AN ORDINANCE TO PROVIDE FOR A LOCAL IMPROVEMENT
CONSISTING OF THE CONSTRUCTION OF CONCRETE PAVE-
MENT, CURB AND GUTTER, SIDEWALK, STORM SEWER AND
OTHERWISE IMPROVING ELM STREET, IN THE VILLAGE
OF DEERFIELD, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS
FOLLOWS:
SECTION A local improvement shall be constructed in the
ONE: Village of Deerfield, Illinois consisting of the
removal of approximately 1,870 square yards of
pavement; the construction of approximately 290 square yards of
aggregate base course, Type A 6 inches; the installation of a
bituminous concrete binder course and bituminous concrete surface
course, Class I and construction of approximately 2,600 square
yards of 6 inch thick Portland cement concrete pavement with
integral curb and gutter to a width of 28 feet back -to -back of
curbs; the removal of approximately 330 square yards of driveway
pavement and construction of approximately 26 square yards of
6 inch thick Portland cement concrete driveway pavement; the
removal of approximately 1,384 square yards of sidewalk and
construction of approximately 3,760 square feet of 5 inch thick
Portland cement concrete sidewalk; the installation of approxi-
mately 246 lineal feet of 10 inch diameter reinforced concrete
storm sewer, Type I with necessary catch basins, closed lid
manholes, Type A 4 inch diameter, Type 5 frame; and inlets, Type
A with special frame and grate; the installation of approximately
1,225 square yards of parkway sodding and other incidental traffic
protection, pavement marking and work necessary to improve Elm
Street for an approximate distance of 936 feet from its inter-
section with Franken Avenue North to its intersection with Central
Avenue in the Village of Deerfield, Illinois.
SECTION The said improvement shall be constructed and the
TWO: details concerning the same shall be in accordance
with the plans and special provisions and specifi-
cations entitled "State of Illinois- Department of Transportation
Plans for Proposed Local Agency Improvement Safer Off - System
Project SOS -D1 (147) Elm Street Improvement ", copies of which are
attached hereto and made a part hereof by reference.
SECTION • All materials of every )c,ir.1d used in the Construction
THREE: of this improvement shall be of first class quality
and suitable for the purpose for which they are to
be used. All, construction shall be done i.n a workmanlike manner,
under the supervision and subject to the approval of the Illinois
Department of Transportation and .the Board of Local Improvements
of this•Village, and use sha.'ll be made of existing grades for
roadway purposes.
SECTION The recommendation of the Board of Local Improvements
FOUR: of this Village providing for this improvement,
together with'the'estimate of the' cost thereof made
by the President of said Board, both attached hereto, are herein
Approved.
SECTION The improvement herein provided to be constructed
FIVE: shall be conditioned upon the V11145e of Deerfield
obtaining a Federal. Grant of Assistance under the
Safer Off- System Road Program of the.U, S•, Department of Transporm
tation for the purpose of payment of 75% of the construction costs
and 75% of the construction engineering of said improvement. The
remaining portion of the cost of said improvement, including
$7,150.00 being the amount included in the Estimate of the President
of the Board of Local, Improvements as the cost of making, levying,
and collecting the assessment herein with an additional amount of
$7,150.00 included as reserve for deficiency and interest, shall
be paid for by special, assessment in accordance with Article 9,
DXVsi,on 2, of the 111Xnos Municipal Code, approved May 29, 1961,
and the Amendments thereto; the provisXons of which are hereby.
adopted by reference as the applicable provisions to be employed
by this Village in regard to such local improvement, The sum of
$7,150,00 shall be applied toward the cost of making, levying and
collecting such assessment and the additional, sum of $7,150,.00 shall
be retained and used as reserve for payment of deficiency and
Xnterest; each said sum being in an amount Which does not itself
exceed 6% of the amount of the assessment As estimated.
SECTION The aggregate amount herein ordered to be assessed
$Z against the property to be benefited thereby, and
also the assessment of each lot and parcel of land
therein assessed, shall be divided into ten (10) installments in
the manner provided by the statute aforesaid, and each of said
installments shall, bear interest at a rate not to exceed 6% per
annum according to law, until paid. This Board does further determine
that there shall be assigned, as public benefit (including benefit
with respect to property owned by the Village of Deerfield and
located adjacent to the improvement area) 4 sum which will total,
the larger of either 150 of the amount to be 'assessed for payment
of the subject improvement, or $7,500,00,
SECTION For the purpose of anticipating the collection of
SEVEN: the various amounts assessed for each of the ten
(10) installments of said assessment, particularly
for the second and succeeding installments thereof, vouchers or
bonds shall be issued, payable out of said installments bearing
interest at a rate not to exceed 6% per annum, payable annually
and signed by the President of the Village of Deerfield, and
attested by the Village Clerk under the corporate seal of the
Village of Deerfield. Said vouchers or bonds shall be issued in
accordance with and shall in all respects conform to the provisions
of the aforesaid statute of the State of Illinois entitled "Municipal
Code" and the Amendments thereto. This Village Board shall be
further authorized to purchase and hold or otherwise call in and
redeem any such vouchers or bonds issued pursuant to this Section,
upon the payment or prepayment, in cash, of all amounts due or to
become due on said vouchers or bonds with accrued interest to the
date of payment, where such action becomes necessary pursuant to
administration of the Federal Grant Assistance Program under the
Safer Off- System Road Program in fulfilling•Village requirements
for payment of the Village's portion of said construction costs,
during the course of construction and pursuant to payment notice
submitted by the Illinois Department of Transportation. Such
vouchers or bonds so acquired by the Village of Deerfield may be
retained pursuant to the provisions of said vouchers or bonds
until maturity and all monies collected from subsequent installments
for payment of principal and interest on said vouchers or bonds
shall be used by the Village of Deerfield to reimburse itself for
cash, funds expended by the Village in purchase of such vouchers
or bonds.
SECTION The Village Attorney is directed to file a Petition
EIGHT: in the Circuit Court of the Nineteenth Judicial
District, Lake County, Illinois, in.the. name of the
Village of Deerfield, praying that steps may be taken to levy a
special assessment for payment of a portion of the said improvement,
as heretofore set forth, in accordance with the provisions of this
Ordinance and in the manner prescribed by law.
SECTION. All Ordinances or parts of Ordinances in conflirpt
NINE: heriewth•'are, to the extent of such conflict, hereby
repealed,
SECTION This Ordinance shall be in full force and effect
TEN: upon and after its passage and approval as provided
by law.
