That Article 14.2 of the Zoning Ordinance of the Village of
TWO: Deerfield, as amended, be and the same is further amended by
deleting the definition of "Elderly, Housing For:" in its
entirety from said Article, and substituting in lieu thereof, the following:
"ELDERLY AND /OR HANDICAPPED, HOUSING FOR: New construc-
tion of multiple - family dwelling units or remodeling of
existing multiple- family dwelling units, the occupation
of which shall be limited to persons 62 years of age or
more or handicapped persons irrespective of age; pro-
vided, that if two or more persons occupy a unit, at
least one shall be either 62 years of age or more or
handicapped. Preference for occupation of this type of
housing shall be accorded to residents of Deerfield and
their families to the extent permitted by state and
federal laws and regulations. Any special use permit
authorizing construction or conversion of Elderly and /or
Handicapped Housing units shall contain provisions
setting forth the foregoing requirements and restric-
tions."
SECTION That the Village Clerk is hereby directed to publish this
THREE: ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in conflict here -
FOUR: with are, to the extent of such conflict, hereby repealed.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage, approval and publication, as provided by
law.
