ORDINANCE NO. 0 -79- 23
AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1328 WOODLAND DRIVE, DEERFIELD, ILLINOIS
WHEREAS, MR. & MRS JACOB STAP have petitioned for a variation from the
strict provisions of Articles 4.3 -6,3,b and 10.1 -1 of the Zoning Ordinance of
the Village of Deerfield, passed April 17, 1978, as amended, to permit
construction of a second story addition to an existing residence having a
minimum side yard of 6.6 feet in lieu of the required 8 feet and an aggregate
side yard of 16.1 feet in lieu of the required 20 feet; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION ' That the findings of fact and recommendation of the Zoning
ONE: Board of Appeals are concurred in and adopted as the findings of
fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioners' property, which is legally described as follows:
Lot 10 of Block 3 of Branigar Brothers Woodland Park, a sub-
division of parts of the north half of Section 29, Township
43 North, Range 12, East of the Third Principal Meridian,
Village of Deerfield, Lake County, Illinois, according to the
plat thereof recorded on August 5, 1924 in Book "M" of Plats
on pages 84 and 85 as document number 243980 in the office of
the Recorder of Deeds of said Lake County, Illinois.
SECTION That a variation from the strict provisions of Articles
THREE: 4.3 -6,3,b and 10.1 -1 of the Zoning Ordinance of the Village of
Deerfield, passed April 17, 1978, as amended, with respect to
the property hereinabove described, is hereby granted so as to permit construc-
tion of a second story addition to an existing residence having a minimum side
yard of 6.6 feet in lieu of the required 8 feet and an aggregate side yard of
16.1 feet in lieu of the required 20 feet, all in accordance with plans
presented and filed with the Zoning Board of Appeals.
SECTION That the variations hereby granted are subject to compliance by
FOUR: the Petitioners with all other applicable provisions of the Zon-
ing Ordinance and with all other applicable ordinances of the
Village of Deerfield.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage and approval as provided by law.

ILLINOIS ", passed by the President and Board of Trustees of the said Village
at a regular meeting thereof on the 16th day of April, 1979, and now in
full force and effect, all as appears on the records and files of my office.
