ORDINANCE NO. 0 -79- 72 AN ORDINANCE AMENDING SECTIONS 22.129, 22.129A and 22.133 OF CHAPTER 22 OF THE MUNICIPAL CODE OF DEERFIELD OF 1975 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 22.129 entitled "Definitions" of Article 16 of ONE: Chapter 22 of the Municipal Code of Deerfield of 1975, as amended, be and the same is further amended by adding thereto subsections (a) (11) , (a) (12) and (a) (13) as follows: "(11) Lot No. 11 located on the west side of Park Avenue between Jewett Park Drive on the south and Hazel Avenue on the north. (12) Lot No. 12 located on the circular drive area lying directly west of the Milwaukee Road Rail- road Depot and consisting of 88 spaces to be reserved for compact cars only, plus areas reserved for motorcycles, mopeds and bicycle parking as designated by signs posted in the appropriate areas. (13) Lot No. 13 located between the Milwaukee Road Railroad Depot along the west side of the Railroad Tracks and on the east side of Chestnut Street." SECTION That Section 22.129A entitled "Parking fees" of Article 16 of TWO: Chapter 22 of the Municipal Code of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting subsections (a) and (b) in their entirety and substituting in lieu thereof the following: "(a) No vehicle may be parked in any of Lots 3, 5, 6, 7, 8, 9, 10, 11, 12, or 13 without paying the parking fees established therefor, nor may any vehicle be parked in any restricted portions of said lot(s) in contravention of any posted limitations relating to types of permitted vehicles. Parking in Lots 6 and 7 shall be limited to residents of the Village of Deerfield as evidenced by display of a current Village of Deerfield vehicle license. The parking fee for parking in Lots 3, 5, 7, 8, 11, 12 and 13 shall be twenty -five cents ($0.25) for each twenty -four (24) hour period, and in Lots 6, 9 and 10 the parking shall be ten dollars ($10.00) per month, payable in advance, for a three (3) month period. Permits to park in Lots 6, 9 and 10 shall be issued on a first -come first - served basis, except that the Corporate Authorities may from time to time reserve a portion of Lot 9 for lease at the rentals provided herein to operators of businesses located within the Village Center. (b) In addition to those penalty provisions prescribed in Section 22- 158'of this Article, any person violating any provisions of this Section may have his vehicle towed from any of Lots 3, 5, 6, 7, 8, 9, 10, 11, 12 and 13, impounded by the Village and shall thereafter be assessed an impounding charge of fifteen dollars ($15.00) and a storage cost of five dollars ($5.00) per day or fraction thereof for each day the vehicle is impounded." SECTION That Section 22 -133 entitled "Certain vehicles excluded" of THREE: Article 16 of Chapter 22 of the Municipal Code of Deerfield of 1975, as amended be and the same is further amended by the deleting of said Section in its entirety and substituting in lieu thereof the following:. "Section 22 -133. Certain vehicles excluded. (a) No automobiles unable to satisfy the requirements of Section 22 -131 of this Chapter 22 relating to the parking of vehicles within specified areas of a parking space shall be parked in Village Lot 12. (b) No vehicles of any type other than those reserved for employees of the Milwaukee Road Railroad Depot may be parked in the two spaces reserved and so designated in Village Lot 12 for use by employees of the Milwaukee Road Railroad Depot." SECTION That the Village Clerk is hereby directed to publish this FOUR: ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict here - FIVE: with are, to the extent of such conflict, hereby repealed. SECTION That this ordinance shall be in full force and effect from SIX: and after its passage, approval and publication, as provided by law.
