AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, RICHARD B. EMERY has petitioned for certain variations from
the strict provisions of Section XIII,G,1 of the Zoning Ordinance of the Village
of Deerfield, passed May 4, 1953, as amended, with respect to certain real estate
located in. the Village of Deerfield and hereinafter described on Exhibit A attached
hereto and made a part hereof to permit construction of an additional gasoline pump
island 17 feet from the front property line, and the construction of a 70 foot by
24 foot canopy to a point 5 feet from the front property line, each in lieu of the
required 50 foot setback; and
WHEREAS, pursuant tc notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed w..th the President and
Board of Trustees its report disclosing its failure to approve said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are not concurred in and adopted as the findings
of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioner's property, which is legally described on'Exhibit A attached
hereto and made a part hereof.
SECTION That variations from the strict provisions of Section XIII,G,1
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended, with respect to the property herein
described on Exhibit A attached hereto and made a part hereof, are hereby
granted so as to permit:
1. The erection and maintenance of a canopy structure, the eastern edge
of same being located 5 feet from the property line in lieu of the
required 50 feet;
2. The construction of a dispensing unit located 17 feet from the pro-
perty line in lieu of the required 50'feet.
SECTION That the variations hereby granted are subject to compliance by
FOUR: the Petitioner with all other applicable provisions cf the
Zoning Ordinance and with all other applicable ordinances of
the Village of Deerfield.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage and approval, as provided by law.
