AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, SHELL OIL COMPANY has petitioned. for certain variations from
the strict provisions of the Zoning Ordinance of the Village of Deerfield,
passed May 4, 1953, as amended, with respect to certain real estate located
in the Village of Deerfield and hereinafter described on Exhibit A attached
hereto and made a part hereof; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are concurred in and adopted as the findings
of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioner's property, which is legally described on Exhibit A attached
hereto and made a part hereof.
SECTION That variations from the strict provisions of Section XIII,B
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended, with respect to the property herein
described on Exhibit A attached hereto and made a part hereof, are hereby
granted so as to permit:
1. The erection and maintenance of two canopy structures, the
eastern edge of same being located 7 feet from the property
line in lieu of the required 50 feet;
2. The construction of two dispensing units located 21 feet and
49 feet, 6 inches respectively from the property line in lieu
of the required 50 feet; and
3. The placement of underground gasoline storage tanks, 25 feet
from the southern property line in lieu of the required 50
feet with all construction being proposed on a site of less
than 40,000 square feet.
SECTION That the variations hereby granted is subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the
Zoning Ordinance and with all other applicable ordinances of
the Village of Deerfield.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage and approval, as provided by law.
