AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1142 CHESTNUT STREET, DEERFIELD, ILLINOIS
WHEREAS, MR. AND MRS. MICHAEL EBNER have petitioned
the strict provisions of Sections V, VII, and XVIII,E of
of the Village of Deerfield, passed May 4, 1953, as amen
side yard of 4.15 feet in lieu of the required 5 feet, a
8.64 feet in lieu of the required 13 feet, and to permit
addition on the non - conforming residence; and
for a variation from
the Zoning Ordinance
led, to permit a single
total side yard of
the construction of an
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are concurred in and adopted as the findings
of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioners' property, which is legally described as follows:
Lot 3 in Foxworthy's re- subdivision of Lots 21 through 34 inclusive,
in Block 1 in the Deerfield Park Land and Improvement Association's
Subdivision in Section 29, Township 43 North, Range 12, East of the
Third Principal Meridian, all in Lake County, Illinois, and commonly
known as 1142 Chestnut Street.
SECTION That a variation from the strict provisions of Sections V,
THREE: VII, and XVIII,E of the Zoning Ordinance of the Village of
Deerfield, passed May 4, 1953, as amended, with respect to the
property hereinabove described, is hereby granted so as to authorize the
construction of an addition to a presently non - conforming residence and
permitting a side yard of 8.64 feet in lieu of the required 13 feet, all in
accordance with the recommendations of the Zoning Board of Appeals.
SECTION That the variations hereby granted are subject to compliance by
FOUR: the Petitioners with all other applicable provisions of the
Zoning Ordinance and with all other applicable ordinances of
the Village of Deerfield.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage and approval, as provided by law.
