AN ORDINANCE AMENDING A SPECIAL USE
(ORDINANCE NO. 0- 72 -41)
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore
held a public hearing on the application of DI PIETRO BUILDING CORPORATION,
DEERFIELD INCOME PROPERTIES, and GENEVIEVE DI PIETRO (the "Applicants ") to
authorize an amendment to Ordinance No. 0 -72 -41 authorizing a Special Use in
order to permit the use and occupancy of certain real estate commonly known
as 12.0 Waukegan Road, Deerfield, Illinois, and hereinafter described, for an
office building on the undeveloped portion of the property as a Special use
under and pursuant to the provisions of Articles 5.2 -3, 6.2 -3 and 13.11 of
the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Applicants also presented to the Plan Commission a Prelimi-
nary Plat of Subdivision dividing the real estate into three (3) lots; and
WHEREAS, said hearing was held pursuant to duly published notice thereof
and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after consi-
dering the evidence adduced, recommended that said special use be granted
pursuant to certain conditions hereinafter set forth and that the Prelimi-
nary Plat of Subdivision be approved; and
WHEREAS, the President and Board of Trustees reviewed the report and
recommendations of the Plan Commission and concur in the Plan Commission's
recommendation that the allowance of the amendment to said special use and
the approval of the Preliminary Plat of Subdivision would be in compliance
with the applicable provisions of the Zoning Ordinance of the Village of
Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby affirmative -
ONE: ly find that the special use, as hereby authorized, fully
complies with requirements and standards set forth in Articles
5.2 -3, 6.2 -3 and 13.11 of the Village Zoning Ordinance, and the special use
of the real estate legally described on Exhibit A attached hereto as and for
an office on the portion of the property described as Lot 2 on the Prelimi-
nary Plat of Subdivision attached hereto as Exhibit B, an "automobile
accessory store" (Firestone Service Center) on that portion of the subject
property depicted as Lot 3 on Exhibit B, and a continuation of the present
uses of that portion of the subject property described as Lot 1 on Exhibit
B, be and the same is hereby authorized and approved.
SECTION That the approval and authorization of said special use and

given is subject to the requirement that all use, construction
and development shall be in accordance with all plans and representations
submitted and made by Applicants to the Plan Commission and President and
Board of Trustees and is subject to compliance by Applicants with all other
applicable provisions of the Zoning Ordinance and all other applicable
ordinances of the Village of Deerfield and is subject to the further express
condition that the parking on Lot 3 in the front yard of the Firestone
Service Center be permanently eliminated. Upon passage hereof, Applicants
shall execute a "Declaration of Restrictive Covenants" providing that seven
parking places located on Lot 1 as depicted on Exhibit B shall be reserved
for the use of Lot 2. Any violation of the conditions herein set forth
shall authorize the revocation of the special use hereby authorized.
SECTION That the Village Clerk is hereby directed to publish this
THREE: ordinance in pamphlet form and to record this ordinance in the
office of the Recorder of Deeds of Lake County at Applicants'
expense.
SECTION That this ordinance shall be in full force and effect from
